Part 3 - Transfer of Guardianship or Conservatorship
§ 15-14.5-301. Transfer of guardianship or conservatorship to another state

Universal Citation: CO Rev Stat § 15-14.5-301 (2017)
(1) A guardian or conservator appointed in this state may petition the court to transfer the guardianship or conservatorship to another state.

(2) Notice of a petition under subsection (1) of this section must be given to the persons that would be entitled to notice of a petition in this state for the appointment of a guardian or conservator.

(3) On the court's own motion or on request of the guardian or conservator, the incapacitated or protected person, or other person required to be notified of the petition, the court shall hold a hearing on a petition filed pursuant to subsection (1) of this section.

(4) The court shall issue an order provisionally granting a petition to transfer a guardianship and shall direct the guardian to petition for guardianship in the other state if the court is satisfied that the guardianship will be accepted by the court in the other state and the court finds that:

(a) The incapacitated person is physically present in or is reasonably expected to move permanently to the other state;

(b) An objection to the transfer has not been made or, if an objection has been made, the objector has not established that the transfer would be contrary to the interests of the incapacitated person; and

(c) Plans for care and services for the incapacitated person in the other state are reasonable and sufficient.

(5) The court shall issue a provisional order granting a petition to transfer a conservatorship and shall direct the conservator to petition for conservatorship in the other state if the court is satisfied that the conservatorship will be accepted by the court of the other state and the court finds that:

(a) The protected person is physically present in or is reasonably expected to move permanently to the other state, or the protected person has a significant connection to the other state considering the factors in section 15-14.5-201 (2);

(b) An objection to the transfer has not been made or, if an objection has been made, the objector has not established that the transfer would be contrary to the interests of the protected person; and

(c) Adequate arrangements will be made for management of the protected person's property.

(6) The court shall issue a final order confirming the transfer and terminating the guardianship or conservatorship upon its receipt of:

(a) A provisional order accepting the proceeding from the court to which the proceeding is to be transferred which is issued under provisions similar to section 15-14.5-302; and

(b) The documents required to terminate a guardianship or conservatorship in this state.

§ 15-14.5-403. Effect of registration
Universal Citation: CO Rev Stat § 15-14.5-403 (2017)
(1) Upon registration of a guardianship or protective order from another state, the guardian or conservator may exercise in this state all powers authorized in the order of appointment except as prohibited under the laws of this state, including maintaining actions and proceedings in this state and, if the guardian or conservator is not a resident of this state, subject to any conditions imposed upon nonresident parties.

(2) A court of this state may grant any relief available under this article and other law of this state to enforce a registered order.

I know it’s wrong but I really want to write the realtor and ask which room BM murdered SM in so I can plan renovations accordingly. Why are they listing it as a Poncha Springs property? I think I need a break from this infuriating case.
I know the word "basement" was used early on and it was stated that there was no basement but I grew up in a tri-level. There was no "basement" but the lower level was below ground much like a photo I see that appears to be a small family room area that the window is up high. Im wondering if that's the room that was being mentioned as we called that level the basement also. jmo
 
Suddenly the home touts High Speed Internet and a Security System? I think the photo with the three marks in the bathroom is actually necklaces. I find the photos disturbing. I don’t think she’s buried there but I think she died there. Odd there are no good photos of the master nor the kitchen.

I’ve followed The last few CO cases and I’m convinced they collected what was necessary I’ve never thought her body was on the property (I’m the wood chipper theory person) but I do believe this listing may cause a new press release in the next week possibly

Thank you so much for your reply. I sure hope that there is a new press release soon. BM may very well have used a wood chipper. He's so cocky in his assuredness that Suzanne will never be found. How much bleach does it take to clean up a wood chipper? hmmm.

I have a completely opposite read on BM right now.

I think he's feeling extremely anxious and rattled right now.

He's been making bad move after bad move.

It's interesting to me that the house got listed on the heels of that body being discovered in Saguache County.

Even if it's not SM, it does potentially speak to BM's hyper-reactivity to news of bodies being discovered.

I think he's in a state of near constant apprehension, wondering when the axe is going to fall.

The thought is not an unhappy one.

When we downsized and sold our home, our realtor had a person come in to stage each room by rearranging furniture, depersonalized, and a few days later a photographer came for still shots and video tour.

These pictures look like some that Barry took on his cell phone.
 
I wonder if LE will do a final sweep before the house is sold? I'd hate to be the new owner and have LE show up with a warrant to search again.
It’s happened before in the McStay case where the new owners granted permission for LE to return and remove flooring, drywall etc. and they learned there was indeed blood evidence. IMO
 
It is sparsely furnished in my opinion, very basic. No signs of a beautiful woman living there.

That's typical in selling a house. It's important to remove all the things that personalize a house, because sellers need potential buyers to imagine themselves and their own belongings in the house. It's something stagers make sure and do to help get a house ready to sell. No clutter at all, no frou-frou, no doilies, no magnets on the fridge, all personal photos removed, clean and not a lot of furniture to overwhelm any of the spaces. My realtor used a stager when I sold a property years ago. IMO
