Yes, I don't think that a mistrial at this point would even benefit the DT. Later on, it might, but not this early on. They wouldn't gain anything by starting over now, IMO.

I agree. I would think they would want to wait until they see more how the prosecution is going to paint this case, and go for a mistrial request right before prosecution rests. That way, all the cads are on the table, and they know how to defend better. Not sure why they are trying for mistrial so soon.

Unless, the defense has been doing absolutely nothing for past couple years. From the looks of their questions of witnesses so far, it seems like they have done nothing...LOL
