Livesay named lead prosecutor in Heather Elvis case, trial possible by wintertime

A new attorney is taking over the legal reins in the trial of Sidney and Tammy Moorer.

Jimmy Richardson, solicitor for the 15th Judicial Circuit, confirmed Monday that assistant solicitor Nancy Livesay is now the lead prosecutor in the Moorer murder trial.

Richardson said the transfer took place about two weeks ago.

Livesay takes over for senior assistant solicitor Donna Elder, who’s been handling the case since the Moorers were charged in February in connection with the disappearance of Heather Elvis.

DNA testing has been completed on human remains recently found in Florida that attracted the attention of Horry County police investigating the disappearance of Heather Elvis, according to a Florida law enforcement agency. But the findings are creating more questions than answers since the remains still have not been positively identified

In Florida, autopsy results are considered public information, but Davidson cited an exemption in that state's law that he said allows law enforcement agencies to not release autopsy findings during active criminal investigations. "We won’t be releasing any additional records while the investigation is still ongoing," Davidson said via email. "Sorry, wish I had something more for you, but there just isn’t anything new that we can release at this time."

The report did describe body conditions as "not recognizable" and as a "near complete or complete skeleton." The body was wrapped in a pink bath robe, curtains and a homemade Mickey Mouse print bed sheet, the NamUS report continued. A Volusia County Sheriff's Office incident report said a man walking just outside the city limits of DeLand, Fla. found the remains in a trash bag.

County officials hope to have surveillance cameras installed at some of the public boat landings within 30 days. Recently, local officials announced that the county had received state funds from Rep. Kevin Hardee, R-Loris, and Heather Ammons Crawford, R-Socastee, to install surveillance cameras at six public boat landings. The sites to receive cameras include the Chris Anderson Landing, Red Bluff Landing, the S.C. 22/U.S. 17 Interchange Landing, Reeves Ferry Landing, Enterprise Landing and Peachtree Landing.

Tammy Moorer's attorney is asking a judge to speed up her murder trial in the Heather Elvis case, saying increased scrutiny of his client could have a detrimental effect on her defense.

Myrtle Beach attorney Greg McCollum filed a motion for speedy trial Friday afternoon asking the court to set a date for the trial.

“Based on the aforementioned authorities and given the prejudicial effects that Defendant may encounter considering the increased media surrounding Defendant’s case, Defendant hereby invokes all of her speedy trial rights as guaranteed by both the United States and South Carolina Constitutions,” the motion states.

“Such request is made in an effort to avoid these negative effects. Therefore, Defendant that this Court set Defendant’s case for trial.”

Moorer, 42, is charged with murder, kidnapping, obstruction of justice and two counts of indecent exposure in connection with the disappearance of Heather Elvis, 20, of Carolina Forest.

Motion for speedy trial filed in Heather Elvis case

The Myrtle Beach attorneys for a woman charged with murder and kidnapping in 20-year-old Heather Elvis’ disappearance have requested she be granted a speedy jury trial because of increased media interest.

Attorneys for Tammy Caison Moorer filed the motion for a speedy trial Friday with Circuit Court Judge Steven John, according to the filing. The motion seeks to have a hearing before the judge within 10 days so attorneys can petition for the jury trial.

Speedy trial request filed in Heather Elvis' murder case

The attorney for the woman charged in connection with the death of Heather Elvis filed a motion in court Sept. 19 asking for a speedy trial.

According to court documents, Tammy Caison Moorer's attorney, Greg McCollum, asked the court to consider the motion because of the amount of media attention the case has garnered.

"Such a request is made in an effort to avoid these negative effects," according to the motion.
 
Hi guys. Newbie here so if I break any rules please let me know. Any thoughts on this motion that the prosecution filing a motion to have a new motion sealed and kept from the public? I found it off that TM's name is on this document, and SM's is not. Does that make it possible that perhaps SM has cut a deal? Whatever it is they want sealed must be detramental to their case IMO... Like I said, sorry if I broke any rules... Brand New Newbie :)
