The one I meant was someone(s) who posted a claim to know, not as a theory, that she was struck by a car on the bridge and knocked into the creek. This may have been later deleted.

Clever girl :rocker:

If you read the whole text, you will see what's required to make an arrest, in principle. The police make an arrest if they have a reasonable suspicion about the person in question. They do not build a case until all the conclusive evidence has been gathered. It can take forever. A reasonable suspicion is not the complete set of evidence. Most of the arrests on suspicion of murder are made within 48 hrs, statistically.

About the car. Ordinarily, the police can not keep property without an owner's consent, unless obtained as a result of an arrest, under a warrant, or if the property is material evidence needed to prove a crime. If property is seized and the person is later found not guilty, the property is returned.

A warrant for a person's arrest is a written authority from a magistrate or judge. A person arrested on a warrant is taken into custody and must be brought before a court. The police can arrest someone without a warrant and the majority of arrests are made without a warrant. The police can arrest someone without a warrant who (amongst other reasons):
-- is caught committing an offence [Summary Offences Act 1953 s 75]
-- is reasonably suspected of committing an offence or is about to be commit an offence [Summary Offences Act 1953 s 75]

What is a reasonable suspicion?

<<Reasonable suspicion is a legal standard of proof that is less than probable cause, the legal standard for arrests and warrants, but more than an "inchoate and unparticularized suspicion or 'hunch' "; it must be based on "specific and articulable facts", "taken together with rational inferences from those facts".>> (wiki)

Grannie, I'm not going to continue to argue, you were quoting a wikipedia article on citizens arrests, quite different for Police investigating a murder case.. I see others have also answered some of your points(Hawkins wrote a good post). I did read the article. And I also have some knowledge/understanding of how Police work in these situations. They do need to have sufficent evidence to make an arrest so that they can get a conviction. It is no point them going in and arresting on 'suspicion' on a case such as this, if they don't have what they need to make a watertight case, they will risk not getting a conviction and that is the ultimate outcome of this..a conviction

Regarding the car..this is not an 'ordinary' situation. The police did have warrants. They are also able to hold items that are relevant to the crime untils such time as yes an arrest is made(and until trial is over if the items pertain to it) or they determine the items to be of no relevance. Seeing nobody has been delared guilty or cleared of innocence and this is an ongoing murder investigation, then they have no need to return said items yet.

(P.S. we are all entitled to our opinion including yourself, on if they may or may not have found evidence or on any other aspect of this case. But a an article on citizens arrest does not relate to whether police should or shouldn't arrest someone in a murder case, based on reasonable suspicion. The defence could easily blow that out of the water)

Someone (who is into tech things) explained several weeks ago that the initial triangulation is done to the mobile towers (3 at least) in the area. But apparently, later, with the cooperation of the telecommunications company, they can pin-point the location to a narrower area. The "150m" thing was reported by the media (TV) the same day the body was found and they also said that new searches were made by SES and police of the backyard of the family home and the neighbours backyard that same afternoon after the body was found. I gather the police thought the iPhone could have been with the body, but when they found her, they knew it wasn't and renewed their search for it. IMO.

Thanks for that CaseClosed. I just wondered why they didn't pinpoint the location sooner, as I thought they would have had full cooperation from the phone company from the start. They seemed so focused on finding that phone. I hope they have it now.

Morning all.....just finished 'catching up' on posts (phew...wipes forehead).

Mountainhigh...it's SO frustrating with the way the media are 'reporting' isn't it? I noticed while going through the posts (someone teach me to quote/link!) that the Courier Mail say Allison 'disappeared' but then was SUBSEQUENTLY murdered. Ordinarily I would think this was VERY significant to the scheme of things, however with all the various 'wordings' reported, I guess we just have to disregard it. I'd been waiting for someone to pick up on the phrase as I read, but unless I have missed something, I don't think anyone has commented on it. Any thoughts?

Hawkins....you're getting quite 'cuddly' with a few margeuritas in you! I'd previously mentioned not being all that interested in 'crime' however with you mentioning Rachel Antonio from Bowen, I recall that case so well, as I lived in Mackay at the time, and it just brought home to me how if you're somewhat 'local' you DO feel more of a connection to things near to you. If I recall correctly, Rachel pretended she was pregnant which was a possible motive for her murder, and it was speculated that she had 'borrowed' a friend's urine to demonstrate a 'positive' pregnancy test to that guy. Very sad....I can still picture she and her parents....who of course have no 'closure' with no body.

Indromum you are absolutely AWESOME....and we appreciate all your input. (Just personally....I am Wozzle enough to creep up the driveway with a torch to look at number plates (I'd take Willough with me for courage!)....'Scrap' and I have a 'connection'.....no not a 'dog whisperer' unfortunately - my avatar is 'Scrat' coincidentally.)

Re 'arrests': I've been wondering whether the QPS would only need enough evidence to arrest the murderer, and having done so, the conspirators/associates would naturally fall into place as 'collateral damage' (ie I suggest someone would squeal like a pig to save his own porky pink skin!!) Or would they want an air tight case on ALL persons involved? Wouldn't you just LOVE to be a fly on the wall in that Indro command centre....I'm picturing enormous white boards and pin boards with photos and arrows etc. in multicoloured textas (or have I just seen too much TV?)

Re SETTLE number plates. To the person asking (sorry no 'quote'!...I think Liadan and KG1) about why the word 'SETTLE'.....as well as referring to closing a deal on property as already mentioned, other posters informed us that 'Settle' is the title of one of GBC's companies (there are links way back there somewhere).

Spratsmum - haha on wearing the baby pooh coloured ribbon for identification. However it's not such a silly idea if people go to the cricket match and want to check out other websleuthers. If someone approaches you and looks a bit 'suss' you could always deny the ribbon means what it does, but if they look kosher you could whip out your 'moniker' to show them. If they look at you strangely, no harm done. But....one must be careful always. (I've had meetings with internet persons....but that's another story for another time and place!! All good, however).

Must away to work...but before I go it's amazing how Allison impacts us in unexpected ways. When Spratsmum was suggesting how difficult it would be to dress a floppy body, I just happened to shortly after be doing the very same thing (yes, I'm a nurse and deal with death often) and as I tended to this dear old man, I thought of Allison....both the contrast between a 'life' completed like the old fellow I was caring for in his 80s (yes, and like my nearly 12 year old Leo!) and poor Allison whose life was cut short, and treated with so much disregard after death. I am not religious at all, but I still 'speak' to deceased persons as I ready them for their trip out of the ward. I wonder what was said to poor Allison as she reached her final resting place......if anything. Sigh.

Welcome all you new posters.....there are quite a few of us popping up now, who've read everything thus far, but contributed little. Great posts...thankyou!

Great post. A nice summary and very positive. On the issue of the SETTLE plates, I can shed a little light. I worked AROUND some of the people involved a few years ago (please appreciate I have to be a little circumspect here) and it was in fact a business partner, now a former business partner, who came up with the word SETTLE to market himself as an agent ("settle" being a positive result of both a purchase and a sale; it also suggests calmness, reliability ... I recall the brainstorming involved). He was going to use it on stickers, calendars etc to mail out to prospective clients etc. GBC surprised him by purchasing the number plate for him - a sign of goodwill and support within the partnership. Fast forward a few years ... partner has left business and apparently not taken the plate with him. I don't know what went down at this juncture, having moved on professionally myself by that stage - maybe GBC took possession of the plate because he did, after all, pay for it or maybe the former business partner said, "Take it - I've no need for it anymore". After this, presumably, GBC thought he'd add to the SETTLE stable with the similar plates, all a tax deduction, I guess.

Radster,

Another great post. Thank you for sharing your knowledge and expertise. :)

Hmmm...what if the perp killed her (maybe with a "love tap") and at some stage later (possibly in the driveway) ran over her. It could have been at attempt to cover up the initial crime???
Such an act may have also left evidence on one of the vehicles/or driveway that caught the attention of police.
The perp may have missed "it" cleaning up in the dark the night before; or maybe it was "suggested" she was killed by a car thief as she went outside for her "walk" the night before.

However, my gut tells me that most of the above is incorrect and that the story suggested to police would have been that Allison was suicidal and that the plan was for her to "just disappear". Now that she has been discovered, there will be an argument put forward to claim self-defence/manslaughter (if someone is charged).

All just guessing though and I doubt any of it could be confirmed in the near future...which means it's time for me take a break! To the powers that be, may we please see an arrest or substantial info today??? (....anything is worth a try).

Any idea on the "SETTLED" plate??...did that one come later on??

Allison Baden Clay went for a walk on the night and she never came home, as her body had been knocked off a bridge in the dark by a drunk driver who may never even have known what he did. In the footage of the lady's husband, he LOOKS and SEEMS innocent. I think the Police Results can only show his innocence yet again.

...before I go though! Do any locals recall if there was ANY rain/drizzle at all on the night/morning of Allisons' disappearance? Police may have noticed that it was dry under one vehicle (or trailer etc) and yet wet under the car/s.

Hmmm!! I remember this post. For this to be correct, it means Allison would have to have been walking over the bridge that night to start with. That wasn't addressed in this post either. Where was her car? Why would she even be there? It was a bit too far to walk. I don't think she'd drive her car all that way just so she could walk over the bridge.

Yes, the bridge is like 12 km away! - IMO, some posters show up here for a short while just to cause upheaval, maybe because they are supporters of the husband, and post anything to disrupt the discussion. If it doesn't make sense, it did not happen IMO.

Do you also remember the 'tenderly placed her in the grass' or something along those lines... contradicts this post?

Pretty brazen to move a C21 office into a place not yet authorized by the franchise. I'd say it might even be a breach of contract. But then again I think if he had to move out of the huge premises he couldn't afford, what else was he suppose to do?

I spoke to one of the retailers at Toowong Village this morning and she said GBC is currently operating out of a serviced office complex on level 5 of the Tower so it looks like C21 is now a one-man operation.

This info was not put here so this man could be stalked, btw.... Toowong Village has some pretty switched on security guards who won't hesitate to politely escort you from the complex.
