Edwards, a couple of more quick answers. Theresa would have filed for the divorce, the whole point was Parker didn't want to let go of her. I don't know about the legal stuff, but checking on status and picking up his copy from her lawyer would make sense. I agree with gagal's take on it.

Yes, there was an appointment at the bank for Friday afternoon, and she was expected and didn't show. I'm sure the police were interested in getting the answer to your question from whoever dealt with Parker.

Lots of other good questions you raise as well.

Now Sam Parker says that Theresa took off because she got caught having an affair. We know that is a lie but so what if she was having an affair? No reason to run away. She was divorcing Sam and had a right to do whatever she wanted.

I also remember Sam Parker saying that Theresa and some friends had gone away to stay at a motel or hotel for a few days. That was right after she went missing. There she was in the middle of moving her stuff out of the house and into her new place and she just up and decided to take a few days off and got stay at a motel with friends.....another lie Sam Parker.

I hope they can break this buddy of Sams. He should be looking out for his own neck instead of protecting his good buddy. If he doesn't start talking they may both end up behind prison bars.

~snip~

According to an affidavit, the Computer Invasion of Privacy charge stems from Chaffin accessing Theresa Parker's e-mail account on March 17th.

Apparently Chaffin formally waived his extradition rights yesterday. In a bond hearing today the judge seemed surprised that Walker County, Ga. authorities had not arrived to pick him up. In court Chaffin's Alabama attorney offered to drive him back to Georgia. The judge said he would not allow that, however he denied bond.

Walker County authorities have one week to pick Chaffin up or he will be back in Mobile County court next Wednesday when he could potentially be released.

I hope someone from Walker County takes a road trip to pick up the SOB from Ala.

Former LaFayette Police Officer Harbin "Ben" A. Chaffin was using a computer to check on data about Theresa Parker a few days before she mysteriously disappeared, according to one of three new felony warrants obtained against him.

The warrant says on March 17 that Chaffin "did use a computer to access a MSN provider account owned solely by Theresa Parker with the intention of examining personal data and financial information relating to Theresa Parker with knowledge that such examination was without authority."

Another warrant says Chaffin "did willfully and intentionally violate the terms of his oath as prescribed by law, to wit he did violate the laws of the state of Georgia by committing the offenses of computer invasion of privacy, giving false statements charged previously on 4-02-07, and tampering with evidence."

I wonder what evidence he tampered with? So he was into Theresa's business on the computer when he was still working huh? I wonder why he was snooping into her business...for himself or ole Sam Parker?

Harbin A. “Ben” Chaffin was charged April 2 with:
Giving false statements. Conviction: 1-5 years imprisonment.

In warrants obtained by the GBI on Monday, July 16, Chaffin was charged with:
Computer invasion of privacy – “On (March 17, 2007 he) did use a computer to access a MSN provider account owned solely by Theresa Parker with the intention of examining personal data and financial information relating to Theresa Parker with knowledge that such examination was without authority.” Conviction: 1-15 years imprisonment and up to $50,000 fine.
Tampering with evidence – “On (March 17, 2007) he did knowingly destroy, alter, conceal, or disguise physical evidence by cutting off the top portion of an email he caused to be printed from the MSN account owned solely by Theresa Parker in order to conceal the email address showing the location(s) to and from where said email was sent.” Conviction: 1-3 years imprisonment.
Violation of oath by public officer – for the above allegations. Conviction: 1-3 years imprisonment.

Ohhh it sounds like he printed the material from her account and used that to show officials where she planned to vacation.....maybe.

I find these charges VERY odd. I wonder if he was trying to help SP set up an "online" meeting with a stranger, etc. and make it look as though she dissappeared as a result of this online "relationship" or something. Just makes things even more confusing.

This whole thing is as intertwined as an every day soap opera. I feel so bad for Theresa's family and pray every day that they can gain some closure and that justice would be done.

Whatever he was doing stalking Theresa online he was doing for Sam Parker. It mentions looking at her financial information. Don't forget that the reason for this and most disappearances of women with silent ex's is money.

Coming a few days before her disappearance, say on the Monday before her Wednesday disappearance, that was the week which would end with a final signing of divorce papers and the requirement for Sam Parker to buy her portion of their property. I believe it was stated that payment was about $20,000, in addition to $4,000 or so he paid her in the early part of the week after the snooping incident and before her disappearance.

When she disappears, he no longer has to pay her a substantial sum of money, and if not convicted would collect her life insurance. Doesn't matter if large or small, it changes her from a net loss to a net gain.

That's why inconvenient women disappear.

Also note that Parker and Chaffin worked together, and he was probably sitting right next to Ben when they dd the snooping, and that the snooping was likely detected because it used a county office computer that was examined as part of Theresa's disappearance. The only other way it would have been detected is if Microsoft supplied a list of times and IP addresses for access to Theresa's MSN account, and that would have been quick considering how quickly Chaffin was found out.

I haven’t piped up for a while so heres my take to now.

BC is being played for a scape goat. His biggest crime was being friends with a ticking time bomb. SP would have BC log onto TP’s email account because SP refused to learn how. One of those computer phobic deals. BC is not programmer material, but he can hit a few buttons and type in a password. BC would print out the account activity and rip the header off the top of the page which contained any identifying info and give it to SP. The email he printed from Tps account showed that TP was planning a little trip to the mountains for two. SP went nuts.

That is all LE has on anyone. WEAK.

SP killed TP and disposed of the body, all by his lonesome. He would not have involved another pair of eyes for anything. The guy is a marine. Don’t sell him short as far as knowing the workings of killing and covering tracks. SP did not have to do any hard work either. No digging, sweating, getting worked up. It was just like carrying out the garbage. He most likely has a Pit somewhere that he has been dumping into for years. Family Pets, deer carcass, old computers, household garbage... you name it – down the pit.

There are plenty of em. I once saw the entire contents of two tractor trailer loads, cram full of junk dropped down one medium sized pit. You may have just as well dropped a bb into the ocean. What goes down, stays down. SP likely had his in and out route down to a scant 15 or 20 minute round trip from his house. Back the car up to the hole, drag out the garbage, slide the cover back (old tin or the likes) drop garbage, cover hole, outta there.

BC is guilty of the same thing all local LE should claim responsibility for. Turning their backs to a real situation that was bound to occur. Now they have all waited too late.

I dare say SP will stay clear of his pit for years. He will however return one day... He will shoot his self in the head and fall in to be with the woman he loved. For eternity.

rd. you nailed it right here:

In my humble opinon, Cunningham is right on the mark. I know him well and have a great deal of respect for him. He is no nosense.

From the Walker Co Messenger

The arrest Tuesday of Harbin “Ben” Chaffin in Alabama was completely unnecessary, says his counsel, LaFayette attorney David Cunningham, on Friday.

“It disturbs me that my client is being portrayed as a fugitive from justice when law enforcement knew exactly where he was,” Cunningham said, adding that the three recent warrants served contain “no new information.”
“Law enforcement knew all of this even before the last bond was set,” Cunningham said, referring to the charge against his client in early April of giving false statements to investigators, for which he was released on a $5,000 bond.

In an appearance before Judge Jerry Day in Walker County Magistrate Court Wednesday afternoon, Harbin “Ben” Chaffin was granted bond totaling $10,000 on two charges.....................

continued.......

Rome Judicial Circuit District Attorney Leigh Patterson requested the denial of bond, saying the criteria under state code has been met.

“The computer invasion of privacy and tampering with evidence charges go absolutely to the heart of the criteria that allows this court to deny bond,” she said.

Day disagreed. “Had Mr. Chaffin made bond (last time) and gotten out and started doing things to try to cover up and obstruct I might feel different, but I don’t think some inconsistent statements is enough to keep him incarcerated.”

Such statements were laid out by Patterson in reference to the hours of investigative interviews of Chaffin.

She pointed out that on March 27 Chaffin told a GBI agent that he accessed Theresa Parker’s MSN e-mail account with a password “that was written down.”

“He admitted to this agent that he had gone into Theresa Parker’s computer and discovered details about this trip to Gatlinburg, Tenn.,” Patterson said, adding that Chaffin did not mention to the agent that he had e-mailed to his own account, printed it, and cut off the top to conceal his act...........

continued.....

Theresa Parker’s sisters and mother were present at the hearing, and said afterward that they feel Judge Day’s decision to grant bond is a disgrace

“I feel that Jerry Day should recuse himself from this case for the same reasons as Buzz Franklin and his staff did,” said sister Hilda Wilson. “He has had dealings in the courts with Ben Chaffin and he should not preside over his legal fate.”

so otoh was right about the email about a trip to Tennessee, if I read that right. Has to be more to say he viewed personal financial information, I believe.

Much more RD the article at the WCM has been updated and adds that Chaffin led authirities to the pond and pointed to the place to search. When ask about why he was having them search the pond , he responded , "I don’t know what I’m doing. That’s my stupid way of policing. I’m trying to picture in my mind… I’m trying to think like Sam. It’s like where would he put her? I guess that’s stupid.” This leads me to believe alot of things namely that this statement not only implies that he knows but that he also implicated Sam Parker.

Yes. I figured that was what the email that was printed was about since Sam said in his interview that he gave her money to pay off credit cards a couple of days before she disappeared but he then mentioned that she was instead planning a trip......

Not sure about the financial information....maybe he looked at some other stuff too or that could just be the legal wording of the law that they used to charge him (against the law to access internet accounts and view personal and financial information). I know they said that Leigh Patterson didn't want to give away all the interview details b/c it would jeopardize the case

Yes, the article has been updated since I posted it. I was just going to post that......him leading them to the pond tells me that either he was trying to throw them off the trail or just trying to act like he was cooperating OR that he helped Sam put Theresa in the pond, especially since he pointed to a specific area, but that maybe it's possible Sam moved her the next day when he had all that time and that Ben didn't know that?????? I'm convinced he knows more than what he's telling since he's got the lawyer, etc.

Also, one more thing - he didn't tell them that was his stupid way of thinking and that he was trying to think like Sam until 4 days later after they found nothing. At first, he just told them they needed to search the particular area of the pond like he knew that was where Theresa was.
