Just as info for astorytold, and a reminder for any other interested people, here is the murder case that is apparently being looked at as a precedent for Tostee's murder charge.

Police evidently have proof that Warriena was in great, substantiated fear of Tostee.

Kelly Healey was in the shower when her boyfriend broke down the bathroom door, grabbed her throat and punched her in the face.

Terrified and in fear of her life, Ms Healey is thought to have climbed out the window and fallen 21m to her death.

Her boyfriend, 33-year-old tattooist Kim William Royall, was found guilty of her murder – not because he necessarily threw her, but because she fell trying to escape him.

A MOTHER was killed while her children slept inside her inner Brisbane home in Norman Park this morning.
One of the flat mates found the woman.

“They spoke to this person, they saw this person leave and then one of the person’s has then checked on the deceased,” he said.
“I don’t know if there was a relationship as such, we believe they were just friends.

Just catching up on websleuths. I pass this building most days and it haunts me every time. Locals say that Warriena was only in the apartment for a few minutes before there was an argument. He really has caused his own demise with his obsession of recording everything.

Sadly Surfers Paradise night club scene is renown for being sleazy however that has changed quite a lot with the new 'bikie' laws. Closed down some venues and cleaned up a lot of the drug trade. Guess it is just a matter of time until it's all back.

A bit off topic, but there are far too many deaths by people either being pushed, accidental falls or suicides from apartment balconies. I can think of 6 recent events within a 500 metre radius at Surfers.

BTW, can't wait for Queensland to televise court procedures. Will save me from watching Judge Judy!

HE was absent from Southport Magistrates Court on Saturday morning, a day after being charged with the murder of Warriena Tagpuno Wright during the early hours of August 8.

Tostee, 28, was unable to apply for bail and remained in the Southport watch house during the brief court hearing.

On September 8, Tostee and solicitor Michael Purcell from Potts Lawyers will make their case for bail in Brisbane.

Today Mr Purcell appeared on Tostee’s behalf in the Southport Magistrates Court on unrelated, earlier charges.

“My client is already in custody on another significant charge,” he told the court.

“My client has given me certain instructions but that may change with this new matter.”

Mr Tostee has lodged an application for bail with the Supreme Court - the next listing will be 8th September

With many charges pending against him, I doubt he'll get bail.

I don't think he's really a flight risk since he seems financially dependent on mummy and daddy (but I still suspect he's a drug dealer)...
I just can't imagine him escaping to Majorca and spending the next 40 years living off mummy and daddy's retirement fund.

Hello everyone. Can someone please explain to me why GT has been charged with murder and not involuntary manslaughter? If Warriena climbed over the railing herself how can that constitute intent to kill?
I am new to WS (and not knowledgeable with criminal law) but interested in this case being a GC local.

If he has in fact been charged with murder as opposed to manslaughter, the police must believe they can prove ‘intent’, because that is the crucial difference between manslaughter and murder under the code. BUT there is more than one way you can ‘commit murder’ and you do not necessarily have to intend to kill someone there are several says you can meet the elements. As an example you may be guilty of murder if although you didn’t intend to kill, you recognised the probability or likelihood of death etc, having recognised this (but still not intending to kill) you still go ahead with your actions. Under section 4 of s302 (Murder) it states it is immaterial that the offender did not intend to cause death or did not know that death was likely to result


**I am not familiar with the Queensland Criminal Code so if anyone knows any more/different then please feel free to correct me.


s302(1): circumstances where an unlawful killing amounts to murder.
(a) Intends to cause either death or GBH of deceased or other
(b) Act done in the prosecution of an unlawful purpose, which act is of such a nature as to endanger human life
(c) Intends to do Grievous Bodily Harm for the purpose of facilitating a crime or facilitating the flight of an offender
(d) Death is caused by administering any stupefying/overpowering force for either of the two purposes above...
(e) Wilfully stopping breathing for either of the two above purposes

Elements:
1. Unlawfully (i.e. not excused)
2. Actus reus – causing the death of a person
3. Mental element – to be found in the language of the Code provision
a. s302(1)(a) “intentionally”
b. s302(1)(b) no specified element
c. s302(1)(c) “intends...for a purpose”
d. s302(1)(d) “administering for a purpose”
e. s302(1)(3) “wilfully” stopping breath “for a purpose”
if no mental element under s302 can be proved = manslaughter

(2) Under subsection (1)(a) it is immaterial that the offender did not intend to hurt the particular person who is killed.
(3) Under subsection (1)(b) it is immaterial that the offender did not intend to hurt any person.

Merzabeth Tomarong Tagpuno left inconsolable after balcony plunge death of daughter Warriena Tagpuno Wright

THE mother of a New Zealand woman who died after falling from a Gold Coast balcony says she hasn’t stopped crying since her daughter’s shocking death.

Warriena Tagpuno Wright, 26, was allegedly assaulted by Gold Coast playboy Gable Tostee and trying to escape when she fell from his 14th floor Surfers Paradise apartment this month.

Wright’s devout Seventh Day Adventist family have remained largely silent since the tragedy but her mother, Merzabeth Tomarong Tagpuno, took to Facebook yesterday to express her grief.

“I can’t stop crying,” Mrs Tagpuno said.

Responding to a friend’s condolences, she said: “Help me, I don’t know what to do??? I missed her so much (sic).”

Oh my god - that is just SO sad to read. Her poor, poor mother.

This whole thing is simply heartbreaking.
