#McStay - Baker testifies that a man identifying himself as Joseph McStay called QuickBooks on Feb 8, 2010 asking to delete the business account. He sent email to @earthinspiredproducts.com asking for more info, once he received that he could delete account. (cont.)

#McStay - (cont) Baker testifies he didn't receive a response and sent follow up email and 3rd email. Sent email 3-4 days later indicating he was going to close the case. (not close/delete accnt)
 
Is it me or does the defense seem to be scrambling?

I know it's not just you, but I think it needs to be put into perspective. Dr. Rudin said himself, and so did the prosecution, that he had emailed his other findings on Monday night. The prosecution didn't even have it at the hearing yesterday and McGee didn't have it until this morning. Even from the prosecution's viewpoint, don't you think they should go through those findings? Don't you think the defense should have time to at least look at it?

These were not things that the defense should have already prepared for, they couldn't, they didn't have the info, neither did the state! The defense also said they weren't saying it was unethical or intentional either.

When the def has to go to irrelevant things like running lights , which can have many variables, ie, dim or high voltage bulbs, dusty or dirty lenses, I'd call THAT a desperate decoy.
Perhaps I should have better explained the issue I have with the testimony. Photogrammetry is a fine science, at issue here is the method used to enhance the original image, those results were then used as data points to create the photogrammetry image. The problem with enhancing the image is the data points are not constant, for instance durning the enhancement pixels are added, by doing so the data points (locations) are changed on the image and even if the change is only a few pixels on the image, when adjusted for the distance between the lens and the subject it becomes enough to significantly change the results obtained from the photogrammetry application.

When did Dr Rudin testify that the "original image" was enhanced? I don't believe your statement is accurate...
 
It was towards the end of the questioning, I heard it live when I got home yesterday. I am not sure if it was off... but there was something about those measurements not being the same. It was part of McGee's "issues" that he wants to discuss at 9am IIRC. Listening to the video right now, he says that they have photo's that weren't presented... I mean... he does have the capability of clearing the video up as well if I understand the software correctly. Faro scan measured the wheel base at 10.71 feet. Their measurements were off by varying measurements.

Apparently, when the witness listed his educationally background he forgot to mention his Doctorate degree in BS.

OK, I pronounce this once (at least) at every trial:

I get your point. However, what would be the motivation of an unpaid expert witness? Publicity? Ego? What else? I think that analyzing the implications would lead to saying: “I discount the testimony of all expert witnesses.”

(Yes, someone could be volunteering, unpaid, for completely altruistic reasons. But likewise, people could refuse to let the pay influence them in the slightest.)

Simple answer: I am hardened by scores of capital cases.
