Hearing Part 2:

Although the court deputy announced that they did a successful practice run on Wednesday with the Polycom camera video conference system, the same could not be said for today.

If the jail camera system worked, the courtroom or the witness cameras went dark. The judge agreed to allow the hearing to begin provided the Defendant KM (audio-only from the jail) received a hard copy of the expert witness PowerPoint presentation to follow along since he could not see the courtroom proceeding. KM confirmed on the record this was acceptable to him. His voice sounds loader, speaking clearly. It was in fact KM's idea to email him the presentation so the hearing could proceed.

Court resumed after the defense emailed the PowerPoint to the jail and the presentation was printed and given to KM to follow along.

The Judge explained that today's hearing is part of sentencing, and expert witnesses will be broken up into groups for their video testimony to the court.

Dr. Erin David Bigler was the first witness that testified today. He is a Neuro Psychologist that's also an expert in neuroimaging -- better known as CAT scans and MRI imaging of the brain.

Dr. Bigler testified about frontal lobe, traumatic brain injury, and did his best to explain white matter surrounding the frontal lobe, and the correlation of brain structure and behavior. (Not exactly a CTE defense since the defendant already admitted guilt).

The Attorney for the Government put Dr. Bigler under a difficult cross-examination. He had to be reminded several times that the witness was presenting correlation and not a defense.

Court adjourned at 3:38 pm and will resume on Friday.

It appears that the Court is waiting on the attorneys to announce their schedule/availability to the Court.

I participated in the last video conference hearing and very little progress made in-between all the troubleshooting with equipment/connection. I must give KM credit for offering the solution to email him the PowerPoint at the jail or else nothing (Exh) would have been entered on that date.
