don't remember the exact date . . .
what time did she tell you that she saw this incident what time of day?
I would have to look @ the dates

you are looking at something else that is not marked
Mr. Martinez do you have it?
I don't have it

Oh you are looking for that day . . I am sorry I was looking for whole collection . . these notes don't involve the masturbation . .
ok if you have them somewhere else go ahead and pull them out and we can mark them for exhibit

These notes are from May 14 2011 .. . . I have another reference to it . . . hands those over to the court as well . . . Dr. S. is still thumbing thru pages

exhibit 543?
there is no date on that . . . .
no date indicated on your notes
correct
you don't tape
correct
all of the notes of when you are speaking with her - your notes

her scores on the PTsd an mcmi scales . arrived @ the conclusion from DSM
date of that publication?
2000
every 10 years has been published . . . . so 2010 new one you haven't purchased?
not a new one yet
didn't purchase DSM 4 TR?
no

you marked A1, A2, A3 lets take a look . . .

speaking objection
judge
approach!

have your report?
yes
in my report there is an error
I am not asking about an error - just after B-3,
I wrote C-3, C-6, and D-3 but I had omitted . . .

I need a date . . .
December of 2012
amendment not given to the State was it?
no I didn't write an amendment what I did was

objection
approach please

Jm back to his own files searching for a paper

Wilmot . . . I want you to finishyour answers in the C's and D's

the C's what are the criteria in C that apply to JA
objection - he is referring to something else
I am referring to my worksheet
ok can we have it?

entered

something you have prepared?
I reviewed this and realized I left out numbers and letters and left out those that met C and D

C - efforts to avoid thoughts about the trauma . . . she avoided

C3 in ability to recall aspects of trauma - memory lapse

c5 - feelings of detachment or estrangement from others - I included attachmentrestraint mentioned early on in the process

c6 - restricted range of affect - blunted affect

7 - sense of forshortened future - when she was feeling like shewanted to harm herself - that is less than a function for today.

c1, 3, 6, 7, necessary criteria is 3
noticed an error would you have mentioned errorsooner
oh yes

D required 2 of 5
irritable or outbursts of anger - anger expressed telephonically with her mother

D3 - inability concentration

D4 - hypervigilience - responded to noise in jail facility
she reported not able sleep with noise - not related to nightmares
need 2 and I found 3

A1 and A2
yes both were met
experienced or confronted with actual events . . . . killing TA . . .
could it also be TA attacking her first
objection not in evidence
it could be but the killing was so much more intense that it superceded

intense fear, helplessness, harm . . . .based upon crime scene photo - threat to her life that the attack eventually caused I felt she met the criteria
the intense fear, and terrified?
yes

B3 - how many criteria . . . I found 3 criteria only need one

recurrent and distressing recollection of events - intrusive thoughts - not where she can't remember -she remembers beginning and end of the attack

psychological distress to internal and external cues
replacement reality (ie: the story) her way to deal with the stress

physicalogical acitivity reaction to internal stimuli . . . .

these are from his notes - what makes JA fall within PTSD profile

all the criteria . . .if person have more criteria doesn't make it worse PTSD just more criteria .. . not trying to make JA sound worse with more criteria? no

lets stay on this for a second . . . DSM 4 - published in 2000 .. . they go and publish about 10 years . . . the DSM 5 is overdue . . . there are beta versions on the internet . . . we don't use it until it is published .

DSM 4 TR - text revision - some text sub are rewritten to make it more clear - it is essentially identical . . . I think there may have been one or two adjustments but not relative to this case

nothing wrong to use DSM4 - I have small version of DSMTR - that I travel with . . . does have the criteria in here and are virtually identical to DSM 4

exhibit #456 - wasn't entered . .
you were showed this portion . . . nothing noteworthy to report that was 2 days after the pediphelia behavior
objection . . . .
next question

exhibit #511 - entered by the defense
has the same first paragraph but it also goes on

you were asked to read when she talks about TA having . . . TA cheating on her . . . yes

at the very end ofthis exhibit TA cheating on her he seems mildly remorseful - going to stop writing about this right now it is of no benefit . . I could rip out the last few pages

besides reviewing all of her journal entry - questions about Ms. Arias . . . . journal entry not going to stand for TA saying negative things about he friends. . . I was glad she was able to write that . . . .Sunday 07 . . . . TA staying @ rachels . . . she won't stand for anyone else saying negative

she wrote something that is mildly assertive but that does not transfer o assertive behavior there is a big gap between what people do and what they say . . .assertive training is first envisioning the assertive behavior and second is actually acting it out

her tell you something bout her confronting back when he yelled @ her ..he checked it real quick and she never tried it again - he had to have power and control.

ok . . . . um

No time that she told Dr. she was able to stand up to TA . .

talked about Transient Global amnesia before talk about dissoiative amnesia . . . wanted to show this is a real phenomenon . . . .trivial stress . . . hot water, cold water, sex . . trivial stress can . . . 119 articles reviewed can cause by trivial stress .. . . trivial stress can cause amnesia . but different kind of amnesia . .

trivial stress point? . . . what does it do to our body
it could shock system . . . . vs. dissoicateive amnesia . . .

fairly commonly occurring 3 or 8 times per 100,000 per year

woman attacked b someone she loved and her having to kill him is that more than trivial?

Many notes are being taken by jurors right now, or perhaps questions? ::raises eyebrow:: #JodiArias

Michael Kiefer @michaelbkieferSamuels tried to ask a question of the judge and she told him he can't talk to her directly. That white noise machine is going to overheat!

Dr says the more traumatic the event the more memory loss (I think I missed this part)

back to the graph . . . memory function under duress over time . . . (inverted bellshaped curve) . . . .the research has not yet given us the answerof where exactly lose and retain memory . .
the bottom of the u shape . . . memory is not being formed . . .eventually long term memory s not being formed . . . a week or 2 weeks down the road the person may not remember during that period of acute stress . . .

is that considerered long term memory 2 weeks later?
no that is intermediate memory - long term is a few weeks out
short term memory is forgetting a phone number after ou have dialed

if a person is having acute stress are they functioning?
that experience is not transferred to long term memory

while in those couple of minutes a person is able to recall they will remember but a couple of minutes of acute stress trying to recall weeks later that is the portion that will be lost

so . . . thank you

WildAboutTrial ‏@WildAboutTrial 1m
I don't see any jurors taking notes at this time. #JodiArias

6:33 PM

Michael Kiefer @michaelbkiefer

BTW: The Arias courtroom will be dark Thursday, and trial starts Wednesday at 1 pm. I don't know yet if there are hearings Wed morning.

MCMI . . . quoting from manual . . .did you ask for a copy
yes
did you get one?
no
ability to read entire article
no
how they relate to the entire text
no

are you familiar with use of MCMI test and MMPi . . . how many you have done?
thousands . . . two thousand maybe?
article In Forensic Evaluation - a survey of psychologists . . . about the McMI - survey asks what percentage of time they are used for court (forensic eval) . . .. MCMI used 55% . . . .on average over 118 times per year and for 18.5 years . . . in forensic matters no problems using an MCMI test? not if used correctly! you used it correctly with JA? yes

over 117 psychologists queried . . 55% time for forensic work had over 18.5 years experience . . . much more than 3 years . . . .

MCMI - you were shown some looks like numbers . . .

exhibit #541 - this is the first page - the profile
yes
on 2nd page - base rate scores
lets talk about base rate first

see the numbers 65, 75, 85 . . . . in the MCMI if you don't get it you don't use it . . . that s strong evidence that the area that exceed 75 is significant factor - should not use this alone , along with interviewing the client . . . he had a hypothesis she had PTSD . . yes

if ignored MCMI and only conduted this test . . .would that be a problem in how this instrubment is used?
yes
number exceed 75 very strong trait . . . strong enough to use without other information to form a diagnosis . . .

other things besides MCmI?
yes
relative strengths and average score . . . .if high enough to confirm your hypothesis . . . PTSd has 69 . . . anxiety scores 75 . . . .

are those the 2 highest scores . . .yes I remember that . . . that means to me anxiety is certainly a feature of ptsd . . . realtively high score in that set of variables

lost feed for a commercial - sorry

the review of all additional material I reviewed and the fact the PDS test suggested presence of PTSD . . . .

complete mischaracterization . . .. if someone doesn't have a 75 . . .
Iwould say
not even a Dr. saying that
I would say so

MCMI - how it was created . . . normed
when you do a test like this - you give the sample questions - you give more than th ones that were chosen . . . you administer test amongst those diagnosed with that particular diagnosis . . . . complex system of analysis which is beyond me at this point . . . correlates to specific diagnositic . . .test are scored against others with this wi th algorithm . . . ongoing process - validation rate keeps changing . . . mcmi was not created last year . . . continually being validated?
yes

already dx with ptsd an other conditions . . ..those people take this test . . . the validation study . . . their test would be scored - big math calculation. . . once scored gives you what people with Ptsd typically present with . . . correct

expect to see in someone you don't know for sure if they have ptsd is that what you need to compare it with? yes

you aleady had a hypothesis?
I did
she was suffering from a form of ptsd
things said in the interview- enough evidence of ptsd . . . .referring to incident of TA . . . her childhood - it became clear to me . . I had formulated my diagnosis earlier . . . diagnose to a test that is normed to people . . . .yes this test is derived from the DSM. . . . high anxiety score we could turn to DSM we can feel fairly certain the diagnosis will conform to the criteria in the DSM

MCMI correlates with, based upon, overlaps with DSM . . . . compare what it means what anxiety means in the DSM . . . is that why MCMI is a better tool in this situation?
in this aprticuar situation it was precisely what I was looking for. . .

more valid to give JA normed to general population
no it is better to give test normed on population I hypothesized about - to confirm it.

question of whether JA felt uncomfy with TA having oral sex wih her the first time - she was uncomfortable . . . . first time TA and JA had oral sex together - it was uncomfortable circumstances . . . don't know if that was the time TA gave her the book of Mormon

objection - leading
approach please

WildAboutTrial ‏@WildAboutTrial 2m
Some jurors are looking a bit zoned out. No note taking seen at the moment. #JodiArias

she spent the night - they had separate bedrooms . . . TA gave into her bedroom and he performed oral sex on her . . . that was what was reported to me . . . she was in a friends home, no understanding oral sex was ok . . . . he popped up and had oral sex . . . normally she would have dated him longer - . . . . too soon . . .after that night TA took her to church . . . .

asked questions about JA reporting she had regular anal sex with TA . . . anal sex on a regular basis . . . .had anal sex . . . JAand Dr. discussed this . . . at some point she said she tried anal sex prior with another . . . .

no . . . she didn't report anal sex was uncomfy . . . . fact that she had it with others - not uncomfy was not relative to my diagnosis of PTSD . . . . not in report that it had been tried prior to TA . . . not in . ..

not a factor in PTSD at all

rememberbeing asked whether JA talked about pictures of breasts on TA computer?
yes I remember
do you know how many computers TA had
no
timeline of when she saw these pictures?
no

various dates I could create a timeline if necessary . . .
ever specific time she saw them in 2006 or 2008

we know that there is only 1 computer
overruled
answer was no

sent a book to JA in jail . . . he purchased it on Amazon $9 paperback - obtained her address and had it sent there. . . . it has been consistently printed since 1978 - self-help book for building self esteem .. . nothing to do with depression.

ethical guidelines . . . anything prohibits you from sending a self help book to a client . .

guidelines say one should not be a therapist and an evaluator at the same time . . . .

but can ensure make the evaluation continue

many patients, friends, relatives, kids, aunt and uncle, got benefit from reading this book - it might make her open up a little more -
ultimately did she open up and reveal info?
indeed she did

in therapy would you ever just hand them a book and say I will see you next
no
sent books to others
yes - as caring professionals we have a duty to

more than a client/Dr relationship . . I have sent it to many people who might benefit from this book by sending it . . . some people I didn't like . . .

sent the book said read this book I think it may help you
if she did't read it do you think it may help you
asked about question tape recording . . . .

WildAboutTrial ‏@WildAboutTrial 2m
I am pretty sure I see the juror that takes the most notes filling out another juror question form. #JodiArias

WildAboutTrial ‏@WildAboutTrial 2m
Yes, confirmed, he just put another question in the bin. This juror stays extremely busy! #JodiArias

WildAboutTrial ‏@WildAboutTrial 36s
I don't see any note taking going on at the moment. Looks like some jurors are eyeing the clock more than the doc. #JodiArias

I missed testimony

clip of what State played for you . . . where she is grabbed by a sweater . . . gun incident . .

look thru notes - any mention of what happened with sweater
no sweater notes
gun and ran out of closet

clip we heard was between you and Mr. Martinez . . . what you and Ms. Arias talked . . . yes

besides talking about the rope and the videos and going into the closet . . . she talked to you about the whole scenario .
yes
did she talk about his violence began in 2008?
objection
approach

violence really started but got worse in 2008 . . . .

regarding the gun remember her telling you if she had the gun it would stop him
objection - sustained

objection lack foundation

first time she talks to you what actually happened was when?
april 2010 . . . april 11th?
leading
overruled
let me look

April 11th yes . . .

honestly not sure if this is the first time she talked to you or not with regarding June 4th . . .

yes she is talking about the actual dates . . .

exhibt #543, #537 and #532 . . . .they are out of context so I have to review them

April 11, 2010?
no
pull those
sure

he hands them over to the defense

JA is reading in her little yellow journal . . . .

#548 is the April notes . . . April 11

on the 2nd page does it tell you about the gun?
objection

speaking objections may we approach?

she was fleeing his approach - ran into the closet . . grab gun hoping the site of the gun would hold him @ bay . . . . she was trying to create distance . . . I think she was out of the closet @ that point . . . refer to notes . . . referring to #548 2nd page middle page . . . don't read it . . she ran into closet that is where the gun is held up

did she run ut the opposite door?
adjoining closet - hallway or bedroom not sure
running out o the closet door
she did say that
after she talked about closet door holding the gun up

objection beyond the scope of his understanding - lack foundation

ADDENDUM BELOW!!!

she ran into the bathroom . . told him about pulling trigger - gun went off - let out a scream notice blood but he came towards her they fell on the ground . . . did she talk to you what happens on the ground . . . they wrestle she was finally able to get up and flee he pulled @ her clothing . . .
did she tell you what happened
I asked a 2nd and third time what happened

when people tell stories they ma y only tell parts of the story . . . a premade story is consistent when told time after time . . I was able to hear slight differences in each of the stories I could put together...
made up stories same words sometimes used
tell story over and over
means can tell story by average of what actually happened

sometime talked to her again about what happned on June 4th

that was april 21st exhibit #537

did she tell you specificall,y if she was in the closet when gun goes off . . .
refer to notes
5th page to make it quicker
