JSS did this in Trial #2 when it became obvious that Jodi wasn't going to allocute. She spoke with Jodi directly, I believe, at the bench, with the public in court, since we got it tweeted. Almost certainly, the goal was to prevent Jodi from later saying that it was everyone else's fault that she was sentenced to whatever and that she didn't willingly give up the right to allocute. JSS had Jodi make it clear that she did indeed willingly give up her right to allocute: it was her own decision. JSS spelled out what the opportunity to allocute meant. Then, she asked Jodi if she had taken any meds, no doubt to record that Jodi made the decision and couldn't later claim she was not "all there". (Ironically, I believe it's possible Jodi was supposed to be on meds, but was out of compliance.) While these moments of direct communication with the defendant at the bench, I believe, aren't that common, I thought it was clever of JSS to preempt any future manipulations of Jodi on this score.
