“SACRAMENTO -- Politicians are often criticized for rushing to change laws after high-profile crimes because they can wind up creating bad public policy with messy, unintended consequences.

But national outrage over the light punishment former student-athlete Brock Turner recently received for sexually assaulting an unconscious woman last year outside a Stanford frat party revealed an inconsistency that took California lawmakers by surprise: Sexually assaulting a conscious person is considered a more severe crime in the Golden State than attacking an unconscious person. On Tuesday, the Senate Public Safety Committee unanimously moved to eliminate that seeming absurdity.”

AB 701, authored by Assemblywomen Cristina Garcia, D-Bell Gardens, and Susan Eggman, D-Stockton, which aims to broaden the definition of rape to include forced penetration of any body part with any foreign object.
Both bills will be considered next by the Senate Appropriations Committee. If passed by that panel, the measures would head to the full Senate and Assembly for floor votes.
BBM. Well then, Uncle Louie- you raped me! I wish I'd had the courage to report you, may you rot in H*ll!!:stormingmad::stormingmad::stormingmad::stormingmad::stormingmad:

Stanford trial judge overseeing much harsher sentence for similar assault case

Raul Ramirez to be sentenced to three years in prison for case with similarities to Stanford sexual assault case for which Brock Turner will serve only six months

Ramirez, a 32-year-old immigrant from El Salvador who admitted to sexually assaulting his female roommate in a case that has similarities with the Stanford case, will be sentenced to three years in state prison under a deal overseen by judge Aaron Persky, according to records obtained by the Guardian.

The three-year-prison sentence, part of a plea agreement signed in March, provides a sharp contrast to the outcome for Turner, a white 20-year-old former Stanford swimmer who Persky sentenced to probation and six months in county jail after he was convicted of sexually assaulting an unconscious woman.

Stanford Sex Assault Convict Brock Turner to Get Drug, Alcohol Counseling
By PAUL ELIAS Associated Press
July 13, 2016

SAN FRANCISCO (AP) — The former Stanford University swimmer convicted of sexual assault will be required to attend drug and alcohol counseling in addition to being randomly tested after he was caught lying about his high school habits.
Internal probation department communications obtained Tuesday through a public records request show that Brock Turner, 20, will have the counseling requirements added to his probation before his Sept. 2 release from jail.

I thought about Brock while watching the men's Olympic swimming, especially Michael Phelps events and was so happy that Brock Turner didn't make it to the Olympics!! He screwed his swimming career forever the minute he decided to sexually assault this woman.

Another Persky case where the sentence was ridiculous

After her speech ended, Persky finalized the sentencing: Chiang, who had pleaded no contest to a domestic violence felony of battery causing “serious bodily injury”, would face so-called “weekend” jail. That meant he would spend roughly 12 weekends in county jail, and that while serving his sentence, he could continue his job as an engineer in Silicon Valley.

Aaron Persky, Brock Turner judge in Stanford assault case, set to make new ruling

“PALO ALTO, Calif. - A California judge is set to make his first key decision in a sex crime case since receiving harsh criticism for the light sentence given to a Stanford University swimmer for sexually assaulting a woman who was passed out.

Santa Clara County Judge Aaron Persky said last year he would be "receptive" to Robert Chain's request to reduce his conviction for possessing child *advertiser censored* from a felony to a misdemeanor, if the San Jose plumber stayed sober and out of trouble.”

Persky previously sentenced Chain to four days in jail and ordered him to register as a sex offender.

Assistant District Attorney Terry Harman said the sentence was unusual because similar defendants convicted of child *advertiser censored* possession are usually sentenced to six months in jail.

Harman said prosecutors didn't object to Chain's short jail sentence because "we were satisfied with the felony plea and sex registration in light of the defendant's remorse and admission of guilt."

Harman said prosecutors will urge Persky to keep the felony conviction when it's considered at a hearing on Aug. 25. Either way, Chain will remain a registered sex offender.”

Many eyes and spears will be pointed at Persky on Thursday. I am glad I am not him.

Stanford sex assault case bows out from upcoming sex case

A California judge under fire for a light sentence given to a Stanford University swimmer has recused himself from making his first key decision in another sex crimes case.

"While on vacation earlier this month, my family and I were exposed to publicity surrounding this case," the judge wrote in his brief ruling. "This publicity has resulted in a personal family situation such that 'a person aware of the facts might reasonably entertain a doubt that the judge would be able to be impartial.' "

Brock Turner: Judge kicks himself off first sex-crime ruling since Stanford assault case

The Santa Clara County judge facing a recall threat for giving a relatively light sentence to former Stanford student Brock Turner has disqualified himself from making his first key decision in another sex case.

The issue is now set to be decided by Judge Kenneth P. Barnum in Palo Alto on Oct. 6.

Brock Turner will be released from jail one week from tomorrow. Friday September 2, 2016.

Ashleigh Banfield will be discussing the case further during her CNN show next week.

And widely reported earlier this week was that Stanford announced a ban on some alcohol.

Here is just one article:

http://www.upi.com/Top_News/US/2016...hol-from-undergraduate-parties/4481471999245/

“PALO ALTO, Calif., Aug. 23 (UPI) -- Stanford University has banned hard alcohol from on-campus undergraduate parties and straight shots from graduate-student parties.”

Obviously there is more to it than that but the topic should probably be on a thread of its own and its not something that compels me to follow up with that.

Judge in Stanford rape case asks for move to civil cases

A California court said Thursday that a judge who was criticized for ordering a lenient six-month jail sentence in a rape case against a former Stanford University swimmer will no longer hear criminal matters by his own request.

Santa Clara County Presiding Judge Rise Pichon said she has granted the request of Judge Aaron Persky.

"While I firmly believe in Judge Persky's ability to serve in his current assignment, he has requested to be assigned to the civil division, in which he previously served," Pichon said in a statement. "Judge Persky believes the change will aid the public and the court by reducing the distractions that threaten to interfere with his ability to effectively discharge the duties of his current criminal assignment."

The move is not necessarily permanent. The assignment is subject to an annual review and takes effect Sept. 6.
