Shannon Martin ‏@ShannonMartinTV 2m2 minutes ago Toronto, Ontario
Sachak changing topics again. Now talking about the work Smich did at one of Millard's residences. #Bosma #HamOnt

I think I see where this is going. Dell devised the safe plan and it was MS who deviated from DM's safe plan and screwed it all up.

All MOO.

"The reason to scope is to make sure this is an area you can effectively steal a truck from," Sachak says. Smich agrees, to see if it's possible to do.

May 17 2016 2:24 PM Adam Carter
Sachak says they considered numerous factors: if the truck was in a busy area, the movement of the truck, etc. Smich agrees.

May 17 2016 2:26 PM Adam Carter
"Lets be realistic, you're not going to go in front of a camera and dance and play a ghetto blaster if you're trying to steal a truck," Sachak says.

May 17 2016 2:26 PM Adam Carter
Smich agrees, says that wouldn't be part of a plan.

May 17 2016 2:27 PM Adam Carter
Smich agrees the plan was supposed to be they'd scope out a truck, then come back later at night to steal it if it worked.

molly hayesVerified account ‏@mollyhayes 2m2 minutes ago
Sachak asks when in relation to May 6, 2013 he was painting the house. Smich says he's not sure, doesn't want to guess on a date. #Bosma

molly hayesVerified account ‏@mollyhayes 2m2 minutes ago
Smich says if he could see the texts he could refresh his memory. Sachak says he's not showing him texts. #Bosma

Sachak now asking about Smich painting Millard's driveway black, and digging a ditch at Maplegate. #TimBosma #Bosma

molly hayesVerified account ‏@mollyhayes 1m1 minute ago
Smich also painted the driveway black. Did some landscaping to divert pooling water. #Bosma

molly hayesVerified account ‏@mollyhayes 1m1 minute ago
Sachak suggests this was some physical labour on his part. Smich says he enjoys painting. #Bosma

Lisa Hepfner ‏@HefCHCHNews 2m2 minutes ago
Smich also painted Millard's driveway. Black. He dug a ditch at Maple Gate. "It would require a spade?" A shovel, Smich says.

Lisa Hepfner ‏@HefCHCHNews 2m2 minutes ago
Smich remembers rain was pooling after Villada (handyman) extended the drive; that's why they needing a drainage ditch.

Lisa Hepfner ‏@HefCHCHNews 1m1 minute ago
Smich says he enjoys painting. It doesn't require strength, Smich says. He didn't even need a ladder at the Maple Gate bungalow.

Adam CarterVerified account ‏@AdamCarterCBC 2m2 minutes ago
Sachak says this required physical strength, and was demanding. Smich says it doesn't require strength to paint. #TimBosma #Bosma

molly hayesVerified account ‏@mollyhayes 1m1 minute ago
At Riverside, Smich did work as well. He used a jackhammer to chip away at the concrete. #Bosma

Sachak now focusing on when Smich used a jackhammer when working on one of Millard's property. #TimBosma #Bosma

molly hayesVerified account ‏@mollyhayes 1m1 minute ago
Sachak asks how heavy the jackhammer was. Smich says pretty heavy. At that point he was ok and it was fun. #Bosma

Peter Akman ‏@PeterAkmanCTV 59s60 seconds ago
Smich used a jack hammer as well. Millard's lawyer showing how Smich had strength in his arms. Smich says "at that time I was ok." #Bosma

molly hayesVerified account ‏@mollyhayes 1m1 minute ago
Smich says this would've been about a year/year and a half before May 2013. #Bosma

Adam CarterVerified account ‏@AdamCarterCBC 1m1 minute ago
"So you had no difficulty using the jackhammer?" Sachak says. "At that point I was okay and in pretty good shape," Smich says. #Bosma

May 17 2016 2:29 PM Adam Carter
"Ultimately, you look at all these variables and say, 'what's the safest way of doing this without being caught,'" Sachak says. "That was supposed to be the plan," Smich says.

"You did all of this work in spite of your shoulder," Sachak says. "I didn't do anything that would affect my shoulder," Smich says. Sachak then says the gun is "lighter than a jackhammer." Smich agrees and says "Dell's gun is not that heavy."

He has been coached extremely well. Mentions DM's involvement at every opportunity.

MOO

"Did you use one finger to paint the walls? One finger to dig the ditch?" Millard's lawyer. Smich answering straight. #Bosma @CTVNews

Adam CarterVerified account ‏@AdamCarterCBC 1m1 minute ago
Smich said at one point he'd use "one finger" to paint using a spray can #TimBosma #Bosma

Lisa Hepfner ‏@HefCHCHNews 1m1 minute ago
When his shoulder wasn't acting up, it was OK, Smich says. People in court are rubbing faces wearily at the repetition of all this.

May 17 2016 2:37 PM Adam Carter
"So you had no difficulty using the jackhammer?" Sachak says. "At that point I was okay and in pretty good shape," Smich says. Sachak asks when that was, Smith says about a year before May 6.

May 17 2016 2:38 PM Adam Carter
Smich says he did other things for MIllard at the airport, using a front end loader and a forklift, putting up walls, etc.

May 17 2016 2:39 PM Adam Carter

Sachak says Smich and Millard went on quite a few test drives. Smich says they've only been on two. #TimBosma #Bosma

molly hayesVerified account ‏@mollyhayes 2m2 minutes ago
Smich says no, just two. #Bosma

molly hayes ‏@mollyhayes 1m1 minute ago
Smich says sometimes they'd go drive out to certain places to scope out trucks. #Bosma

molly hayes ‏@mollyhayes 1m1 minute ago
"There were quite a few. I'm not gonna give an exact number but...in a year or so...close to 10," he says.

Adam CarterVerified account ‏@AdamCarterCBC 2m2 minutes ago
Smich says they "scoped out" quite a few places looking for a Dodge. Over a year they looked at close to ten. #TimBosma #Bosma

Susan ClairmontVerified account ‏@susanclairmont 2m2 minutes ago
Smich says they didn't do that. Says they scoped trucks "for a year or so." About 10 trucks. #Bosma

molly hayesVerified account ‏@mollyhayes 2m2 minutes ago
Again, he agrees with Sachak that this was Dell's plan. #Bosma

Adam CarterVerified account ‏@AdamCarterCBC 2m2 minutes ago
"Dell would tell me that he wanted to steal a truck and he wanted to scope it out," Smich says. #TimBosma #Bosma

Lisa Hepfner ‏@HefCHCHNews 2m2 minutes ago
Dell wants the truck, Dell plans the scoping? Sachak asks. Smich says they scoped about 8 trucks over the year before #TimBosma killed.

molly hayesVerified account ‏@mollyhayes 1m1 minute ago
Sachak suggests that in all those scoping trips, Millard would decide not to take it. Smich agrees--for various reasons, he says. #Bosma

Susan ClairmontVerified account ‏@susanclairmont 51s52 seconds ago
That's 8 trucks scoped on top of Tumanenko truck & #Bosma truck. Sometimes truck moved or "it was just too difficult to get it," says Smich.

Adam CarterVerified account ‏@AdamCarterCBC 1m1 minute ago
Sachak says it would be Millard's decision to call off a theft. Smich says sometimes the vehicle wouldn't be there, etc #TimBosma #Bosma

Adam CarterVerified account ‏@AdamCarterCBC 47s47 seconds ago
Sachak again pointing out "ultimately Dell decides." Smich says it was a "mutual agreement." #TimBosma #Bosma

Peter Akman ‏@PeterAkmanCTV 58s58 seconds ago
Back at it... Millard's lawyer and Smich quibbling over scoping out the truck, who decided what and when about stealing. #Bosma @CTVNews

Smich agrees the only truck Millard had that could tow the large trailer Bosma's truck was found in was his red Dodge.

May 17 2016 2:49 PM Adam Carter
Sachak now talking about again how there would be "many variables" if they were planning to steal a truck.

Ok, Phew..all caught up :)

Can't wait for this filibuster to be over and get to the crown with some relevant questions

molly hayesVerified account ‏@mollyhayes 2m2 minutes ago
Sachak says Millard had talked about using a large trailer to steal a truck. Smich says that was one thing they discussed yes. #Bosma

molly hayes ‏@mollyhayes 43s43 seconds ago
Smich agrees that, to his knowledge, the only vehicle Millard had that could tow that trailer was his red dodge truck. #Bosma

Adam CarterVerified account ‏@AdamCarterCBC 1m1 minute ago
Smich agrees the only truck Millard had that could tow the large trailer Bosma's truck was found in was his red Dodge. #TimBosma #Bosma

molly hayes ‏@mollyhayes 39s39 seconds ago
Smich says there were different variations of the plan. #Bosma

Lisa Hepfner ‏@HefCHCHNews 59s60 seconds ago
"The idea was to use the winch in the truck to drag the truck into the trailer," Sachak says of the theft plan.

Lisa Hepfner ‏@HefCHCHNews 9s10 seconds ago
Once the stolen truck was back at the hangar, mechanic Shane Schlatman could pop the ignition out and allow them to start the stolen truck.

Susan Clairmont ‏@susanclairmont 21s21 seconds ago
Dell would work on getting equipment or getting Shane to. One plan was for Dell to use 5th wheel trailer/winch to get stolen truck inside.

Adam CarterVerified account ‏@AdamCarterCBC 1m1 minute ago
Sachak now talking about again how there would be "many variables" if they were planning to steal a truck. #TimBosma #Bosma

Lisa Hepfner ‏@HefCHCHNews 30s31 seconds ago
Yonge Street, Eaton Centre wouldn't be the best place to steal a truck with a trailer, right? Sachak asks.

Despite the fact that I (mostly) believe MS's version of events (the gun story is exempt, I just don't know about all that), I do think TD is going to advise him to keep his smart-mouth comments out of it. I suspect, if he IS innocent of shooting/planning to shoot TB, this reaction of his is simply a matter of being fed up with being accused of something he didn't do and facing a sentence for something he didn't do. In which case, it's a natural reaction, although not a well-advised one.

moo.

I think defendants under cross exam are limited in the communication they can have with their lawyer until they are finished giving evidence. Not sure what the scope of that is though.

Lisa Hepfner ‏@HefCHCHNews 1m1 minute ago
If it was Yonge St you would have had walkie talkies and people watching, Smich says.

Susan Clairmont ‏@susanclairmont 2m2 minutes ago
Variables with that plan too. Could they get huge trailer in and out of area?

molly hayes ‏@mollyhayes 57s57 seconds ago
Sachak suggests Dell also had other friends he could contact if need be--like Michalski, Hagerman etc. Smich agrees. #Bosma

Susan Clairmont ‏@susanclairmont 1m1 minute ago
Sachak asking about Millard's "walkie talkies." And Millard's friends would use them to be lookouts.

Adam CarterVerified account ‏@AdamCarterCBC 2m2 minutes ago
One of the court clerks now totally has his face in his hands during this cross examination as it goes on.
