I believe the police would have a stack load of evidence. I don't think they would risk getting this one wrong considering the nature of the crime.

I know that some people think the police were a little "trigger-happy" with their arrest, trying to bring the local townsfolk back to a feeling of security, and so they rushed into it.

I can assure you all that police never make accusations like this without substantial evidence. If it turns out he was innocent, it would have huge ramifications for the police, and they'd rather still be looking for the real criminal and have the media hounding them to do their job better and hurry up, than to suffer the public humiliation of getting the wrong guy.

It's like in the game of cluedo, you don't make your accusations until you've ruled out all other possible suspects. You get one shot at it, so don't go messing it up.

Yes, once they had that DNA they knew they had him in the bag, even if he tries to say it was consensual sex that happened at say 10pm (for arguments sake), then they can rule that out by looking at where the semen was exactly, if she had any injuries which showed she had been forced, bruises on her legs, arms, that kind of thing. Does he have scratch marks on him. It's not like the swab is the only connection to a rape they have, there's a lot of corresponding evidence that goes with that which can also be validated as having occurred at or near the time of death.

I think it very unlikely to be consensual when she was ill with croup.
 
Is it able to be determined how long semen has been exposed, tracing back to an approximate hour, or even less of a time frame, of when ejaculation occurred?

Croup (or laryngotracheobronchitis) is a respiratory condition that is usually triggered by an acute viral infection of the upper airway. The infection leads to swelling inside the throat, which interferes with normal breathing and produces the classical symptoms of a "barking" cough, stridor, and hoarseness. It may produce mild, moderate, or severe symptoms, which often worsen at night. It is often treated with a single dose of oral steroids; occasionally epinephrine is used in more severe cases. Hospitalization is rarely required.

I believe there could be a way to narrow down the time frame in some instances ...Sperm is said to live for only 24 hours but out side of the body only 1 hour. And how do I say this delicately? Perhaps by how something is digested??

About Croup
Croup is a condition that causes an inflammation of the upper airways — the voice box (larynx) and windpipe (trachea). It often leads to a barking cough or hoarseness, especially when a child cries.

Most cases of croup are caused by viruses. Those involved are usually parainfluenza virus (which accounts for most cases), adenovirus, and respiratory syncytial virus (RSV). Croup is most common — and symptoms are most severe — in children 6 months to 3 years old, but can affect older kids, too.

I was surprised to hear she had croup. It generally affects younger children around 5 years and younger.

My 17 year old sister gets it at least once a year, it gives her a really bad cough. She takes cough medicine for it, I believe.
 
We do know at about 11pm she was on FB and exchanged goodnight messages with her boyfriend. She said she was feeling unwell and i would imagine she went to bed after that.

I am a newbie on this site. Been lurking around for a few days... Here goes my theory...

He gets un invited to a party that CR hosts. Feels depressed and goes on a drug/alcohol binge. Calls CR on the fateful night and she agrees to see him. He makes some kind of advance and maybe she responds but then starts feeling sorry for cheating on her new love. Things get emotional and she asks him to leave. At that point something triggers his anger and he goes berserk with her. Parents wake up in the meantime and he finishes them too. Being drug affected, does not really fathom what he has done. Once the affect of drugs wears off, he does not have much recollection of events of the previous night. That is why he probably behaves normal.

Unless he was a hardened criminal prior to this incident, it would have been extremely hard to behave normally after what took place.
 
If the sex was consensual, wouldnt there be some form of kissing involved?

Croup is notoriously cantagious. Surely he would have caught the virus from her

Maybe he just tried extremely hard, and succeeded. He might also feel that he performed an act of justice, did something right. He had been denied what he most treasured, and so it was his right to make sure no one else could have her. Being self gratified with what he had done might enable him to act cool with it.

In the words on an old Aussie police show which is no longer aired, "He's one sick puppy".

Sperm lives up to 48-72 hrs, generally, but even up to 5 days. (have done IVF). It depends on the man too. I think they can tell to about an hour how long it has deteriorated. So, if a rape occurred at 1am, and he said the sex happened at 10pm, he's gone.
