Defense is dragging their feet because they're not prepared for closing arguments. In any case, there isn't time for closings today esp if they all want to take 2 hours. Good lord. That's whole day of closing arguments the jury will have to sit through - painful.
I don't know who DaCoste is going to put up for his case in chief but after all this complaining that no one called the club owners about KM's employment if he doesn't bring a couple club owners to say she worked there and got paid in cash he's going to looks extremely foolish.
The jury should have asked that question to the neighbor who called 911. He must have knew it.
Still begs the question why asked? Dunno.....
Matt Damon could play Det. C?
Your comment raises a very interesting point about juries and the jury trial process. The defense never has the burden of proof, and a defendant declining to testify and declining to present their own witnesses and evidence should never be held against them. In fact, the jury will be explicitly instructed not to hold a defendant's silence, or the non-presentation of defense evidence/witnesses, against them. However, no matter how strongly a jury is instructed on these fundamental rules, there is always human nature and human curiosity. It can be dangerous for a defense attorney to keep hammering a very specific point during their cross-examination of prosecution witnesses (in this case, that KM was making all that cash from the clubs she worked at), because when the defense gets their turn to present a case, their failure to bring in even a single person from the club to substantiate this will raise some eyebrows. Even if the jury is no not supposed to consider it, they inevitably will.
The only reason I can think of for that question is if they were trying to ascertain if some kind of conversation/altercation took place between Dan and his killer before he was shot.
What was the answer?
I have followed your posts throughout this trial, and I want to thank you so very much for your expertise, and putting it in terms that all of us can understand. Greatly appreciated I'm sure from more than just myself.
You bring out many things and put it into words that are so easy to understand for us. And point out many significant things for us to consider.
