‘A UK forensic scientist says it is 7.2 million times more likely than not that Hayley Dodd contributed to DNA found on a strand of hair in the car her alleged murderer was driving the day she disappeared.’

"The contents was examined again 14 years later, when a single strand of hair was discovered by a scientist at PathWest.
In November 2015, WA Police took the root part of the hair to the United Kingdom for analysis by Mr McDonald, who testified on Wednesday in WA's Supreme Court about the complex scientific process he had used to test it.
He told the court levels of DNA were very low, but he concluded that Ms Dodd could have contributed to it
Mr McDonald said he also found traces of male DNA on the hair, which he said could be explained by the way it was stored for 14 years with other debris from the ute floor, or by a "drop-in" event that happened during the testing process.
He said after using specialist computer software to analyse the results, he came up with a "likelihood ratio" that it was 7.2 million times more likely than not that Ms Dodd and an unknown male, through "a drop-in event", had contributed to the DNA.
Mr McDonald said he also examined a DNA sample from Mr Wark, but his testing "gave no clear indication that he had contributed to the result".
Mr McDonald testified he was aware separate testing done on the shaft of the hair had also found DNA from Ms Dodd.
"To have two of the same I think is significant, it gives greater credence to my belief that this could be a mixed profile."

"We cannot discount the importance and possible effects of other factors which would affect any type of DNA samples: the age of the sample, the way the sample has been collected and stored, and any external forces that may have altered the state of the DNA (for example, exposure to very high temperatures, soaps and cleaning agents, or to corrosive substances)."

"Several Badgingarra residents told*The Sunday Times*two detectives investigating unsolved mystery visited the town on Tuesday.
“They were detectives from the special crime squad and they were asking about an early model Holden Commodore ute, up to 40-years-old,” one resident said."

‘The man accused of abducting and murdering WA teenager Hayley Dodd told police they were "wasting their time" investigating him because he was not guilty.

Francis John Wark made the comment at the end of a three-and-a-half-hour interview with police, recorded while he was serving a jail term in Queensland for abducting and raping a hitchhiker in the north of the state in 2007.

The interview was played to WA's Supreme Court today during Mr Wark's judge alone trial on a charge of murdering Ms Dodd. Mr Wark has pleaded not guilty to the crime.

It was conducted in November 2013 by WA Police, who travelled to Townsville to talk to Mr Wark as part of a cold case review of the investigation into Ms Dodd's disappearance from Badgingarra in WA's wheatbelt on July 29, 1999.

She was last seen walking along a road near where Mr Wark owned a property, and prosecutors allege he lured her into the borrowed white ute he was driving, then murdered her before disposing of her body.

Mr Wark has always denied any involvement in the teenager's disappearance. At the end of the interview, when asked by Detective Sergeant Darren Bethell if he had anything to say, he replied:

"I'm not guilty. You're wasting your time."’

Is there any proof of the accused having been in hospital ?
The way this has been written leaves an uncertainty about the accused having being in hospital, maybe just making an alibi again...

Motorbike crash alibi

Mr Wark had earlier been quizzed in detail about his movements on the day.

He told police that at the time Ms Dodd is alleged to have disappeared, from what he could remember, he had shopped for supplies in Moora, which was about 50 kilometres away, before going home, putting away the shopping and setting off on his motorbike to travel to Perth for a party.

During that journey he had a crash and he told the detectives the first time he heard about Ms Dodd's disappearance was when he was in Royal Perth Hospital.

He said a friend who had stayed with him in Badgingarra told him, "someone's disappeared up near your place," and so he tuned into the TV.

"They said there was a girl missing or something," he said.

Detective Bethell asked him what his reaction was, and he replied: "Shocked, I wondered what went on or what was going on".

Mr Wark said he and his friend decided to contact police because they were in the area on the day of Ms Dodd's disappearance, and after making "a couple of calls" officers came and interviewed him.

The court heard that in that statement, Mr Wark maintained he did not see any hitchhikers on the road on the day in question, but said if had seen any he would have picked them up.

He also claimed he would have remembered seeing a hitchhiker, because he did not see many people hitchhiking on the roads in the area, "especially young girls".

"Former Badgingarra resident Keith Skelley said he saw Mr Wark at the town’s roadhouse on the day of the alleged murder.
Prosecutors say Mr Wark killed Hayley before arriving at the roadhouse at 1.36pm. Mr Ryan asked Mr Skelley if he noticed anything “unusual” about Mr Wark’s demeanour. “No, Frank was just normal Frank,” he said."

"Mr Wark is challenging DNA evidence. Scottish DNA expert Professor Allan Jamieson has disagreed with the conclusion reached by the State’s forensic scientist Andrew McDonald over a hair found in the ute Hayley was allegedly lured into.

Mr McDonald concluded it was 7.2 million times more likely than not that Hayley contributed DNA to the hair.

Professor Jamieson said due to the “paucity” of the evidence he did not believe a reliable opinion could be developed".

He told her that she would be “safe with him” and that he knew the local police and could take her to them if she wanted.

Instead, Ms M agreed to have a coffee at his house.

He later refused to drive her home and when she tried to leave, he hit her twice in the head with a piece of wood.

When she asked him what he was doing, he said: “This is rape”. He said he “liked her” because she was “feisty”.

Mr Wark dragged her back into the house, stripped her naked, tied her to a bed and raped her several times. The ordeal ended hours later when she freed herself and fled.

Naked and carrying a rope, Mr Wark gave chase but the woman reached a neighbouring house and police were called.

Ms M said during the assault, Mr Wark told her to “take the earring out, b....”."

"Mr Wark was questioned about a statement made by his boarder, convicted paedophile John McConnell, who has since died, which said he arrived home to find that the indicator lever on his utility was broken.

Prosecutors say the broken indicator lever was a sign there had been a struggle in the vehicle.

Mr Wark said he had “no idea” if the indicator lever was broken or not, but said it “might’ve fallen out”."

‘The lawyer defending a convicted rapist accused of murdering West Australian teenager Hayley Dodd in 1999 says a key piece of physical evidence against his client could have been planted by police.

The judge-alone Supreme Court of WA trial of Francis John Wark is wrapping up, with defence counsel Darryl Ryan targeting an ankh-shaped earring matching a description of the style the 17-year-old was wearing when she went missing in his closing submissions on Friday.’

‘The trial heard the evidence bag was open because the adhesive had delaminated.

'The possibility that the earring was planted is open and it cannot be excluded,' Mr Ryan said.

'There's an opportunity for that to have happened.

'If everything had been done by the book, we'd have nothing to point to.'

‘Mr Ryan said police had a motive to plant the earring, which was mass-produced and depicted an Egyptian symbol that was thousands of years old.

An officer took over the investigation when no progress was being made and things that should have been done were not being done, and if that emerged at a pending inquest, police would have been embarrassed, Mr Ryan said.’

Her fixture on the long-term missing persons list would have led many to assume there would never be an answer to this question.

Then, in 2013, came a breakthrough — a newly discovered piece of evidence and improved DNA testing finally linked a suspect to the crime.

Now after years of heartbreak, Hayley's family and friends will be hoping for some closure when a Supreme Court judge delivers her verdict in the trial of Francis John Wark — the man prosecutors say abducted and murdered the teenager, before disposing of her body, never to be found.’

‘Justice Jenkins said because of the large amount of evidence, and the requirement for her to provide written reasons, it would take some time before she could deliver her verdict.

She said she expected to hand down her decision by January 15, and remanded Mr Wark in custody to await the verdict.’
