The sergeant testified that after seeing the video from Albany Ave in Hartford of Fotis Dulos making multiple stops to dump items, and a woman he inferred was Michelle Troconis in the car with him, the sergeant said there were exigent circumstances to seize her phone.

The sergeant testified that there was an immediate need to seize the phone so potential evidence couldn’t be destroyed. He said he immediately put it in airplane mode so that couldn’t happen. A search warrant to do a forensic exam of the phone was applied for & granted on 6/6.

I am incredulous that MT is jumping in and posting on Marissa Alter's twitter thread today related to the questioning of the sergeant who took MT's phone and put it into airplane mode and then got a warrant ! Just a bad look overall and terrible judgement IMO

And he also mentioned after asked by atty Jon Schoenhorn if he was present at JD home before the 31st & he said that he DID NOT see any blood in New Canaan 69 Welles Ln. garage on the 28th which he took photographs to show Nanny Lauren Almeida on the same day.

Thanks. I was wrong about the time of day the warrant was approved for FD’s device and logical extraction of it anyway (a warrant had been approved for his phone records at 8:30 am - prior to taking his phone -, but the warrant to seize the device and logically extract it was approved at 8:50 pm NOT am). I deleted my original post and edited to include correct info.

Analysis of FD’s phone led to discovery of the Albany Ave evidence-dumping trip and the surveillance images of MT accompanying FD on that trip. Cannot imagine a judge disagreeing with LE that seizure of MT’s phone to prevent FURTHER evidence destruction was absolutely called for Under those circumstances.
Discovery of the Albany Ave location/stops proved extremely critical here! Don't even want to think about where this case would be if dumpsters had been collected and routed to the landfill. o_O

I'm glad MT's tweets do not shows on my feed from reporter! How incredibly stupid. Of course there were not visible pools of blood inside the garage nor does the AW report such.

The AW addresses evidence of blood being cleaned up from the floor and panel of garaged vehicles! Also, the photos that were shown to Nanny were not about blood evidence but for her to identify what if anything was out of place and/or missing from the garage and she did just that including noting a couple of child seat cushions missing that were later found inside dumped, black garage bags. MOO

Dulos DID use 10 full rolls of paper towels to clean up the mess he made-no wonder the cop didn’t mention it, when he was asking the nanny to try and identify what might be missing or out of place-and can you imagine being the nanny and trying to do that in someone else’s house? I couldn’t even do it in my own house-especially the garage!

Lauren Almeida (Nanny) affirmed she arrived at JFD's residence at 69 Wells Lane on 5/24/19 around 11:30 AM, opened the center bay garage door, and immediately noticed the Range Rover parked inside and the Suburban gone, which was inconsistent with Jennifer's plan to drive the Range Rover to her appointment.

What Lauren did not see (with her naked eye) after opening the garage door was a bloody scene with pools of blood on the garage floor, walls, and door panels of the Range Rover.

This observation on 5/24/19 by Lauren, most likely the first person to enter the garage within hours of fD fatally attacking Jennifer, is important to the context of MT's tweet from Court today.

The idea that JLS's examination of Sgt Beauton and his testimony that he did not see blood inside the garage on 5/28/19 while taking photos shared with Lauren, does not in any way mean that citing there was blood evidence and signs of blood clean up in the AW is incorrect or it was somehow a fabrication by police because no blood was not detected by the naked eye of Lauren or Sgt Beauton.

Seriously, please tell me that MT doesn't really think fD simply drove away from 60 Wells Lane with Jennifer's body -- leaving a bloody mess behind?

Not only do we know fD used 10 rolls of paper towels to clean up the garage but he also used several sponges and buckets.

To be clear, MT (if you are reading), finding forensic blood evidence in the garage is not the equivalent of seeing blood on the garage floor with a naked eye. Sorry MT, this testimony by Sgt Beauton was no smoking gun, and it's obviously not the Perry Mason moment you were promised!

Of course the interrogation videos are in! Waiting 6 months to require an interpreter when your attorney was at your side was really a stretch -- even for JLS.

UPDATE: We are finally going to begin the hearing on the defense’s motion to suppress Michelle Troconis’ statements to police. They’ve now added Friday to the testimony schedule with the video interrogation motion starting so late today.

Several hours worth of interviews with Troconis will be entered into evidence in the hearing. There will also be testimony so it’s going to take a while to get through it.

The whole week has been blocked off to take up motions from Troconis’ attorney to get evidence thrown out in the case. That included wrapping up arguments Monday on the defense’s motion to suppress anything from Troconis’ cell phone after it was seized without a warrant. Most of the testimony on that motion was heard on Sept. 13. Police seized Troconis’s cellphone on May 31, 2019, a week after Jennifer Dulos was last seen dropping her kids off at school in New Canaan. The phone seizure came while police served a search warrant at 4 Jefferson Crossing in Farmington, the home where Troconis lived with her then-boyfriend, Fotis Dulos, who was going through a bitter divorce at the time with Jennifer Dulos.

The rest of the day Monday was expected to focus on the police interrogations, strip search, and seizure of Michelle Troconis' cell phone after her arrests in connection with the Jennifer Dulos murder investigation.

The testimony from law enforcement is part of a suppression hearing at Stamford Superior Court ahead of the start of her trial in January.

The hearings will center around the interviews Troconis had with state police in 2019 after investigators charged her as a co-conspirator in the case, along with other charges including allegedly tampering with evidence and hindering prosecution.

At a hearing last week, Troconis' attorney Jon Shoenhorn said in court, he plans to bring up what he calls an unconstitutional attempt by investigators to get Troconis to talk.

"The fact that they arrested her late at night, ripped her away from her 12-year-old daughter, had kicked her out of her house so she could not even be asleep in her own house will all go to whether this was part of an effort to deprive her of sleep her surroundings," Schoenhorn said.

State prosecutor Michelle Manning argued that police had grounds to seize Troconis’ phone without a warrant because there was more than enough “probable cause” to believe that the phone was related to the disappearance of Farber Dulos and that it had information relating to the case.

Meanwhile, defense attorney Jon Schoenhorn argued it was unlawful for police to seize that phone without a warrant because there was no probable cause, and that as a result, the contents of the device should not be used as evidence. He added that police had time to get a search warrant for the phone, but didn’t get one.

Defense and state lawyers also presented questions to the officer testifying about the validity of a video which allegedly shows Troconis discarding a package that contained old license plates in a storm drain.

The defense argues there is no proof the person in the video is Troconis. Schoenhorn spoke to reporters briefly about her interrogation videos with police.

12/7/23 Update: FILED on 12/4/23 Defendant is seeking dismissal of charges citing the right to a speedy trial, as outlined in constitutional amendments & legal doctrines. The argument centers on the delay between jury selection & the start of evidence, claiming a violation of statutory & constitutional rights. A new date has been set for the Troconis trial in Stamford. Attorney Jon Schoenhorn clarifies Troconis’ court appearance on Monday, 12/11/23, is a suppression hearing. Her trial is expected to start on 1/8/24. Troconis’ attorney, Jon Schoenhorn, said that interrogation videos will become public at that time.
12/11/23 Update: Troconis is in court for a multi-day hearing on her attorney’s motion to suppress Troconis’ police interviews at trial. Before the suppression hearing began, both sides took up requests from a couple jurors who now want off the trial. The day begins with taking up emails from two jurors who now say it would be “inconvenient or beyond inconvenient” to serve on the jury for Troconis’ trial, which is expected to last two months. The first juror has had a change of residency since being picked. Juror who was chosen says he actually lives in New York & has lived there since Nov. 2022 but never changed his license to NY & the jury notice came to his parents’ house, where he used to live, in CT. Juror is excused. He was selected as a regular juror. So now one of the six alternates will be drawn to replace him. Next person who says he can’t serve on the jury is an alternate. He says he can’t serve on a jury that length because his mother-in-law needs heart surgery & he & his wife need to help take care of her. Judge excuses him from serving. Now down to 4 alternates left, along with the 6-person jury, when the trial begins in four weeks. Jurors: 6 jurors & 6 alternates. (8 men & 4 women / 6 men & 4 women). Now 6 jurors & 4 alternates.
