Prosecutors in the case of Isleworth murder suspect Bob Ward have asked for his medical records from the day his wife died and the day after.

A former prosecutor spoke to WESH 2 and said the state wants to know whether Ward was under the influence of any drugs or alcohol the night he is accused of shooting his wife.

Criminal defense attorney and former prosecutor Tom Luka said Ward's defense needs to lessen the damaging impact of that statement. "If the defense is trying to make the statement he wasn't in his right mind, then it's up to the prosecution to rebut that with medical evidence, Luka said.

Luka said it is common for prosecutors to successfully petition the court for medical records. "It's extremely likely they will be granted if the defense has in any way, shape or form brought his mental state into play in this case."

The defense filed a motion asking for contamination logs along with all kinds of documents related to how lab staff handles or mishandles evidence. Now more than ever, an Orlando defense attorney said law enforcement labs are being questioned about their methods and objectivity. "The National Academy of Forensic Science came out with a scathing report on virtually every crime laboratory in the United States, basically saying that because they are overseen by law enforcement that they are not being neutral or objective in their findings," Orlando defense attorney Richard Hornsby said.

Hornsby said the reliability of law enforcement lab testing was also questioned in that recent National Academy of Forensic Science report. "They find that many of the tests do not stand up to scientific scrutiny," Hornsby said.

All of that scrutiny, Hornsby said, can lead up to something very important to defendants like Ward and Casey Anthony. The more errors that can be found in how law enforcement processed and tested key evidence, the more doubt jurors could have about its reliability.

The case of an Orlando millionaire accused of killing his wife will be back in an Orange County courtroom Thursday.

Attorneys for Robert Ward want the court to turn over all records collected by the Orange County Sheriff's Office and the FDLE crime lab, items like crime scene notes, iological evidence, training records for crime scene investigators and more.

Investigators say they recovered a Smith & Wesson .357 Magnum handgun from the top drawer of a nightstand next to the bed in the master bedroom.

Ward is out of jail on bond and confined to his Isleworth mansion with a GPS-monitoring bracelet.

Inside the courtroom, attorneys for Bob Ward asked the judge to force law enforcement and prosecutors to hand over discovery documents in the case. They're looking for things like DNA evidence, crime scene notes from the sheriff's office and lab records.

"In this type of case, there is not going to be one bomb that shows this is what happened. We want to look at the evidence, understand it all and present it all," Ward&#8217;s attorney Kirk Kirkconnell argued.

As far as records are concerned from the sheriff's office, the attorneys just have to put in public information requests. Prosecutors agreed Thursday to work with the defense to help them get the rest of the discovery.

Attorneys for Bob Ward, the Isleworth man accused of killing his wife last year, told a judge this morning that they had reached an agreement with law enforcement in getting documents dealing with DNA.

Ward's defense team wants records from the Orange County Sheriff's Office that focus on the collection, analysis and evaluation of DNA evidence in the case.

An attorney for the county told the judge that the documents, including crime scene technicians training records, are public record. The defense can submit a request to view them.

If an issue arises, the defense can file a request to the judge, said Michael Snure, one of Ward's attorneys.

The defense also wants records from Florid Department of Law Enforcement. Snure said the state has agreed to provide the entire lab file on the case. The defense can also review lab manuals.

Ward was there dressed in a dark suit and pink tie. He came across as pretty relaxed at the hearing.

Ward's team was looking for access to the sheriff's case file and the Florida Department of Law Enforcement's records on how the evidence was handled.

Seeing as much of it is already public record, those requests were granted.

Bob Ward left court Thrusday without comment and two bodyguards at his side.

His team would not comment on whether they plan to claim that this shooting was an accident.

A log of e-mails from an Isleworth man accused of killing his wife last year was filed in court Tuesday by his defense attorneys. Florida's law requires prosecutors to turn over certain investigative material to defense. When that happens, the material becomes public record unless ordered by a judge.

Ward's attorneys want a judge to stop the release of the e-mails. They cite various legal reasons, such as attorney-client privilege, work-product protection, trade secret exemptions and confidentiality.

The log reflects e-mails sent and received between June and September. The content of the e-mails is unknown, but Ward's attorneys categorized them by topic. The Orlando Sentinel is fighting for their release.

Attorneys for Diane Ward's estate also filed objections to certain e-mails being released to the public. The Ward's two daughters, Sarah and Mallory, along with Diane Ward's sister, Paula Saare, filed their objections. Some of the e-mails listed in their log include e-mails between Bob Ward and Mallory about birthday plans for Diane Ward. Others involved travel agenda, holiday plans and household monthly budget.

The daughters of Isleworth homicide suspect Bob Ward are asking a judge to keep their late mother's personal information out of the public eye. They're also slamming the media for feeding the public's "morbid fascination" with the case.

In court papers, the attorney for Ward's daughters said the airing of their jail visits is an example of how they've been subjected to unwanted public scrutiny while struggling to deal with the loss of their mother, Diane Ward. Releasing the information to the public, they argue, would create a new media circus to "satisfy morbid curiosity."

What remains to be seen is whether Bob Ward's motive for allegedly killing his wife has anything to do with the information contained within the documents both the suspect and victim's family are fighting hard to keep out of the public eye.

The Wards said the electronic information is part of an "overbroad seizure" by detectives.

Among the evidence are two lab Florida Department of Law Enforcement reports. Details about the reports were not listed on the notice.

Earlier this week state prosecutors filed a motion that a several-page search warrant for an IBM Thinkpad was released to Ward's defense lawyer.

Ward is accused of shooting his wife, Diane Ward, inside their mansion in September. Ward, a developer whose company went into bankruptcy before the shooting, faces a count of second-degree murder. He was released from the Orange County Jail after posting $100,000 bond.

I find it pathetic they are so disinterested in justice for their sister and mother. Really disgusts me. I know people will say it's "none of my business", but seeing criminals locked up and justice served is EVERYONE's business.

The auction to sell murder suspect Bob Ward's Isleworth home has suddenly been put on hold.

The foreclosed 8,800 square-foot house was scheduled to be put up for auction on March 23rd. But for some reason the auction has been delayed until May.

At the time of his arrest, the Wards had not paid their $16,000 a month mortgage payment for more than year. The home, which was once owned by pro golfer Arnold Palmer, had been on the market for $3.5 million.

In paperwork filed with the court Thursday, Kirkconnell said Ward plans to fly out May 14, stay at the Ritz-Carlton near downtown Washington, and fly back May 17. Ward would continue to wear his satellite monitor, Kirkconnell wrote, and stay in touch with the people who monitor his whereabouts with it.

He is asking Komanski permission to travel so he can attend weekend events at George Washington University. His oldest daughter, Mallory, will be graduating. He wants to fly out May 14 and return May 17. Ward plans to stay at the Ritz-Carlton near downtown Washington.

The state opposes the trip. So do several others. Ward's request to travel to Washington, D.C. and stay at the Ritz-Carlton has irked at least two of the people who purchased property at his developments.

In separate letters recently filed in Orange County Circuit Court, Lori Sirovy and Theresa A. Noto asked Judge Walter Komanski not to give Ward any special travel privileges.

In a letter dated April 7, Sirovy stated she was one of the thousands of Land Resource property owners "swindled" by Ward. "There are many of us who are watching this case very closely and are enraged at his cavalier attitude," she wrote.

"It is very frustrating for me to see the unscrupulous over spending on Mr. Ward's behalf while millions of dollars which were taken from our communities un [sic] accounted for by Mr. Ward and his officers."

In her April 2 letter, Noto said she and others are "outraged" that Ward has asked to attend his daughter's college graduation "where he will enjoy 3 days of festivities while being ensconced at the Ritz Carlton."

Personally, I hope the judge denies him the ability to travel to the graduation, it's bad enough he's not sitting in a prison cell awaiting trial - this is just MOO
 
I'm sure Diane would have liked to attent the graduation also.

The sooner this is locked up for the rest of his life the better.

The attitude of this man and his family is a complete outrage! Wonder just how many people he has ripped off to fund his cozy lifestyle? How exactly is he affording to stay at the freaking Ritz-Carlton? I'm thinking the money is coming out of the trust funds. I am furious that this man is being allowed bail.
