I hope he pleads guilty .. as more time goes on with this case the worse it seems to me.

Yeah, me too. It all seems exacerbated by the lack of a plea......it's like it's dragging on and on.:tantrum:

Must be excruciating for Morgan's family. Holding them in my heart through this awful time :rose:

Can he go right to trial, if the evidence is enough for a trial as it must be, without entering a plea?

Bet there's a lot of discussion going on in regards to admission of guilt to lesser degrees of murder.

Because I am completely unfamiliar with many legal terms, I looked it all up. Just thought to share this info in case anyone else needs to know:

ARRAIGNMENT:

Is the procedure when a person is called to the court, (generally being the District Court or the Supreme Court) the offence is read to him or her, and the person being at that stage an accused person pleads guilty or not guilty to the charge.

In the District Court and the Supreme Court, this procedure is generally formally conducted.

In the District Court and the Supreme Court, if a person pleads not guilty the matter is then listed for trial, generally before a jury.

So if the arraignment is in August, does anyone know when we can expect the subsequent trial to begin?? (a rough estimate, even.....)

Mr Kelsall did not appear in court on Thursday, but his lawyer George Breton indicated he will plead not guilty to his charges of murder, indecent assault and aggravated break and enter.

Mr Breton said his client will also plead not guilty to two child *advertiser censored* charges and one charge of larceny, both of which will remain in the local court, with hearing dates yet to be set. Outside court, Mr Breton said Kelsall’s waiving of his right to a committal hearing was just a “procedural matter”.

He reiterated that his client was “settled” in custody and was committed to fighting the charges.

MORGAN Huxley’s accused killer has been committed to stand trial for murder, with his lawyer saying he will allow the allegations “to be determined by a jury”.
Kelsall, 21, made a brief appearance on the screen of Central Local Court, wearing glasses and with curly hair.
The court heard theft charges, including an allegation of stealing Mr Huxley’s mobile, will remain in the local court, with a hearing date to be set next month.
 
He reiterated that his client was “settled” in custody and was committed to fighting the charges

The only way I see him winning that fight is if he sneaks up on the charges while they're sleeping, with a big knife...
 
So I take it there will be several court appearances for the different charges:

The charges of possessing child *advertiser censored* will return to Central Local Court on July 28, to set a hearing date.

The court heard theft charges, including an allegation of stealing Mr Huxley’s mobile, will remain in the local court, with a hearing date to be set next month.

Then there's the murder charge:
The matter will return to the Supreme Court on August 8, for arraignment.

Mr Kelsall also entered a plea of not guilty in relation to two counts of possessing child *advertiser censored* before Central Local Court.Those matters will be dealt with by a lower court.
