One of the court clerks now totally has his face in his hands during this cross examination as it goes on.

May 17 2016 2:55 PM Adam Carter
Smich says it never came up that other friends of Millard's could help them steal a truck. "If it was going to happen, then that conversation would come up," Smich says. "If he decided he was going to steal ... he was confident to call up his friends and help him steal." "Yes, he had lots of people under his thumb he could call up," Smich says.

I think NS is doing a pretty good job of backing MS into a corner to suggest that DM scoped out other trucks with MS previous to TB's and it was all DM's plan and that DM never in the past made a decision that would deviate from the plan if if was too risky and could get them caught. NS is surely trying to set up a scenario to suggest that it was MS who deviated from DM's plan. I wonder if MS is catching on to this strategy?

All MOO.

Sachak says Millard wanted a red 3500. "He says it would be a bonus if it was red," Smich says.

Note to self: if ever in trouble, hire Dungey as lawyer - NOT Sachak.

Lisa Hepfner ‏@HefCHCHNews 1m1 minute ago
Smich agrees Millard was going to switch the stolen truck for his red one. That's why it had to be a Dodge 3500. Main thing was diesel.

Lisa Hepfner ‏@HefCHCHNews 40s41 seconds ago
"As time went on he was getting more anxious to get it," Smich says plans changed over time.

Fixed, added Adam Carter's name so there isn't any confusion later :)

Good lord! Does this cross examination have a point to it?

NS is jumping all over the place. So I'm thinking he must have a point and is trying to back MS into a corner......waiting for that "gotcha" moment.....but MS has been under cross-examination for almost 10 hours......and I don't see the finish line in sight.....MOO

Note to self: if ever in trouble, hire Dungey as lawyer - NOT Sachak.

Dungey definitely gets to the point a lot more quickly......his cross examinations (and even his direct of MS) seemed much more effective and efficient......MOO

WHAT? Why on earth would he do that!?

May 17 2016 3:05 PM Adam Carter
The point that Sachak keeps going over is the plan was to steal a truck, paint it red, and then swap the VIN and the plates for MIllard's red truck.

Smich says he and Dell were talking about it. Shane showed Dell how to do it, but Smich says he was working on another vehicle.

Smich didn't need to know how to do it "Because I would have just kept six."

molly hayesVerified account ‏@mollyhayes 1m1 minute ago
Smich says in case of stealing a newer vehicle it'd be his job to "keep 6." He only knew how to steal older vehicles. #Bosma

May 17 2016 3:08 PM Adam Carter
Smich says Schlatman showed Millard how to hot wire one day at the hangar. He says he doesn't remember on what vehicle.

May 17 2016 3:08 PM Adam Carter
"He went to Shane and asked him and Shane would have shown him," Smich says.

May 17 2016 3:11 PM Adam Carter
