The judicial system and the lawyers in this case are a joke. This woman's familly have been waiting for 5 years for some sort of resolution. In the meantime, the accused has been allowed to go work in Louisiana and travel to Colorado, while he was on probation. NOW, suddenly, he/they pull a rabbit out of the hat and ask for DNA from the Hot Springs - Not Hot Springs Village? - chief of police. Like they haven't had time to request that in the last five years. What a bunch of goobers. The only question I've had is who was Duck calling on 12/22??

I'm sorry for Dawna's kids and her mom and her family that this has just drug on and on and on. The suits and robes should be ashamed.

I don't remember specifics on Duck's phone calls, could someone refresh my memory on this 12/22 call? TIA
 
I reread through this thread and didn't see this man's name come up. He claims he never met Dawna. Most of the older articles posted on here indicated that there was always one person of interest, Kevin Duck.

Despite this last minute request, it looks like the judge won't delay the trial.

The motion by defense attorneys alleges that “David Flory had a relationship with the victim and was a person of interest in the murder of the victim.”

Flory, speaking to Fox 16 News by phone from an out-of-state work trip Thursday morning called the allegation “totally untrue.”

“I have never even met Dawna Natzke. It is the absolute craziest thing I have ever heard in my life,” Flory said. “I was never questioned in the case. The only phone call I have ever gotten regarding this investigation was on Tuesday when I was told I had to provide a DNA sample.”

According to Flory, the only basis he can think of for the allegation is a rumor that began circulating in January 2012.

“It was a few weeks after Ms. Natzke’s body had been found, and an officer in my department informed me that a retiree at the firearms range had speculated to others that I had an affair with Ms. Natzke and probably killed her,” Flory said. “It was a bad joke that became a bad rumor or a purposeful smear campaign.”

According to Flory, he had no notice that his DNA would be sought by Duck’s defense.

“I got the call on Tuesday about the DNA sample, and the next thing I know it is in the paper while I am working out of town. Now, my reputation is at stake based on a bad rumor or a bizarre smear campaign.”

A DNA sample from a former Hot Springs police chief submitted in connection with the 2011 death of a Hot Springs Village police dispatcher was excluded as a match to DNA found on the victim, the former chief's attorney said Friday.

John Wesley Hall, Flory's attorney, told The Sentinel-Record that he filed a motion to have the DNA purged Friday afternoon as soon as tests at the state Crime Laboratory confirmed Flory was excluded as a possible contributor to the DNA sample found on Natzke.

Hall said Flory voluntarily went to the Crime Lab in Little Rock to be tested Friday morning and "literally submitted his sample directly to the person who would be testing it."

He said in his response to the order requesting Flory's sample that he had argued the request was "unconstitutional on its face" since it was essentially done without any probable cause being presented. He also noted that the order violated the spirit of a gag order because it was not done under seal.

"The defense motion utterly fails to state any factual basis for alleged probable cause to take DNA from him," he wrote.

He obviously has rocks in his head instead of brains so it wouldn't surprise me.... either that or he just made it up out of thin air, which also wouldn't surprise me; anything to put off the inevitable.
 
Looking forward to this trial. Hopefully it actually starts tomorrow.

Attorneys for a man accused of killing a Hot Springs Village police dispatcher more than five years ago pleaded with the judge during Monday's pretrial hearing to exclude evidence or testimony of the man's prior criminal history or of a state child-services investigation concerning his son.

The first-degree murder trial for Kevin Duck, 33, will begin at 8 a.m. today at the Garland County Courthouse. Duck is accused of murdering his girlfriend Dawna Natzke, whose body was found Dec. 31, 2011, submerged in a pond near the Jessieville community in northern Garland County.

Wright had not ruled on the request as of late Monday.

At issue in nearly all of the previous requests to delay the trial were telephone triangulation records that detail the calls Duck made after Natzke vanished Dec. 22, 2011.

Cellphone records show Duck made a call at 7:46 a.m. on Dec. 22, 2011, from a Hot Springs Village gate and numerous calls from the junction area between Arkansas 7 and Arkansas 298 -- the same area where Natzke's body was later found.

Records show that Duck made a phone call at 8:34 a.m. that day six-tenths of a mile from where Natzke's body was found and at 9:02 a.m. Duck made a call six-tenths of a mile from where Natzke's burned out car was later discovered.

When Janske spoke to the Democrat-Gazette in January, he said facts in the case were limited.

"They're relying on the assumption that he was the last person to see her [Natzke] alive," Janske said.

The cellphone timeline is consistent with what Duck has claimed all along, Janske added.

"He went looking for her. He drove down those same roads searching for her and he made a bunch of phone calls to friends and family," he said. "I think it can be argued that the cellphone records will help the case."

Not sure if who he called was ever disclosed.

I would think those people would be called to testify at the trial as to what their conversation with Duck was about at the time.

I thought I remembered hearing he was phoning his mother. I could be wrong though.
