LE needed the SW to determine the locations of where the phone was when used for making calls. The cell phone provider will give detailed information as to what tower was used when each call or text was made or received. This will then be used to corroborate JW story as to where he was when he said he made those calls, sent those texts or received the same.

If he wasn't were he said he was or was somewhere he shouldn't have been, bad news for JW.

Not denying that. But because they got a SW doesn't prove he isn't cooperating with the investigation...

If law enforcement asks you to provide your mobile device to them for examination and sign an authorization to your provider (which every urban law enforcement agency has on hand) allowing law enforcement to access your records, no warrant is needed.

But if they want to use any of the retrieved info in a trial, they need a SW, imo. They would not go forward without one because a person can rescind their authorization at any time.

Good point. But if it was a First Responder, would it have been put in a SW? That seems like it would muddy the waters...but I am certainly no expert on how legal documents work!

I'm sure LE is checking with first responder's if it's possible, just firming up the evidence.

I believe that a customer can only direct that the provider turn over information that the customer himself has a right to obtain from the provider. The SW is seeking information on the location of the cell phone. I don't believe that I or any customer has a right to obtain location info from the provider. So I think a SW is necessary regardless of consent.

I wonder if they asked JW to see his phone, he agreed because the texts and photos had already been deleted? The sw was sealed so JW wouldn't know LE were already looking at his records and finding W2. It sounds like he forgot to tell W-2 to delete the photos from her phone. Big mistake on his part.

Not necessarily. Even if JW handed them his cell and said 'go for it' ---they would still obtain a warrant for legal purposes. Getting a warrant does not automatically mean that he is not cooperating. He might not be, I don't know. But LE obtaining a warrant is not indicative either way, imo.

After years of paperwork between LE and telcoms and obtaining warrants for those cooperating that they've developed legal authorization forms so that when someone is cooperating, they sign the form and the process that once took hours/days now takes minutes. It makes it easier for everyone involved and speeds up the process.

Is it normal for the Secret Service to be involved? Given how AIW worked on the Pentagon, I've wondered if AIW did classified work or maybe the Secret Service is involved because the bank was used.

I'm very curious about the Secret Service involvement as well- they have a pretty limited jurisdiction. That being said, I think agents are available to help out local PDs when needed even if not really related, but I am not 100% sure of that... I'll try to do some digging.

Secret Service also investigates currency crimes. Maybe they are tracking the cash to determine accountability. IDK
