"On Tuesday, a judge set a Dec. 14 date for a competency trial for Carlo Mercado, 30. The bench trial comes after evaluators from Patton State Hospital – a psychiatric facility in Southern California where Mercado had been receiving treatment – found him competent to stand trial."

"Mercado’s attorney said the defense is still waiting to receive evaluation documents from Mercado’s doctors. All medical and mental health records for Mercado will be given to a judge prior to the start of the competency trial."
 
There's a video at the bottom of the page where they discuss whether the Death Penalty should be sought when juries tend to need a motive. There's still no known motive as to why he killed three people.

In that video they show his cell phone calendar notations. One of the last entries I could see was for Jan. 22, 2014 noting some girl's birthday. It's weird really when you think of all the loose ends he was still dealing with from the murders. He sure seemed to have a firm grasp on life until he got caught, and then went comatose.

I'm not sure in this particular case about going for the DP without a known motive. What do you think?

Thanks for posting all the links Curious! I was watching him on TV and he does have that same blank stare and seems to have gained a little weight. In the report I watched they said the judge wanted him to be housed in the PSU ward awaiting the hearing December 14, 2015. Note: he still shows as being in the general public as of this morning.

As for the DP without a motive...I don't see how that can happen. I'm not even sure why they are discussing it at this point when we are unsure there will even be a trial? MOO
 
He just doesn't seem to be actually present in his own body. I expected him to look more alert. Is he doing a good job of faking it?

I said comatose, but that is the wrong term. He seems to exhibit some type of catatonic stupor. I guess he could be on some powerful medications.

SDHELPS, I also have doubts this is ready for trial. Without knowing his motive for committing these murders, it seems it will support a mental illness defense. Like - there was no reason - he was just mentally ill. A DP trial then would be a waste.

I continue to follow along hoping maybe something interesting will come out to reveal a motive. Why, why, why?
 
Today was day one of the Competency Trial...finally! I saw on local CBS8 http://www.cbs8.com/category/154671/local-news a Dr. @ Central jail PSU ward testified that Carlo seems to be aware of what is happening and following all direction of deputies and doctors (paraphrasing). The trial will continue tomorrow. As soon as the video becomes available on msm I will post.

Praying that his can move forward and the family can find justice as we come upon the two year anniversary of this horrific crime.

I hope many people come back to witness the trial. I was so sad two weeks ago when another trial nobody followed when the trial happened I didn't know about it at all until the verdict was over and nobody was here with the family and friends.

So, it's still not decided whether he's ready for trial?
He's not a computer, but I hope they can do a "restore" on him. I think part of his mental state boils down to wanting to stall going to trial...as long as he can convince all the doctors he's just too out of it. I don't know, but I'm not willing to just forget about the horrible crimes he committed.

I want to see Justice for the families and loved ones of Ilona, Gianni, and Salvatore.

I agree that he's stalling. He was cognizant enough to put the deed on his calendar. That's not mentally ill, imo, it's literally premeditation. :-|

Agree with all that it's a stall tactic. On one of the news stations last night they made it clear it is CM's attorney who is pushing for the insanity clause and he is the one stalling. Will be interesting to know who the defense witnesses will be today.
 
I don't buy any of his BS. He was certainly competent enough to kill 3 people, put one in the trunk and rig up an air freshener can to try to conceal the odor. Then he becomes magically incompetent once he's arrested. Nope.
 
I believe the defense attorney knows how a trial will end on this case. Both trying to delay the inevitable and also looking down the line for an appeal issue. If he gets Mercado to act a fool in the courtroom, I would not be in the least surprised. I am wondering since both Prosecutors and the Defense Attorneys have had discovery all this time how soon it will be tried.

If Mercado is deemed fit for trial and it is scheduled in January I will consider it our early Christmas gift! HO-HO-HO.

Wooohoo! I've been so sick of this I'm crazy act.
He was functioning just fine at work during the time between murder & arrest.
So happy these families & friends can move forward towards closure. I can't imagine having this trial drama occupy my life for years. Grieving is hard enough.

Based on what I know from evidence and etc I still believe it was a coincidence he got Sal and Ilona I think they say the car there with blood in it and that's why she was calling the hospitals etc hopefully we will know sooner than later

I know motive isn't necessary, but I was hoping we would learn WHY. I hadn't previously considered a road rage scenario... my mind is spinning.
 
Completely floored by this, Best ... if I remember right, the Deputy DA said it was random and akin to road rage and emotions running high. Stunned, just stunned.

:thud: I'm having a hard time believing it. Really? All this time asking why, why, why...and if this is the reason, it is even more senseless and terrifying. The victims names were dragged through the mud and it had nothing to do with their being murdered in cold blood. :sigh:

Not one person, but he killed three! :panic:
He didn't even know them? I guess, especially now days when the why often is illogical, but I need to hear more because it's hard to believe.

“It looks like a random, almost a road rage incident,” Erickson said. “There’s no phone call connection between them. It appears to be a random event.”
