Trial Day 3 -- Daily Mail

Lots of pictures, of course. That's pretty much the only thing I trust in the Daily Mail.

Nothing about the actual proceedings which have now transpired, just photos and a small discussion of the two of them going into court. But one interesting claim:

Miss Mack is expecting to remain behind bars for at least two years while her case drags on through the Indonesian legal system - assuming she is not freed before then.

True???

Trial Day 3 -- Associated Press

Answering the claims made by the defense last week that the case should be thrown out, the Associated press summarizes the prosecution’s response: the case “should proceed despite defense arguments that the indictments are inaccurate and should be annulled.”

Also in the article:

State prosecutor Eddy Arta Wijaya argued Wednesday that the indictment and the charges are very clear.

It is a little strange that there is no report that the prosecution corrected the room number discrepancy. This is an early report, so we should watch for this detail in later, more expansive, articles.

Mark your calendar: Judges will decide next Monday if the trial should continue.

Firdia Lisnawati’s AP story has been updated and posted on NBC Chicago.

Excerpts:

… state prosecutors told the court that their indictment is fully qualified both formally and materially according to the law.

"Our indictment as well as charges are very clear," said chief prosecutor Eddy Arta Wijaya. "Let's prove it through witnesses' testimonies and evidences in the next hearings."

Presiding Judge Made Suweda postponed the trial until Monday where the judge panel would decide whether or not to proceed.

Interesting - I know that in very early reports it was mentioned that HM & TS had said that other people murdered Sheila :furious:
I really didnt think that HM & TS's legal team would seriously be using it as one of the defensive tactics to get the trial thrown out of Court.
Im not sure of the accuracy of the MSM report. I cant imagine HM & TS's legal teams trying to rehash that excuse in a Court of Law - especially since (IIR) they changed their mind on using that excuse.

My Bold...
The couple's lawyers have said mistakes in the prosecutors' indictment raised questions of whether other people entered the victim's room and killed her.
Judges will decide if the trial should move forward next Monday.

Is this the Australian "friend" who has been taking care of them? It's apparent that Favia and Elkin managed to find an Australian living in Bali to take care of them. Makes sense considering what would otherwise have been a language and cultural barrier. I guess they trusted an English speaking Australian expat over a local.

This appears to be the other "friend" who is helping them. Definitely a couple of Australian women it appears. I'm sure they are in the courtroom during the trial as well. I saw a pic with what looks like a side view of the blond one. What I want to know is how these people can just walk up to holding cells in a court of law and hand them money and take their lunch and dinner orders?

I think you are onto something there, Kamille. It wouldn't surprise me at all if a couple of expat Aussies were plying a trade of delivering meals, books, toiletries and other western items to Aussie prisoners in Kerobokan .. and that HM & TS may be now using their service too. There are not always family members in Bali to do this for the prisoners, although Aussie family members fly over and visit when they can.

Looks like it could be a sort of prisoner support service - which could also be why one of them was accompanying Tommy's mother to court. To help bridge the language barrier, and help follow customary ways.

They could even be part of the organisation that put that website/webpage up stating that conditions in Kerobokan were not that bad, what to expect, etc.

Thanks for looking that up SouthAussie. This is another reason why I don't believe SC was having all that "mental difficulty" in prison. It really is easier for prisoners at Kerobokan than in the general population of most U.S. or "western" prisons IMO. It is also a step up from most people's living conditions in third world countries if you've got some money. Heck even if you don't. At least they're being housed and fed.

I wonder what happened to HM's glasses?

Charges have been upgraded from felony theft and misdemeanor damage to property to felony theft and felony burglary for Heather and Tommy's "squad" member VonMar for trashing a Gold Coast 7-Eleven.

Now he wants fans to visit him in jail. Ummm... Don't think so.

I guess he's given over his social media to others to post for him. I thought he was out on bail. Didn't realize it was other people posting for him. Good idea to post your jail address and ask people to visit and send you stuff. What's this world coming to? Social media accounts for anyone jailed or incarcerated should be shut down immediately. And every time someone starts up one of those crowd sourcing fundraisers for any reason having to do with an incarcerated person, they should be fined themselves. Enough is enough.

The arrogance of this guy just floors me. It mirrors HM's. Even jail has not tempered it as he...like Heather... feels now entitled to donations, jail visits, public sympathy and attention. SMH.
