Weinstein: The sooner we can get closure the better for everyone’s interests. “The ugly tragic truth is that Jennifer Farber is dead.”
Gloria Farber’s attorney Richard Weinstein: such a hearing could undermine state’s alleged ongoing murder case
JUDGE: Still believes there sh on sk be an evidentiary hearing. She wants to hear from those
who were part of warrant

Troconis attorney: Estate admins says there’s overwhelming evidence Jennifer Farber Dulos dies by homicide. Attorney Schoenhorn says the affidavit that was signed by detectives is based on speculation, opinion and hearsay.

Attorney Anne Dranginis argued that Schoenhorn “does not have standing” to be a part of the discussion regarding Jennifer Dulos. However, he argued that this case could have an effect on Troconis’s criminal case.

Schoenhorn said the request is full of “half-truths,” which claims Dulos is not just dead but was likely killed. “They’re not just asking you to declare that Jennifer Dulos is dead,” Schoenhorn said.
Schoenhorn said there would need to be a full evidentiary hearing before the court can determine if Jennifer Dulos is dead.
Anne Dranginis one of the lawyers for Gloria Farber said that if judge looks at timeline of her disappearance and the medical examiners conclusion there is enough evidence to say Jennifer Dulos predeceased Fotis Dulos which is all they are seeking.
Weinstein said the request for Dulos to be declared dead has nothing to do with any ongoing criminal cases. “This is just going to be an excuse for some media frenzy around the Troconis case,” Weinstein said.

Peter Alter the attorney appointed to represent Jennifer Dulos said that he doesn’t believe it’s in her best interest to wait another 5.5 years to declare her dead. “Make a determination that is final so that the children can get in with their lives”

@Tomlinson_PE
“To what end does the prolonging of her being determined to be dead benefit her,” Attorney Peter Alter, guardian ad litem for Jennifer Dulos said. Even if she is alive, he said, the estate in question is “insolvent” and there is little for her to lay claim to
Knierim is now reiterating Dranginis’ claim that Schoenhorn should not be a party to these proceedings

Hug implores Daly to “look at the big picture” and craft an order determining that Jennifer Dulos predeceased her husband. “I would urge the court to adopt the suggestions that were brought up by Attorney Alter and the others here today,” he

Daly said the court will adjourn and any orders will be issued at a later date

“It’s an alternate reality to think that Jennifer Dulos is alive. She is dead, and she died in May of 2019,” Attorney Richard Weinstein said following the hearing

Attorneys are now sparring over items left at Fotis’ properties. Schoenhorn claims his client has not been able to retrieve items, including her child’s toys, from the home at 4 Jefferson Crossing.
There are two pieces of furniture, valued at about $800, in particular that are being contested. Troconis claims the items were a gift to her, but Hug said it is “nearly impossible” to get to the bottom of these disputes. (BBM)

MT has removed items during two previous visits. Her summer shopping trip yielded all kinds of items, after the JFD family had claimed their items.

NOW....MT says more toys and furniture belong to her???? I need an explanation, other than greed. JMO...IMO

Unbelievable but not surprising once you think about it. MT always wants, wants, wants. Why didn’t she get those items while FD was alive if they were hers and he knew it? And FD and MT shared a safe deposit box? Is that the one we know about or another? MOO.

Like vultures, they are!

Like vultures, they are!

I’m all for it if they’re sparring for the good of the kids but it’s shameful otherwise. The greed and spitefulness of MT make me sick once again. She can’t ever let news about JFD go by without trying to make herself a “victim”, too—as if $800 of furniture and toys that she neglected to mention were hers on her previous ransacks could compare in any way to the murder of JFD and the sadness of JFD’s kids and family! Truly sickening. MOO.

Thanks for posting this sds1.

Showboat Schoenhorn is at it again. It's all about him and MT. Attorney Dranginis speaks the truth. Schoenhorn has no standing in the probate hearing and his attempt to use the venue to create free publicity for MT is disgusting, IMO.

When the family of the victim and the court-appointed victim's GAL agree that a ruling of death is rational and desired by all parties, Schoenhorn's motivations have to be suspect.

If the parties who matter, the probate attorney, the victim's family and attorney, and the victim's probate attorney agree, it should be a powerful reason to rule in favor of the motion, IMO.

A couple of "must" read tweets from Dave Altamari...Notice MT's child's toys are Lego's...wonder how often she uses those now?:

@davealtimari

To show how contentious the estate has become. There also seems to be a dispute over a few pieces of furniture, mirror, drinking glasses, kitchen knives and apparently a set of Lego’s found at Jefferson Crossing all of it worth less than a few thousand dollars.

AND...Don't think NP or AS were present either:
The Dulos probate court hearing has seven different attorneys at least. This is going end up rivaling the divorce case when it comes to attorneys fees. This time most of it is coming out of the remains of Fotis Dulos estate.

Under the circumstances, I don't know that I'd want to go on record asking for knives.

Legos. Seriously. So she can donate them.

She's had ample opportunity ALREADY to recover her possessions.

No one is going to believe she fled with the shirt on her back anyway.

How much more does she want to take? Hasn't she taken enough?

Judge Daly says she is reluctant to set new precedent without a hearing and based on legal briefs which only cite an 1878 case to buttress their argument to declare Jennifer dead five and a half years before state statutes say she should be.

One of items in safety deposit box is a Tiffany ring that likely belonged to Jennifer, also three watches for the the couples three sons. Gold coins were supposedly birthday presents for the children.

Dulos had a separate safety deposit box at Peoples Bank that contained more than $35,000 in valuables including Rolex watch, gold doubloons, rings and other jewelry. There is some dispute over who it belongs too.

Articles about the Probate Hearing. They are all very similar:

This article includes a nice gallery of some of the attorneys involved.
After hearing arguments from attorneys involved in the case on why they felt Jennifer Dulos should be declared dead, Daly adjourned the proceedings without making a decision. It remained unclear whether she would schedule another hearing on the matter to seek more evidence or issue a ruling based on arrest warrants.
Judge: More evidence needed on whether Jennifer Dulos is dead

In his motion, Hug argues that Jennifer Dulos was likely dismembered by Fotis Dulos.

Jennifer Dulos' mother, Gloria Farber, has custody of the couple's children. Her attorney, Richard Weinstein, joined in asking for a death declaration.

“The sooner we can get to the closure of Dulos’ estate, the better it will be for everyone,” Richard Weinstein said. “The tragic truth of the matter is that Jennifer Dulos is dead.”

Daly said she will study the issue and assess whether more witnesses need to be called to testify before she decides on the request.

https://www.usnews.com/news/best-st...s-hearing-to-decide-if-jennifer-dulos-is-dead

Daly said briefs submitted by attorney Christopher Hug and letters from attorney’s representing her five children and her mother Gloria Farber that they agree she is dead may not be enough to “deviate from state statutes.”

“It’s fair to say you didn’t provide the court with any related Connecticut case law precedent to make it clearly deviate from the seven-year statute,” Daly said. “I believe that a full hearing needs to be held before I can render a decision.”

Probate judge delays decision on whether to declare missing New Canaan mother Jennifer Farber Dulos legally dead

While I believe that JD is dead and the victim of a murderer by her husband and his posse, it really irritates me that Christopher Hug put himself front and center of the Judge to say it's so.

IMO, he's just a slithering snake in the realm of this tragedy. I'm sorry if anybody is offended by my feelings here. MOO

@Tink56 - any news on KM's divorce hearing from 10/21? Which was supposed to be a remote hearing. Any "new" hearing date? Or too soon to ask....

TIA! :)

I think that was delayed? There may be a post up-thread with the November date?

If anyone spots him in Florida -- post piccies!!!

You have time to sing, Kent, make sure everyone knows exactly what Michelle Troconis did to make sure Jennifer was out of her way!

No that was about the assault case in his divorce which was moved to 11/5/20 - this hearing was "just" about his divorce. :)
