yes Maline told the Judge this - the jury was not present..but they didn't start to look for him until February. the jury wasn't present...discussion about Kavanaugh and Riccobene was only with the judge.
Prosecution tells the judge during arguments over Kavanaugh this morning, "There are reasons we didn't call him and those reasons are protected by work product."

Let’s be honest the judge has been a waste of space from the get go. The entire trial has been a s*it show because of his attitude.

That seems so disjointed to me, but you probably have it right.What I understood yesterday was the judge was giving the option to the prosecution to start their rebuttal now, and McGee will question Rudin when he returns. Imo. I dont know if Rudin got dropped today though.
