So Garcia's attorney's theory is that Charlie Adelson hired Rivera (not Garcia) to carry out the hit on DM? Given all the evidence we've seen over the past 5 years, that seems highly implausible. There's no evidence I'm aware of that CA was in contact with Rivera. And CA had a much more direct connection to Garcia (via KM) than to Rivera. (It was not clear whether Garcia's attorney was suggesting that KM served as a go-between between CA and Rivera, or whether Garcia is saying KM was involved at all.)

Garcia's attorney admitted that Garcia and Rivera traveled to Tallahassee together (at least on the second trip, when DM was killed) -- but said the purpose of their trip was to do drug deals, not kill anyone. But that theory seems at least somewhat in tension with his blaming Rivera for the murder. Is Garcia's position that Rivera told him they were going to Tallahassee to do drug deals, but that Rivera instead was secretly planning to kill DM all along, but never told Garcia? And what was Garcia doing while the murder was happening (and before, when they were following DM around town)? Just hanging out innocently in the car while Rivera got out and shot DM? He really expects the jury to believe that Garcia had no prior knowledge of the murder at all? And how is Garcia going to argue that the trip was really about drug-dealing unless he testifies to that himself?

Garcia's main tactic, as articulated in his attorney's opening statement, will be to attack Garcia's credibility. No doubt, there is plenty to attack; I re-watched Rivera's interview, and his statements are confused and arguably contradictory and even flat-out wrong in certain details (not to mention that there's no doubt he's a violent criminal). Rivera is clearly not the sharpest knife in the drawer. But the basic gist of Rivera's story -- that he traveled to Tallahassee at Garcia's request to help with the hit -- is consistent with the objective cell-phone evidence, and much, much more consistent with the other evidence (i.e., the relationships between Garcia, KM, and the As) than anything Garcia's attorney floated in the opening.

Seems to me that what Garcia's attorney realistic best hope may be not an acquittal, but a conclusion by the jurors that, although he was involved in the murder, it wouldn't be fair to give him the death penalty because the others who were involved (Rivera and the As) were either given a light sentence or haven't been prosecuted at all.

Ms. Cappelman has prepared extremely well and conveys a sense of confidence with her carriage and demeanor. Her delivery was calm, logical, and clear. The woman to the right of Ms. Cappelman was fidgety and her tossing and flipping of her hair was a distraction! SG’s defense attorney used the 7fingers too much. I know why, and I understand the intent, but it was irritating. I got the impression there’s not a lot to work with, defense-wise, so he’s tossing out the best he’s got for a defense. It’s flimsy at best. KM’s attorney was high energy and had an attitude. The defense may have some doubt-provoking evidence, but it remains to be seen if those two can pull off reasonable doubt.
BTW, I’d never seen pics of either defendants with glasses. Now both are wearing glasses. Strategy or bad vision?

Glasses were equated with intelligence as far back as the 17th century, per Business Insider, because they were only worn by skilled craftsmen and scholars who needed them for finely-detailed work."

Dan Markel's family was in court Thursday as attorneys made their opening remarks....

While prosecutors pointed heavily to the involvement of the Adelson family, neither Wendi nor any of her family members has been charged and all deny any involvement in the murder. Defense attorneys were quick to point that out to the jury.

"They're not in this courtroom today and they're not going to be here during this trial," Kawass said.

Testimony will continue Friday and is expected to last another three weeks...."
