The judge presiding over the upcoming damages trial against Rudy Giuliani said Friday she will tell jurors that the former Trump lawyer intentionally hid financial documents and other records in defiance of court orders.

That means jurors deciding how much Giuliani should pay two Georgia election workers he defamed will be told they can assume the worst about why the former New York City mayor has failed to turn over the court-ordered records.

Additionally, Giuliani and his lawyer will be prohibited "from making any argument, or introducing any evidence, stating or suggesting that he is insolvent, bankrupt, judgment proof, or otherwise unable to defend himself" since he failed to hand over evidence that would show that's true, the judge wrote.

He's toast. Sweaty, dripping hair dye toast. He FAFO'd bigly!

(total 7 counts). Bond $100K. Surrendered 8/23/23. Plead not guilty (9/1/23) & waived his arraignment. Represented by Manubir Arora & Scott R. Grubman.
vs. Sidney Katherine Powell (68) (Trump campaign lawyer) indicted & charged (8/14/23) with 1 count of violation of the Georgia RICO Act (1), 2 counts of conspiracy to commit election fraud (32 & 33), 1 count of conspiracy to commit computer theft (34), 1 count conspiracy to commit computer trespass (35), 1 count conspiracy to commit computer invasion of privacy (36) & 1 count conspiracy to defraud the State. (total 7 counts). Bond $100K. Surrendered 8/23/23. Plead not guilty (8/29/23) & waived arraignment. Represented by Brian T. Rafferty.
Trial set to begin on 10/23/23 with jury selection. About 450 potential jurors will report on this date & another 450 on 10/30/23.
Trial set to begin on 11/6/23. (expected to last 4 months)
Prosecuting Office: Fulton County, GA District Attorney’ Fani Willis’ Office.

The Court finds that the motion is procedurally defective & the defendant's request is simply beyond the purview of this Court-Denied. 10/10/23 Update: Fulton County prosecutors investigating efforts by Trump & his allies to overturn the 2020 election are seeking testimony from Republican National Committee Chair Ronna McDaniel, at the upcoming trial of lawyers Chesebro & Powell, according to court documents. Prosecutors are also seeking testimony from conspiracy theorist Alex Jones & Andrew Hitt, a 2020 Trump elector in Wisconsin. Prosecutors say each of them has unique knowledge as to Chesebro's involvement in efforts to overturn the 2020 election. To compel testimony from an out-of-state witness, two judges must sign off. The judge in the jurisdiction where the case is being prosecuted, Judge McAfee, and a judge local to where the witness lives. For McDaniel, that’s Michigan; for Jones, that’s Travis County, Texas; for Hitt, that’s Wisconsin. There are certificates that McAfee signed for McDaniel & Jones in the docket but there isn’t one for Hitt yet. Has filed motion on Friday, 10/13/23.

10/10/23 Update: Chesebro: At a hearing Tuesday, McAfee heard arguments on several motions filed by Chesebro. One seeks to dismiss the indictment as a violation of the U.S. Constitution's Supremacy Clause. A second argues Chesebro's actions outlined in the indictment were protected by the First Amendment, so the indictment should be dismissed. The judge didn't immediately rule on either motion but indicated that the arguments advanced by Chesebro's attorneys may be procedurally improper for pretrial motions. A third motion argued that any legal memos or correspondence between Chesebro & the Trump campaign, which was his client in the aftermath of the 2020 election, should be excluded. McAfee grilled the lawyers for both sides on this issue & asked them to provide additional information to help him make a decision." Next 450 jurors will report on Monday 10/23/23 for jury selection.

10/13/23 Update: Powell & Chesebro: Notice of hearing. The parties having submitted their proposed questions for the juror questionnaire pursuant to the Court's Order entered on 9/15/23, this matter is scheduled for argument on Monday, 10/16/23 @ 10am.

Chesebro rejected plea deal.

He either is very confident in his defense, is scared to testify against other defendant(s), or ...what? Sounds like a sweet deal he turned down. imo

The deal, from the link, was for him to plea guilty to one count of racketeering, testify against other conspirators, and write an apology.

In exchange, he would receive three years probation and a $10,000 fine. And, his record would be wiped clean after probation.

Maybe he wanted the deal served to him on a silver platter?
