I don't see how people "forget" that they got a traffic ticket, though. Why would he need a letter about his ticket when LE always gives you paperwork when they cite you?

I guess this happens a lot. Heck, 2 out of the 4 drivers in this wreck did not have valid DLs.

This happened to us, my DH got a ticket when we were traveling thru MO. We got home mailed the ticket back, we live in a different state, 2 years later, we were driving, ironically to renew my DL, when he got pulled over. Having no clue that MO never received the payment and had our state suspend his DL, my DH showed his DL and valid insurance and within 10 mins he was arrested on the spot because it's illegal to show LE a suspended DL. We had no clue that MO never received the payment and at no time did we receive a letter from MO or our home state. So it does happen.

isn't this the prius upper right? if so, it's not that far away:

I notice from the above picture that there is a center turning lane. It has been alleged that the Prius driver may have been stopped in order to make a u-turn. The existence of the center turning lane blows that theory out the window since if she really wanted to make a U-Turn she would have been in the center turning lane.

Oh I think its criminal too but not quite the same thing.

No, it's not the same thing, it's even worse.

One moment of inattentiveness is one thing.
This is a one time mistake and that most people make at some point.
Even I have been distracted while driving at some point, I have children.

Knowingly not restraining your child when you know they can die?
That is neglect on a daily basis every time you drive them in the car.
That is something I can say I have never done.
I have never knowingly, intentionally endangered my children.

There is intention to neglect kids who are not restrained.
Bruce made a mistake, which is different. :twocents:

People stop in front of me to turn in the traffic lane at least once a week.
Just because the center lane is there doesn't mean people always use it. :twocents:

Not necessarily. That center turning lane has cars coming from the opposite way as well. So you cannot just jump quickly into that lane. You need to slow down a bit before you move into it. I wondered if she was maybe getting ready to pop into that lane when she was hit.

Not really. It shows where she should have been to make a U-turn, doesn't mean she used the lane...

IMO, as long as she didn't have a license suspended due to something related to bad driving, or a medical condition such as a seizure disorder, I don't feel like her license status has anything to do with this accident. It certainly doesn't release BJ from his obligation to maintain a safe distance, safe speed, and attention to the road.

I don't think even that matters as long as it is proven she did nothing wrong. BJ would have killed the person in the car license or not. He's lucky there weren't more and younger people involved.

TMZ has a sweet story up about Kim:

This is not about kids in a car. This is about someone who was operating a car and bashed into someone else and caused their death. There were no kids in the car.

there are many reasons kids may not be restrained properly but it is not all neglect. Many many people think they are doing the right thing and find out later they werent. But that is a whole other thread.

Not trying to be argumentative, just this is something that has always scared me a bit. I haven't had a ticket in 25 years, but my D recently got one, and I worry about this exact scenario.

Wouldn't it have been obvious when you reconciled your check book each month that the check you wrote had not been cashed?

In my state (SC) you can't pay with a check. They only accept Postal Money orders by mail, or cash or m.o. in person.

I would suggest you certified mail, then you would have a record of mailing and receipt that they received it. But you would still have to maintain that for who knows how long.

So I guess the solution is to send it via some fashion where someone must sign for the mail and you can check on the status of the case? Do certified checks come with any kind of option to show that they have been cashed? Could you simply call the court in the jurisdiction where the ticket was given to ascertain whether or not the file is closed satisfactorily?

I don't want D pulled over and arrested.

"If he's going at a really excessive speed, if he's under the influence of alcohol or a drug, if he's texting, these would certainly be things that a prosecutor would want to explore, but most drivers that are involved in fatality crashes – even when it's their fault – are not charged with vehicular manslaughter," says Fox. "It's very unlikely he would be charged with a criminal [offense], and if he was charged, it would only be because he's Bruce Jenner."

http://www.people.com/article/bruce-jenner-crash-jail-time-unlikely

“The bottom line is that charges most likely will not be filed, if they are filed, Jenner will avoid prison and most likely be granted probation with no jail time,” California-based criminal defense attorney R.J Manuelian told FOX411. “However, Jenner's biggest worry should be the wrongful death lawsuit, which will be filed soon enough, and will reach deep into his pockets if his insurance doesn't cover his tab.”

“If there is such evidence that he was driving with ‘gross negligence’ or ‘ordinary negligence’ he can be charged with either a misdemeanor -- punishable up to 1 year in jail -- or a felony under Penal Code Section 190(c)(1) and can be sentenced to a maximum of six years,” Manuelian said. “But this is not likely at all given it is Jenner's first brush with the law."

I am not going to listen to the commentators on if Jenner will be charged or not. I will wait and see. I have a feeling that the since there is a death and he was the one who hit both cars it means he was traveling too fast for his cargo and conditions.

We will see.

Bruce Jenner: Why He’s Decided To Speed Up Gender Transition After Car Crash

http://hollywoodlife.com/2015/02/19/bruce-jenner-sex-change-car-crash-gender-transition/

Bruce was so shaken by his traumatic Feb. 7 car crash he decided to take a brief break in his gender transition process. Now, after some serious soul-searching, the 65-year-old reality star has sped up the process after realizing he’s lucky to be alive.

Bruce Jenner feels as though his life was “spared” after walking away from a car crash that left one dead on Feb. 7 in Malibu, Calif. Now after having the scare of his life, a source tells HollywoodLife.com EXCLUSIVELY that the former Olympian has decided to move forward with his gender transition, so he can start his new life as a woman as soon as possible.

Snipped by me.

BJ choosing to change his identity to a woman is his choice and didn't give me much thought. However, reading the above article, I have highlighted a few purported thoughts/statements Bruce made that are beyond troubling for me!

How at such a time of crises for these three other families can BJ just turn his nose up at them by making such remarks? He is the reason for the problems these other families are suffering. To me, it shows him to be selfish, self-centered, spoiled, a snob, and having that elitist attitude "look at me"!

Personally, I don't think he will serve one day behind bars as is customary for Hollywood stars. What I think will get him is the monetary suits that are just waiting to be filed. Having been an Olympian star first, he probably has always been heavily insured. However, causing a death will have a great impact on what her estate will seek.

Now for a lighter note - will he appear as the new she as this case goes along? Now that picture has me belly laughing! My puppy is looking at me to see what's wrong.

[SUB]My opinions only![/SUB]

Rear end collisions are the most common of all automobile collisions. It happens A LOT.
How many people are charged with felonies? Even when a death occurs?

Misdemeanor? Possibly. That's 1 year sentence and he would be out in about six months. So I agree with the "commentators" 100%.

IMO if BJ in convicted, if he serves any time at all, it will be minimal.

This is a pretty good case to compare.
California. Rear end collision. 2 deaths. Multiple serious injuries. Driver admitted to looking down at his cell phone and was distracted.
