The way I read it, they want expedited transcripts for the TES witness they just deposed.

The jail visits is just a standard JAC Motion (and we know it is needed with this bunch ;)), the Judge has to approve before they pay and they will only pay standard rate.

Don't they need an official transcript if they won't to use it during a hearing? My bet is they want to quote from it during the upcoming hearing in March about their 'Agents of the State' Motion.

Yes, I was very tired when I posted. The problem with this requests is that the defense already had this depo transcribed and filed with the court before they filed this motion for expeditious copy without any justification or a date for that matter.

Once again, making up their own rules as they go along. It's :maddening:!!

The JAC established rates for experts in the Ninth Judicial Circuit are as follows:

Notes pertaining to all services:
Expenses up to $500 may be incurred without prior approval.
Expenses in any category over $500 or in excess of the ISC rates
require prior written approval by the judge before exceeding
the $500 cap.

Out-of-Court Services (includes initial review of records, testing,
writing reports, depositions and other services.)
First hour or less: $131.00
Per quarter hour thereafter: $32.75

In-court Testimony:
First hour or less: $158.00
Per quarter hour thereafter: $39.50

Waiting to Testify:
At-court appearance per hour: $79.00
At deposition per hour $65.50

Travel Time:
Per hour: $65.50

Caps per Case for Experts Established ISC services:
Capital Cases: maximum hours: 20
First degree felony cases: maximum hours: 15
Second degree felony cases: maximum hours: 10
Third degree felony cases: maximum hours: 5
Misdemeanor, traffic ,juvenile :maximum hours: 5

JAC objects to any rates in excess of the established ISC rates.

Wow, if that is true, that is why his experts won't return his calls...it is not good if all the money goes through Baez first. No wonder that court reporting company made a complaint...

Are you sure on that? I could have sworn that while the lawyer submits the invoices and receipts and paperwork to the JAC, unless they lay out funds themselves the JAC pays the vendor or servicer directly in order to avoid shenanigans.

So fo example JL submits hi sbill to JB, JB then squares it (hah!) with approved funding and submits it to the JAC along with any documentation showing it was a legitimate and approved expense. The JAC then pays JL directly.

Baez always seems to have issues with everything and anything "defense expert witness" related.

How can HHJP say no? Or can he force the expert witnesses to show up, or not be allowed to testify?

Thinking about the Motion to Approve $$ for the video conferencing, do you think he should have listed the charges and asked for an order to approve a certain amount per hour? I know I am asking a lot of him, but won't the judge just say, find out how much and come back, then I'll approve? I guess what I'm trying to say is he should submit what each expert will cost and then the judge can ok it?
Or, does he want the court to set a fee, then he will go back to each and see if they will accept it? Then, if they won't, he'll have to come back for more? Isn't there an easier way to do this?
 
Wouldn't they have to set up equipment in the offices of the experts, as well as the courtroom? I would think the availability of such equipment would depend on where the experts are. What a strange request for hearings that are so upcoming!

So long as the experts have SKYPE (free program) I don't see why they'd need video conferencing on the experts side?

Why does the defense always make things so difficult? Are they that frightened?:waitasec:

I bet the experts are technically challenged, and they all require professional assistance. March 2nd and 3rd is looking mighty grim at this point.
