I know that this will not be a popular opinion here, but, I really do think the judge has overstepped the mark.

In his own words, this is not a trial and if the tweets are quoting the judge accurately, BM has been found guilty by the judge. I'm afraid, I do not call that justice, nor do I call it due process.

It heightens the need for the defense to present more than conjecture and flim flam disguised as evidence. If his lawyers cannot refute these prosecution points, their client may get the death penalty.

To me, the judge is only stating that these points go to probable cause. We still have to wait for proof beyond a reasonable doubt and a jury agreeing.

He has nowhere to run, and if he is truly narcissistic, will not FD himself.

I don't think the psychiatric literature supports that claim - narcissistic PD overlaps with several other disorders (two of which better describe Barry, IMO). The idea that "narcissism" is a stand-alone DX or that narcissists never self-harm is false. IMO.

Apparently there's enough for probable cause but NOT proof evident.

Proof evident isn't a thing where I practice so I don't know how you are supposed to weigh that.

The judge does not believe the state proved enough evidence for first-degree murder so there will be a bond set. We are on a little break now. The family was all in tears hugging one another. #BarryMorphew

For some reason the prosecution didn't bring up any of those reasons for not giving him bond.

On the question of bail, the judge says the prosecution did not meet the standard of evidence greater than that needed for probable cause, which is what would be required to deny bail.

I don't know if the no-body holding over for trial is any sort of precedent, but it bodes well for the possible future of the Gabby Petito case if she is never found... MOO
