But why should authorities have to rely on everyone else to look after them? Shouldn't their MOTHER be doing that? Isn't that one of the purposes of CPS? To take children out of situations, where the parent(s) aren't capable of looking after them?

Agreed.. but note i did say right now

Watch out for the findings past the funeral

"Right now"

Things will change after the funeral..

The obit listed names sisters, the first sisters last name is also different than the other 2. And where is that child?

Also list the BF as the step father. I didn't think a "boy friend" was a step father. It thought you had to be married to be the step father/mother?

CPS doesn't have to wait from my experience. If they believe that the children are endangered they will act. However, if they are going to remove the kids based on what the police investigation reveals then it will take time. i.e. if the police feel that the mother was negligent they will turn their findings over to CPS as it is a child welfare issue.

I am not sure what the criminal charges for negligent parents are in Florida.

I followed the Jorlys Riviera case too. It was sad as is so many others.

I also followed the Tori Stafford abduction, sexual assault and murder. The mother, Tara McDonald (Google the case) was crucified by the media and the public. For a long time. Turned out the mother had nothing to do with the crime.

under our fourth amendmrnt rights, dcf has to have a court order to remove the kids UNLESS they are in clear/immediate danger

Can't be too hard to do. DFACS removed Jorelys almost immediately and the mother's worst infraction was simply allowing her 8 year old to go to the apartment complex playground alone. She didn't put Jorelys in a van with a stranger or knowingly allow a strange man to escort her 8 year old to dressing rooms.

She also didn't expose her other kids to danger by allowing them to play unsupervised.

This mom exposed all three girls to this same monster. No red flags, at least none she knew how to recognize or was willing to listen to. I'd say those children are in immediate danger. Mom has zero logical judgment according to her actions.

I think DFACS and CPS can get pretty quick hearings/court orders on this kind of stuff very quickly, especially when the case is being opened because a child is dead. :twocents: :seeya:
---
ETA: I just looked up an old article on Jorelys. They weren't even anticipating charging the mom with anything! They still removed the girls for safety, then did their research, then returned them fairly soon.

Police have removed two other young children from the Rivera home over ‘concern about the supervision of Jorelys,’ said Lt. Jay Baker with the Cherokee County Sheriff's Department.

Baker said no charges were expected against the mother or the baby sitter.
(the babysitter wasn't with Jorelys, but also back at the apartment.)

I'm sorry if you've already said and I missed it, but how far is it from Cherish's residence to DG?

Feel free to create a fancy map with pin points so we can picture it better... (I'm only half kidding!) :seeya:

Do we know if she walked from home to Dollar General or got dropped off?

I have no idea how she got to the DG. I don't believe it has been said or heard yet..

maps

(A) Cherish's Residence
(B) Dollar General
(C) WalMart
(D) Location of her body :(

Residence...1.0-1.3 miles to Dollar General
6.63 Miles to WalMart
4.5 Miles to where her body was found :(

Dollar General to WalMart 5.6 Miles
WalMart to where her body was found 3.4 Miles

Perhaps she previously married a US citizen and the third sister is a child she had with him?

If the mother is originally from Australia, as some questioned early on, she would need a legitimate way to remain in the US and collect government benefits. (Pretty sure that dancers are not on the Immigration list of ‘necessary occupations that are unable to be filled by US citizens’ - so I doubt her previous job would have gained her residency status). Marriage to a US citizen would be enough to allow her legal residency in the US.

You might be right.

BTW, the sentence BBM made me laugh out loud!

Or you could get pregnant by an American and give birth in Florida. Then you could probably stay, right?

Thanks for trying to make the map. I wouldn't even know where to start! :blushing:

I really think that third child belongs to the boyfriend and another woman. :twocents:
If she had previously lost custody of a child we would have heard that by now.

Here, some people call that an "anchor baby." (Sorry, I know that's not PC.) People come here from Mexico and have babies, in hopes of not getting deported, or the baby growing up and securing citizenship for them. If she was here illegally (Cherish being born here, does not make mom a citizen) then I think we would have heard about that already. If she couldn't provide the police with a social security number or documentation, they would probably be looking into it.

How did someone think she was from Australia, again? I don't remember.

"According to Pastor Steve, Cherish loved to win little prizes for memorizing Bible verses. He says if she'd get a piece of candy she acted as if she were holding "$10,000." He says her family was having a tough time financially.

In fact, he says, the church wanted to bring them a meal to cook but neighbors said the family's stove was broken. The church bought them a new stove and a vacuum."

So heartbreaking :(

What case is left? The father was fighting the unfit mother for custody of his child. The custody case is over. The lawyer is speaking for his client who is still being kept from his child. I don't care if he rents an airplane with a banner and flies it over the State of Florida. I am so angry at this mother and bf, so I can only imagine what the father is feeling.

Thank you for answering my questions. your response is what I thought to be the norm too.

Even the most fame monger atty's don't behave in this manner. Allred, Kuby etc. i wanted to call my atty and ask about this but I kinda didn't want to spend the 200.00 for a question lol

good night, Cherish, wherever you go, go in peace...

And I don't believe in the existence of angels
But looking at you I wonder if that's true
But if I did I would summon them together
And ask them to watch over you
To each burn a candle for you
To make bright and clear your path
And to walk, like Christ, in grace and love
And guide you into my arms

Into my arms, O Lord
Into my arms, O Lord
Into my arms, O Lord
Into my arms

It is heartbreaking.. but only for the children.. if i was that diwn on my luck the best i could do for my child is send her to daddys until i picked myself up..

Early on, some people here saw something on her FB site that made them think she was from the Ipswich area here in Oz. (We have a saying here .. the Dippy from Ippy). I haven't seen that myself though because her FB site went fairly private quite quickly.

I have seen animals protect their babies better than this mother. I don't know about any of ya'll but if someone is creepy and paying to much attention to my child and wanting her to buy HIGH HEELS he would have been picking up his teeth and trying to find his eyeballs because I would have plucked them from his head, right there in WM, if he would have said anything remotely close to what we have heard he said.
But that's just me..........

So should we all just quietly hand our children over to pedophiles for fear that the scenario gets worse?

They were in a public place, and there was help available, and a pedo is not going to get far if they attack every shopping family who don't let their children be groomed and molested. Exceptions to every rule but it is not usually their MO and at least 99,99999% of the time it is more dangerous to let your kids leave with perverts than not.

Anyway I'd rather be attacked and die fighting than just give my children to a pedo and know that i didn't try to protect them.
