Just to keep the record straight about the extraordinary activities in the Braunschweig rape and sexual abuse trial and the role played by the accused's defence team in the debacle.
The court officials allowed this witness to take the stand; what on earth were they thinking about.

The videos and photos were shown at the request of Christian B's lawyer, Dr Friedrich Fulscher, who argued it was important to understand that the witnesses may have been egged on by such media reports to misinterpret the defendant's behaviour as a sex offence.

The video was played straight after the court read out the testimony of the Portuguese girl who claimed that Christian B had been in a playground, pulled down his trousers and masturbated while calling out to her.

However, the prosecution objected to the video being shown in court and said that they could not see the relevance of it.

The prosecution were spot on in questioning the relevance. Particularly when it added nothing to the process and actually allowed due process to be derailed for two days.
 
Its either The reporting of the Dr's assessment is a condradiction, he's alleged to have said CB is in the absolute top league of dangerousness and then says he's only likely to reoffend in the 30%-50% range which is 70%-50% he wont.

Police investigated Brueckner at the time over her death in 2010, but he was never charged.”

In the absence of court transcripts reliance on journalistic licence can be counter productive short of a record of which witnesses have taken to the stand.

A characteristic of information emanating from the journalists is that accuracy takes a period to settle in and even then the minutiae of proceedings is seldom as fully sequential and transparent as one would like it to be.

Wells there's one the BKA are certain of with no charge in sight ,it would best clear that one up first.

German police say they have enough evidence to charge Brueckner and hope the probe into his alleged involvement will conclude next year.

thats one thing I dont understand. Considering it took a couple of years to take the current trial to court they could at least have charged him for the MM case

Probably wouldn't get passed the first hurdle.
No, while they can continue to claim that CB did for MM without actually having to try and prove it, they are content to do so, particularly if they can get him locked away for something else in perpetuity .

One presumes BKA investigated the information received but found no evidence to back it up.
Just as CB also featured in another high profile investigation in 2016, which proceeded no further.

One wonders how often he was investigated in like fashion over the years. But the norm is that -- "No Evidence" = "No Indictment"

The five cases investigated and brought to court obviously met the required criteria in 2022 (only the alleged quality of the witnesses being blamed for the withdrawal of charges in 2024).
Also passing muster was the indictment featuring the rape of DM and the betraying body hair confirming the information received which instigated today's proceedings.

Funny old world though when the BKA is
  • derided when there is no supporting evidence justifying further action
  • roundly criticised for pursuing leads which provide sufficient evidence to raise charges to bring a suspect to trial.

There was sufficient evidence available in 2022 to allow charges to be laid against CB for serious sexual crimes which were totally unrelated to the MM case except for the fact police found them as a result of separate investigation of crimes against MM.
 
It has been said that his report only comes into play if he is convicted so to be honest she shouldnt really bear his words in mind unless she does convict him.

I think their plan is very simple & very obvious. Prosecute these 5 cases, wait until all proceedings & appeals have concluded, then make their move in the MM case.

Passing over their files before other proceedings have ended would be idiotic.

she cant find him guilty without the evidence just because of what he said . Not just that HCW has never ever said they will wait for all appeals to go through before making a move in the MM case. He has however said there may or may not be the evidence to indict in that case.

To suggest that the prosecution will launch appeals, even before verdicts are announced, suggest that it recognised that the evidence is weak.

You can't appeal a court decision just because you happen to disagree with the judge, there have to proper legal reasons for doing so

Best to await the verdicts before talking about appeals, I think.

I must admit myself to be at a loss as to why it would be a shameful outcome for a sexual abuser and aggravated rapist to be locked up having been found guilty of his crimes after due process.

I agree. Particularly as there could be appeals and counter appeals. But there are other issues which haven't drawn a great deal of interest of late, but they are still there.

Constitution of an Arguido', and said: 'As part of the investigation into the circumstances surrounding the disappearance of MM in 2007, a person was made an arguido on Wednesday.

'The man was made an arguido by the German authorities in execution of a request for international judicial cooperation issued by the Public Ministry of Portugal.

'The inquiry is led by the Portimao section of the DIAP in Faro with the assistance of the Policia Judiciaria police.

'The investigation has been carried out with the cooperation of the English and German authorities.'

There are two viable options open regarding the charging and prosecution of the prime suspect in MM's disappearance.
  • the Germans may take him to trial
  • or the Portuguese might
Just a matter of time until it all kicks off looking as if the belt and braces of the five serious sexual charges have still to do their job. But the fall back position to 'mak sikker' has been in existence since 2022 and wasn't put in place for no reason.
