  • 12:05 a.m.: The burner phone has contact with Amber's phone from West Babylon. Around this time, the client -- described as an "ogre" driving a first-generation Chevy Avalanche -- arrives at her residence at pays for her services, at which point a male pretends to be an outraged boyfriend and the client leaves.   • 1:18 a.m.: Amber receives a text from the burner phone reading "That was not nice so do i [sic] credit for next time." The burner phone sent the text message from Massapequa Park. (pg. 8 of the bail application)
  • 9:32 p.m.: The same burner phone communicates with Amber's phone, using a cell tower in Midtown Manhattan (pg. 8 of the bail application)
  • 10:39 p.m.: The burner phone again has contact with Amber's phone, this time from a cell tower in Massapequa Park (pg. 8 of the bail application)
  • 11:05 p.m.: The burner phone has contact with Amber's phone from a cell tower in Massapequa Park (pg. 8 of the bail application)
  • 11:17 p.m.: The burner phone travels to West Babylon near Amber Costello's residence. Shortly after this, a dark-colored truck was seen driving past Amber Costello's residence. (pg. 8 of the bail application)
- 5 September 2010: RH's wife returns to New York from New Jersey (pg. 9 of the bail application)

- 15 January 2011: An AOL email account -- "Springfieldman9" -- linked to a Tinder account and burner phone is established with an Astoria, Queens zip code (pg. 17 of the bail application)

- October 31, 2013: RH is allegedly (case later dismissed) struck by a car at the intersection of West 36th Street and 6th Avenue in Manhattan (Affirmation in Opposition in Heuermann v Singh)

- 2014 or 2015: RH had hernia surgery (pg. 99 of the EBT in Heuermann v O'Sullivan)

- Mid- to late January 2017: RH flies to Las Vegas to attend a conference for "four or five days" (pg. 19 of the EBT in Heuermann v O'Sullivan)

- March 2017: RH drives down to Virginia to visit his mom by himself. (pg. 129 of the EBT in Heuermann v O'Sullivan)

- November 2017: RH visits Las Vegas alone "for a couple days to meet some people." When asked, "so it was a pleasure trip?," RH responds "I guess you could say that, social." (pg. 133 of the EBT in Heuermann v O'Sullivan)

- January 2018: RH drives down to Cocoa Beach, Florida with his wife, mother, and daughter (pg. 131 of the EBT in Heuermann v O'Sullivan)

- 14 February 2021
  • A fictitious Gmail account, "Hunter1903a3," is created with the fake name "Andy Roberts" and is linked to the burner phone 347-885-1697. The IP address used to accept the Terms of Service for this account was RH's residence in Massapequa Park (pg. 24 of the bail application)
  • The "Hunter1903a3" account is used to send pictures of a prostitute in upstate New York between two of RH's "burner" email accounts (pg. 24 of the bail application)
- 28 July 2021: RH purchases four unimproved lots totaling about 5 acres on Rippling Brook Drive in the Mirror Lakes subdivision in Chester County, SC for $154,351 (Rock Hill Herald)

- 23 February 2022: RH allegedly gets into a car accident near the intersection of Union Avenue and Devoe Street in Brooklyn (pg. 5 of complaint in Heuermann v Fenimore)

- 28 March 2022, 9:19 - 9:25 a.m.: A fictitious Gmail account, "thawk080672," is used to search "long island serial killer" (pg. 20 of the bail application)

- 21 July 2022: An undercover SCPD detective recovers 11 bottles from the trash can outside RH's house in Massapequa Park (pg. 26 of the bail application)

- 8 November 2022: The burner cellphone 347-304-2671 is used to access the "Springfieldman9" account (pg. 17 of the bail application)

- 11 December 2022: RH's cellphone is used to access the fictitious "Springfieldman9" email account for over 3 hours (pg. 17 of the bail application)

- 26 January 2023: RH is observed throwing a pizza box in a trash can outside 385 5th Avenue in Manhattan. The box is recovered by a surveillance team (pg. 29 of the bail application)

- 19 May 2023: RH is observed by law enforcement via video and field surveillance at a phone store in Manhattan purchasing additional minutes for the burner phone 347-304-2671 (pg. 22 of the bail application)

- 13 July 2023: RH is arrested outside his office in Midtown Manhattan. At the time of his arrest, RH had the burner phone 347-304-2671 (linked to the "thawk080672" Gmail account) on his person (pg. 31 of the bail application)

I swear I saw a video with the SC DA and he seems to say that maybe RH's DNA hasn't been entered into state and national databases... because of laws. That it's only usually done if there's a "conviction". WHAT?? Maybe I misunderstood! I'm trying to find another acceptable link to post. Did anyone else hear similar??

The Federal Bureau of Investigation (FBI) maintains the host systems and provides a telecommunication network to one CJIS Systems Agency (CSA) in each of the 50 states, the District of Columbia, territories, Canada, and federal agencies, including DOJ. CSAs provide access to CJIS systems as well as Nlets.
Maybe is VICAP. I’ll have to watch the killing season again but whichever system it was was voluntary so the lack of data reporting was causing connections in crimes to be missed. Edited to add: it is VICAP.

I'm trying to research NY's DNA Databank. I see the BBM part.


Presently, any offender convicted of a New York State felony offense or Penal Law misdemeanor is required to provide a DNA sample for inclusion in the Databank. This requirement applies to anyone convicted on or after August 1, 2012; the law does not apply to juvenile delinquents, whose cases are handled in Family Courts, or individuals granted youthful offender status by the court, which results in their conviction being sealed except in limited circumstances allowed by law. The Databank also includes samples from offenders who provided them under certain circumstances outlined in state regulation.

Additional Information

The New York State DNA Databank was established by law in 1994 and began operating in 1996. At that time, only offenders convicted of certain offenses were required to provide DNA samples.

The list of crimes that require a DNA sample upon conviction has been expanded five times, most recently in 2012. In addition to requiring DNA samples upon conviction for felony offenses and all Penal Law misdemeanors, the 2012 law expanded a criminal defendant’s access to pre- and post-conviction DNA testing in certain circumstances.

In addition, state regulations permit the release of partial DNA matches that meet certain criteria to law enforcement agencies for investigative purposes and allow law enforcement agencies to request a familial search of the DNA Databank in connection with unsolved, serious crimes. Information in the Databank is protected by state law and by comprehensive internal procedures. The intentional disclosure of a DNA record to an unauthorized person or agency or the intentional use or receipt of DNA records for an unauthorized purpose is a felony.

It varies state to state. Some states collect DNA after any arrest. In other states it's any arrest for a felony. And other states require a conviction of a felony before they collect DNA. So, it's possible that they haven't collected DNA yet. I don't know NY's laws on the matter.
NY I believe you have to be convicted of a misdemeanor or felony to be required to provide a DNA sample, and there are certain crimes that fall under the misdemeanor and or/felony umbrella that don’t require it.

NY I believe you have to be convicted of a misdemeanor or felony to be required to provide a DNA sample, and there are certain crimes that fall under the misdemeanor and or/felony umbrella that don’t require it.

Special circumstances could warrant a pre-conviction DNA sample. They already have his DNA, it’s just a matter of it being entered in CODIS. I’m no expert but I’m going to guess the DA has to make a motion to the court and have it granted and ordered to be entered into CODIS pre-conviction? Just MOO

I suppose it’s possible. Laws are a funny thing; sometimes from a legal standpoint, it’s not the written law itself, but the interpretation of the law that can be manipulated and argued.

Maybe it’s in and they are keeping it quiet, maybe they are taking the legal steps required by the jurisdiction and NYS Laws to make sure it gets in ASAP.
