Court is back in session for the #PinyonPines triple murder trial. Robert Pape's defense attorney, Jeff Moore, continues cross-examination. @KESQ @LocalTwo

Greg Guillette, a senior analyst with Gladiator Forensics, is still on the stand. Both the defense and prosecution are taking turns asking him questions. He's the only witness so far today.

Expert witness Greg Guillette has been excused from the stand. It is possible he will be recalled for further questioning at a later date. #PinyonPines

Police Officer James Dickey, with @RSO has been sworn in. He is assigned to the central homicide unit and became involved in #PinyonPines investigation in 2015. (Disclaimer: In the Coachella Valley there are several police departments that contract with the Sheriff's Dept.)

Officer Dickey: First made contact with informant Jeremy Witt on May 18, 2016. #PinyonPines triple murder

Officer Dickey: Went to Witt's home where Witt answered the door with a beer in his hand. He knew immediately Witt was under the influence of alcohol. @KESQ @LocalTwo

Officer Dickey's testimony was at lightning speed compared to first witness called. He has been excused from the stand.

#PinyonPines triple murder trial: Jury has been excused for the day. Requested to return tomorrow at 9:30 a.m. Prosecution and defense teams are discussing "business" with judge. @KESQ @LocalTwo

#PinyonPines triple murder trial: We are still inside the courtroom for discussions between presiding judge and defense/prosecution. Defense would like to get former confidential informant, Jeremy Witt, impeached. He was supposed to take the stand tomorrow morning.

Defense says Witt has at least two restraining orders against him. They have been entered as evidence. Depending on the nature of the situation that led to them, the defense says the behavior may be misconduct that goes to credibility.

There are several issues that will need to be litigated in the morning, before Witt can testify before the jury. May be a hold up in proceedings tomorrow morning. Judge and representation will commence at 9:30 a.m. Jury to be called in later. @KESQ @LocalTwo

*Trial continues (Day 12) (@ 9:30am) - CA - Rebecca 'Becky' Annaleigh Friedli (18), Vicki Friedli (53) & Jon Hayward (55) (Mom's BF) (Sept. 17, 2006) - *Cristin Conrad Smith (29/17 @ time of crime) faces LWOP (juvenile @ time of crime) accused & charged with 3 counts of murder w/special circumstances allegedly of committing multiple murders. Plead not guilty.
*Robert Lars Pape (29/18 @ time of crime) (ex-BF) charged with 3 counts of murder with special circumstances allegedly of committing multiple murders & faces LWOP. Plead not guilty.
**Both arrested in March, 2014, but case was dismissed in October, 2014
5/3/18: Judge Schwartz lets jury know that the prosecution could rest their case on Wednesday (5/9) or Thursday (5/10). A little ahead of schedule.
No court on Fridays.

Court is back in session for #PinyonPines triple murder trial. Jury is not present as judge discusses issue surrounding next witness and former confidential informant, Jeremy Witt. @KESQ @LocalTwo

Judge Schwartz says that having a restraining order filed against you is not moral turpitude, but the underlying behavior may be if it includes criminal threats.

An attorney representing Jeremy Witt in a different case is speaking with Judge. Says Witt may plan to plead the fifth if he takes the stand. Witt is accused in alleged road rage incident where he may have brandished a gun and identified himself as a police officer. @KESQ

Judge: Witt may have been in possession of high capacity magazine. Also, Witt is accused of DUI and is alleged to have interceded with court witness in different case.

After being briefed, the attorney for Witt says she would advise him to take the fifth, to not incriminate himself in other cases while on the stand as key witness in #PinyonPines trial. @KESQ @LocalTwo

Judge Schwartz: It is not 100% that Witt would take his attorney's advice and plead the fifth. He may chose not to listen. Court would have to see what happens if he were to take the witness stand to testify in #PinyonPines trial. Judge still needs to determine if.... 1/2

Con't.: Witt should be impeached as a witness. Court is looking further into allegations made against Witt to see if his behavior during instances constitutes misconduct that goes against his credibility.

#Recap: Jeremy Witt is a key witness for the prosecution. He says defendant Cristin Smith made incriminating statements to him about the triple murder when they worked together at Knott's Soak City in Palm Springs. Yesterday, the defense counsel moved to have Witt impeached.

Prosecution says this is a waste of the court's time. Judge says there needs to be testimony form Witt on at least two of the un-related instances he has been involved with. If he pleads the fifth, he will not be able to testify in #PinyonPines murder trial. @KESQ @LocalTwo

#PinyonPines triple murder trial: Judge says imitating a police officer is a good example of moral turpitude. His public defender is back after conferring with Witt and says he will plead the fifth on the stand if asked about pending, unrelated case against him.

Judge Schwartz: "We need Mr. Witt to personally come over and to invoke." A witness named in one of Witt's restraining orders may also testify before counsel this morning. Judge says we will not spend weeks on this impeachment, but may allow some time for the process.

#PinyonPines triple murder trial: Essentially, there is now a trial within a trial in this case. Key witness Jeremy Witt's credibility will be examined in court. Depending on which way it goes, he could be impeached as a witness.

Things have become very convoluted over Witt situation. At different times this morning the judge, prosecution and defense have all shown confusion over what they're discussing.

Jeremy Witt is being brought in to answer questions about aforementioned issues. Jury is still not present. Defense wants him sworn in, but he is not seated at witness stand. Judge will ask questions.

Jeremy Witt has been sworn in and is standing in the middle of gallery aisle while speaking with judge. Witt confirms he will in fact evoke his right to remain quiet about open cases agianst him.

Jeremy Witt will not be able to testify about his open cases and has been dismissed. (It is undetermined on how this will affect his testimony in #PinyonPines trial). Witnesses are being called to testify about him after short break.

We are back on the record. A man named Gregory Ellis has been brought in to courtroom. He is named in restraining order against Witt.

Ellis has 28 outstanding cases against him. Judge says some of the allegations are serious. Ellis says he is president of a Home Owners' Association and that is where many of the issues stem from. Ellis tells judge he will testify about issue with Witt.

Ellis has been ordered back next Tuesday for his testimony. All other witnesses for the impeachment exploration will try to be scheduled for Monday.

Court is going into recess until 1:30.

#PinyonPines triple murder trial: Court is back in order. Jury is not present and has been sent home for the day. @KESQ @LocalTwo

Robert Pape's defense attorney Jeff Moore : "I feel like we have put the buggy in front of the horse and we're so far off, I can't even see the horse."

Witt will not testify in person, but a previous statement he made under oath will be read aloud in court, possibly tomorrow.

A former neighbor of Jeremy Witt, James Carter, has been sworn in. Says he lived next to Witt for a little over a year and used to have beers with him every once in a while.

Carter says he spoke to Witt about his involvement in the #PinyonPines triple murder case. Carter says Witt told him he was a witness and that his testimony would have a big impact on the case.

Carter says Witt was worried that there was some type of award out and that somebody was trying to come after him. Carter testifies that the award was either $50,000 or $100,000.

Carter is testifying that he avoided the defense investigator when the investigator arrived at his house. Says there were people looking for him and he didn't know who the investigator was. Ultimately, the investigator served him with a subpoena.

Carter says about two years ago, Jeremy Witt asked him to come over. They started discussing that Witt was a witness in the #PinyonPines case. Witt mentioned a reward.

Carter says he gave Jeremy Witt defense investigators phone number. Witt then allegedly contacted investigator, pretending to be Carter.

Carter says he was told by an acquaintance that Witt was a bit "loony" and had gone into the work place "waving a gun around."

Carter says Witt was afraid after some guys pulled up to him on the street, said they knew who he was and that he better watch out.

Carter says he did not give Witt permission to impersonate him when he contacted the defense investigator.

No further questions for Carter, he has been dismissed. New witness is taking the stand.

Sam Gayer has been sworn in. He is the acquaintance of previous witness, James Carter. They worked together for an air conditioning company.

Gayer was in court during the preliminary hearing and heard Witt testify. He was also in contact with Robert Pape during that time.

Gayer testifies he is best friends with Robert Pape and Cristin Smith. He met Carter through work. Carter lived next door to Witt. Witt was key witness for prosecution. Witt claims Smith made remarks to him about the crime when they worked together and at a party.

Gayer is off the stand. Investigator Marek Kasprzyk, who was hired by the defense, has taken the stand.

Investigator Kasprzyk: Says he was in contact with Carter. Then received a text from another number identifying himself as Carter, saying the previous number was out of commission.

Investigator Kasprzyk: The person never admitted they were NOT Carter. He says the conversation seemed odd. Essentially, it was an interview via text. He says he thought it was odd and did a reverse look up on the number, which came back to Witt.

Investigator Kasprzyk: Now reading some of his text conversations straight form his phone aloud for courtroom.

Investigator Kasprzyk: Says he went to Carter's house to serve Carter papers when Jeremy Witt, who was Carter's neighbor, came walking up with his German shepherd and a beer. Says Witt was agitated he was there. Witt told him Carter did not have any information for him.

Investigator Kasprzyk has been dismissed. Discussion has turned to what grounds of impeachment there are against Jeremy Witt.

Took a short recess. There is more back and fourth between prosecution and defense. Prosecution says tomorrow they planned to have FBI agent set to testify about shoe impressions and will discuss information from search warrants on Pape's bank accounts.

Opening remarks this morning begin with Robert Pape's defense attorney, Jeff Moore, bringing up the issue of Jeremy Witt testifying. Judge Schwartz makes point of saying the issue of impeaching Witt was brought up by the defense, "now we have gone down this road." #PinyonPines

While IF Witt will be impeached remains to be seen, it was established yesterday that he would not take the stand. However, a previous statement he made under oath during a pre-trial hearing will be read allowed to jury.

Con't.: This does not sit well with defense counsel, who now say they will lose out on the ability to to cross-examine Witt and are concerned that the jury will not be able to watch Witt's demeanor on the stand.

Cristin Smith's defense attorney, John Patrick Dolan, requests the transcripts from Witt's previous testimony not be allowed.

Jeff Moore has suggested they allow Witt to testify in-person on the stand and that counsel refrain from asking questions regarding the situations which Witt invoked his fifth amendment right on yesterday.

Judge Schwartz denies both defense requests. Jeremy Witt will not take the stand and his previous under oath testimony will be read aloud. #PinyonPines @KESQ @LocalTwo

This murder trial is progressing again. First time since Monday mid-afternoon, when it was delayed due to witness impeachment hearing proceedings. New #PinyonPines expert witness is on the stand. Jury is entering the courtroom.

Judge Schwartz apologizes to jury for delays. Says the trial is still on schedule. No court tomorrow or Friday. Prosecution expects to rest its case on Monday.

Man on the stand is investigator Michael Gavin. He is actually NOT a witness, but is here to read the role of a witness in the upcoming transcript that's about to be read aloud.

Jeremy Witt's previous under oath statement, taken during the preliminary hearing, is going to be read aloud in a role-playing style. Prosecution will read their parts, defense will read theirs and Gavin will play role of Jeremy Todd Witt. @KESQ @LocalTwo

Jeremy Witt former testimony via transcript reading: Confirmed he was an employee of Knott’s Soak City in 2007 as a lifeguard and then security supervisor. Confirms he met Cristin Smith, who was also employed there as lifeguard. Confirms he interacted @ work & socially with Smith

Jeremy Witt's former testimony via transcript reading: Smith was supposed to be watching the water in role as a lifeguard. Smith was staring in south-easterly direction toward the mountains “in a daze.” Says Smith was “out of body, wasn’t there. Wasn’t paying attention.”
