Purely hypothetical, but if GT were to ever confide or confess in any manner to someone, what would happen?

I guess if he did and it was recorded, it would probably count as "new and compelling" evidence, and he could quite well be retried. I'd like to hear what any of the legal people in here like JCB or Ksks would have to say about it.

I found this:
(quote)
“Finality of a verdict of acquittal does not necessarily prevent the institution of proceedings, or the tender of evidence, which might have the incidental effect of casting doubt upon, or even demonstrating the error of, an earlier decision. There may be cases where, at a later trial of other allegedly similar conduct of an accused, evidence of conduct may be adduced even though the accused had earlier been charged with, tried for, and acquitted of an offence said to be constituted by that conduct. R v Z, R v Arp and R v Degan are cases of that kind. In such cases, the earlier acquittal would not be controverted by a guilty verdict at the second trial.”

And this from a 2012 article:
(quote)
The Queensland Government looks set to amend the state's double jeopardy laws to allow retrials in some historic cases.

The double jeopardy rule prohibits the prosecution of a defendant on the same or similar charges after acquittal.

But Attorney-General Jarrod Bleijie says he is considering amendments to the law to allow for retrials of serious offences where either fresh and compelling evidence has come to light or where the acquittal is tainted.

I remember when I listened to the recording, I had to listen through headphones because my big dog got really upset and fretful when he heard Warriena's screams. No matter how low I turned the volume. :(

BTW Same happened with my dog when i was listening to part of the audio recently, had to turn it off.

I am very late to this case and only read a couple of your latest threads.
Nonetheless, have enjoyed reading all ( almost ;) ) of everyone's posts on this terrible case. From one of your links I'd just like to add something that jumped out, even though you may have all discussed this one before.

Tostee is asking on social media on how to make new friends and recounting his exploits trying to pick-up & sleep with women. Anyway he asks BIB below.

The following night he was out on the town again. He kissed one girl and asked her if she wanted to take it further. She gave him her number and left to find a friend. He got two more numbers before the night was out. He rated one a 6/10 and admitted he couldn't even remember the third.

He called and messaged the first girl but got no reply.

"Not sure what more I could have possibly done though," he lamented. "Maybe bought her more drinks? Would this be unethical?"
...............
"Is it normal to get screwed around like this?" he asked his forum mates.

"In my mind, I just want to get the second one down," he wrote. "So then I'll know it's not a fluke."

BIB ^ Getting someone so drunk so that you can have sex with them when they are physically unable to consent......? It implies he is considering this.
In the UK , legally, this would be rape.

I'm just wondering about all his recent conquests...... and what they do/don't remember

This is why justice can rarely be served.

Because of judges that dont allow certain evidence to be shown to the jury. Jmo.

Now after her death. TOstee was still bragging and humiliated women that he tried to conquer.

But the judge didn't let the jury see this.

So imo. Why leave the jury blind?

And then you start reading about Tostee and it's all bad. Committing forgery as a teenager. Something was already horribly wrong, right there.

RSBM

He then sold all of those forged IDs (about 500 of them) to underage schoolies for them to attend clubs and events that they should not have been at, at their age. Assist them with their underage drinking, and their admission to the raunchy clubs. I thought he was 18 when he did this .... no, he was 17.

WHEN Gable Tostee was just 17 ......
It was a fake ID racket, designed to take advantage of the Gold Coast’s Schoolies Week.
The mate would bring Tostee $60 and a passport photo. Tostee would hand over a product detailed with the close eye of a perfectionist.
Together they’d produce hundreds of the cards over more than a year .....
Police raided the trio in late 2004. By then, the business had brought in $30,000 for the young entrepreneurs.

Omg. They've let loose a lunatic. This is a joke right? A freaking joke?

This guy got to live out a major fantasy. Ruminated on it before he did it. Scared a previous date on the same balcony, and had photo image of a chalk body outline on his phone. He orchestrated his very own snuff film. And he Got to re-live it every time tape was played in court. Now he's free to go home and WRITE about it as well.

I'm barfing. Seriously. This guy is DANGEROUS.

Sent from my XT1254 using Tapatalk

I can certainly see why the charge was murder .... given all we now know. That chalk outline would have gone a long way to assisting the jury in a murder verdict imo. Could have aided in the 'intent' element.

I think I will forever be at a loss as to WHY almost all the evidence was excluded, other than a 6min portion of the 199min recording and the witness testimony!!

I wonder if this person will face any consequences. Probably not though, as the judge just said the behaviour was 'disappointing' and it did not cause a mistrial.

If found guilty a juror can face two years in jail.
(From your link)

I think she should be charged with contempt of court at the very least and should have to pay a hefty fine. It might discourage others from doing it in the future.

When my son was in Year 11 he said something briefly about going to the Gold Coast for schoolies. Knowing the kinds of things that happened (and knowing that all my son wanted to do was have a few drinks with friends - and he would have been 18.5yrs by the time he went, so totally legal) I told him that if I got a whiff of any plans to go to the GC I would deliberately sabotage any plans. I then told him that if he wanted to have fun with his mates I would help him financially if they chose a quieter place and went camping/fishing etc. He was happy with that. I was thrilled - I couldn't bear the thought of him being at Surfers for schoolies.

In the end he and his friends decided to go to Vanuatu for their schoolies - to help rebuild after the cyclone. So proud of him.

What a fabulous thing for them to do for schoolies! Well done them.

Just a caring suggestion for everyone who has seen injustice done for beautiful Rrie and her loved ones during the past two years.

I move that we honour beautiful Rrie by setting ourselves some boundaries and confining our discussions to events before and after the fact; if only for the weekend.

Her poor mother was devasted when the recording was played in open court. By now, we've all heard either the partial or the entire(?) recording seized and I'm sure we all agree that the minutiae of beautiful Warriena's last minutes on earth are traumatising for any right-minded person.

We've also read firsthand how a psychopath tries to worm their way into our minds and vicariously relive their crime.

Take this post as you will. It is made with good intention and much love for fellow WSers.

Namaste.

Speaking of psychopaths ..... I read an interesting line in a book last night.

"Psychopaths try to kill you from the inside out"

Apt title SA. As we've witnessed they can not only figuratively but literally push someone to their death.

I've got to love you and leave you. Pilates and more meditation calls. :loveyou:
