Thank you for the clarifcation, but I remain confused. I ran this by a Public Defender in the COmmonwealth and basing it on what he told me. I thought it incredulous that Prosecutor's could seal evidence through arraignment and beyond, so clearly I misunderstood. How could a lawyer even begin to build a defense?

Could you please give us a min-lesson on how this sealed evidence thing works? At least break down stages?

Sealing evidence is a different issue than discovery in a criminal matter. A court can seal evidence from the public during the proceedings for a variety of reasons but a defendant in a felony case is entitled to discovery, albeit of a more limited nature than in a civil case. Here is the rule and statute governing discovery in a criminal case in Virginia:
RULES OF SUPREME COURT OF VIRGINIA PART THREE A
CRIMINAL PRACTICE AND PROCEDURE
Rule 3A:11. Discovery and Inspection.
(a) Application of Rule. This Rule applies to any prosecution for a felony in a circuit court and to any misdemeanor brought on direct indictment.
(b) Discovery by the Accused.
(1) Upon written motion of an accused a court shall order the Commonwealth's attorney to permit the accused to inspect and copy or photograph any relevant (i) written or recorded statements or confessions made by the accused, or copies thereof, or the substance of any oral statements or confessions made by the accused to any law enforcement officer, the existence of which is known to the attorney for the Commonwealth, and (ii) written reports of autopsies, ballistic tests, fingerprint analyses, handwriting analyses, blood, urine and breath tests, other scientific reports, and written reports of a physical or mental examination of the accused or the alleged victim made in connection with the particular case, or copies thereof, that are known by the Commonwealth's attorney to be within the possession, custody or control of the Commonwealth.
(2) Upon written motion of an accused a court shall order the Commonwealth's attorney to permit the accused to inspect and copy or photograph designated books, papers, documents, tangible objects, buildings or places, or copies or portions thereof, that are within the possession, custody, or control of the Commonwealth, upon a showing that the items sought may be material to the preparation of his defense and that the request is reasonable. This subparagraph does not authorize the discovery or inspection of statements made by Commonwealth witnesses or prospective Commonwealth witnesses to agents of the Commonwealth or of reports, memoranda or other internal Commonwealth documents made by agents in connection with the investigation or prosecution of the case, except as provided in clause (ii) of subparagraph (b)(1) of this Rule.
(c) Discovery by the Commonwealth. If the court grants relief sought by the accused under clause (ii) of subparagraph (b) (1) or under subparagraph (b) (2) of this Rule, it shall, upon motion of the Commonwealth, condition its order by requiring that:
(1) The accused shall permit the Commonwealth within a reasonable time but not less than ten (10) days before trial or sentencing, as the case may be, to inspect, copy or photograph any written reports of autopsy examinations, ballistic tests, fingerprint, blood, urine and breath analyses, and other scientific tests that may be within the accused's possession, custody or control and which the defense intends to proffer or introduce into evidence at trial or sentencing.
(2) The accused disclose whether he intends to introduce evidence to establish an alibi and, if so, that the accused disclose the place at which he claims to have been at the time of the commission of the alleged offense.
(3) If the accused intends to rely upon the defense of insanity or feeblemindedness, the accused shall permit the Commonwealth to inspect, copy or photograph any written reports of physical or mental examination of the accused made in connection with the particular case, provided, however, that no statement made by the accused in the course of an examination provided for by this Rule shall be used by the Commonwealth in its case-in-chief, whether the examination shall be with or without the consent of the accused.
(d) Time of Motion. A motion by the accused under this Rule must be made at least 10 days before the day fixed for trial. The motion shall include all relief sought under this Rule. A subsequent motion may be made only upon a showing of cause why such motion would be in the interest of justice.
(e) Time, Place and Manner of Discovery and Inspection. An order granting relief under this Rule shall specify the time, place and manner of making the discovery and inspection permitted and may prescribe such terms and conditions as are just.
(f) Protective Order. Upon a sufficient showing the court may at any time order that the discovery or inspection be denied, restricted or deferred, or make such other order as is appropriate. Upon motion by the Commonwealth the court may permit the Commonwealth to make such showing, in whole or in part, in the form of a written statement to be inspected by the court in camera. If the court denies discovery or inspection following a showing in camera, the entire text of the Commonwealth's statement shall be sealed and preserved in the records of the court to be made available to the appellate court in the event of an appeal by the accused.
(g) Continuing Duty to Disclose; Failure to Comply. If, after disposition of a motion filed under this Rule, and before or during trial, counsel or a party discovers additional material previously requested or falling within the scope of an order previously entered, that is subject to discovery or inspection under this Rule, he shall promptly notify the other party or his counsel or the court of the existence of the additional material. If at any time during the course of the proceedings, it is brought to the attention of the court that a party has failed to comply with this Rule or with an order issued pursuant to this Rule, the court shall order such party to permit the discovery or inspection of materials not previously disclosed, and may grant such other relief as it may deem appropriate.
§ 19.2-265.4. Failure to provide discovery.

A. In any criminal prosecution for a felony in a circuit court or for a misdemeanor brought on direct indictment, the attorney for the Commonwealth shall have a duty to adequately and fully provide discovery as provided under Rule 3A:11 of the Rules of the Supreme Court. Rule 3A:11 shall be construed to apply to such felony and misdemeanor prosecutions. This duty to disclose shall be continuing and shall apply to any additional evidence or material discovered by the Commonwealth prior to or during trial which is subject to discovery or inspection and has been previously requested by the accused. In any criminal prosecution for a misdemeanor by trial de novo in circuit court, the attorney for the Commonwealth shall have a duty to adequately and fully provide discovery as provided under Rule 7C:5 of the Rules of the Supreme Court.

B. If at any time during the course of the proceedings it is brought to the attention of the court that the attorney for the Commonwealth has failed to comply with this section, the court may order the Commonwealth to permit the discovery or inspection, grant a continuance, or prohibit the Commonwealth from introducing evidence not disclosed, or the court may enter such other order as it deems just under the circumstances.

I listened to good old Coy several weeks ago on his radio show at which time he claimed to be great friends with Longo. Then he bragged for about an hour and never revealed what he claimed to reveal that day. My opinion of him is that he is a sensationalist blowhard. He spent several minutes of the air time blubbering. I will believe that he and Longo are BFF's when I hear Longo say so. JMO
 
Read the rest of the property information. It includes the maintenance shed and it appears to be a part of the park and has two different addresses (may be scrivener error). One is 3750 and the other is 3760 Walnut Creek Park (not Walnut Creek Road).

The name of the road on which that 106 parcel of land sits is called: Walnut Creek Park. That's exactly how it is named on all the maps, so that road is listed in the address of that 106 acre parcel of land that belongs to the County Finance dept.
 
Well I certainly hope that's not the case, but it is definitely a weird statement. It could be exactly that, they are waiting for something in the autopsy that casts a reasonable doubt for JM. :facepalm:

It is so interesting how we each can interpret things so differently. I heard it as, "oh, crap, they found the body and my client is in deep doo-doo. I'm not going to comment until I have to."

Most people wouldnt.

Most of this likely occurred between 2am and sunrise. A time when every day, honest, law abiding citizens are usually fast asleep.

Even people who live in rural areas arent usually awakened by the sound of a car passing by.

If I lived in the area and thought this guy could be a serial killer, I'd do my part to make sure he had a fair trial and get convicted and off the streets. Everything this woman said is just her being a good, responsible citizen and following what LE asked her to do. It confims nothing.

Exactly. Coy Barefoot quoted the conversation, and stated that a property she owns is the crime scene. Perhaps it's true. We'll find out in the next few days, I suppose.

It is 3193. Owner died three years ago. My guess is she is the woman that died inthe car accident.

That doesn't help much because Ammonett Branch Creek is West of the park, but the search is NW of the park.

I become highly irritated when a "professional" undermines an investigation, especially when that "professional" has no specific or personal knowledge of a case. In my field, no "professional" would dare to speculate unless they were able to directly examine the evidence themselves. This guy has NO credibility in my book.

I am not saying he is right but I find the whole process too short for the condition of the body. Virginia is hot right now just like here.. but decomp doesn't happen that fast to where there is only bones and pants. That sounds like someone that has been deceased for three months. We should know Tuesday.. but I would question the rapid decomp. We have had a lot rain.. but I think this place a dumping ground and it's being treated that way. ( fine tooth)
 
Info I am marking on the map based on the daily news interview with the supposed neighbor of supposed property where skeletal remains may have been found which would match Coy's article.

Yes, that's just what I said. The address is Walnut Creek Park. I believe you have previously referred to it as Walnut Creek Road. I don't believe there is a Walnut Creek Road. There is a Walnut Creek Lane. But I disagree that this area is not part and parcel of Walnut Creek Park. it certainly appears to be. Why would the Park's maintenance shed be located on property that is not part of the park?

Sorry to take so long in answering: Go to MVAH FB page at the top between the facebook "F" logo and your persoanal icon there is the search bar with the page name MVAH. Put your cursor in the white rectangle and click on the name bar. A drop down menu will appear. Then choose "People who like this page" there are only 6 likes (earlier today there were 5)
You can also choose "Friends of people who like MVAH". I just found a very curious connection beyond the massage connection. A family member of one of the missing girls is friends to one of the 6 members who liked the MVAH FB page. It is not a family member who liked the page but a friend of the mother of one of the missing girls.

Should this loose link to the family member of one of the missing girls and that property be reported to the Tip line?
 
It's not ... at least not in the information I've looked at. It looks like it was a gift ... total value of $1.1 million.

Interesting.. I was just wondering if Mr. Bass of Anchorage Farm (where MH was found < 5 miles away) was a member of the COUNTY OF ALBEMARLE BOARD OF SUPERVISORS. Or if he had ties to this property as well? Its also interesting to me that both remains were just "skull and bones" as reported by the news agencies. Someone posted something about the locations being triangular, I have not seen the map on this. Thinking out loud.

I've drawn in a bike trail that runs behind the maintenance building. Also note that the trail runs on a hill top behind the maintenance shed (yellow square). There is no dry creekbed in that area. The nearest creek is about half a mile away. That trail gets a lot of traffic. There is no dry creek bed there; the nearest creek is several hundred yards away, and I don't recall ever seeing it totally dry. I doubt it would be now since we've had a lot of rain here late in the last week. That little grassy field by the maintenance shed might just be a convenient parking area. Old Lynchburg is a narrow road often without shoulders - I know because I cycle on it frequently; there wouldn't be much room for parking large vehicles and trailers.

Someone asked earlier what the creek beds are like. Generally, they are fairly muddy and may have exposed hard clay. The bottoms usually have some sand and gravel and a few large rocks. They usually aren't the pretty river rock and washed pebble mountain streams you see in the steeper terrain of the mountains.
