Roger Bentley's trial for murder and kidnapping will start now on June 27th. And both sides may have settled some pre-trial "disagreements..."

Bentley has requested a "speedy" trial date, one that falls within 90 days of his arrest. And his attorney asked for a hearing to "speed up" getting copies of prosecution evidence to study. But both sides told the judge that problem was being resolved...

A Linn County judge will decide next week whether a videotaped interview with Jetseta Gage, a 10-year-old Cedar Rapids girl slain in March, can be used as evidence in a Vinton man's trial on sex abuse charges.

An attorney for James Howard Bentley, 33, argued in a brief that use of the tape should be barred because it violates Bentley's Sixth Amendment right to cross-examine his accuser...

Jetseta told interviewer Roseanne Matuszek that James Bentley would play "sex" with her, describing in detail the activities, according to Thompson's brief...

Senate leaders say they made the change to House File 619 because mandatory monitoring could be costly and greater flexibility should be given to the state corrections department.

An early fiscal analysis by the nonpartisan Legislative Service Agency estimated the cost of mandatory monitoring to be about $2 million a year.

Under the House bill, electronic monitoring would be required of anyone registered as a sex offender and released from prison on conditional release.

Rep. Kraig Paulsen, a Republican from Hiawatha, said he will propose to change the bill back to mandatory monitoring - though in limited scope - and return the legislation to the Senate.

That could happen as early as today, leaders said...

... Under Iowa Law, prosecutors must prove that a forcible felony occurred during the killing in order to support a first-degree murder charge.

In court papers filed Thursday, Johnson County Attorney J. Patrick White listed six forcible felonies he said Bentley committed while he killed the girl.

They include one count of first-degree sex abuse and two counts of second-degree sex abuse because of the serious injuries, Gage’s age and the risk of death and injury she faced in the alleged assaults, White said.

Bentley also committed kidnapping and two counts of child endangerment because his actions resulted in serious injury and Gage’s death, the court filing said...

Trial for a convicted sex offender charged in the abduction and slaying of a 10-year-old Cedar Rapids girl has been scheduled for November 28th.

Roger Bentley is charged with first-degree murder and kidnapping in the death of Jetseta Gage.

A Johnson County judge agreed last week to move the trial to Scott County, but lawyers for Bentley say they want the trial moved across the state to Pottawattamie County.

James Bentley is accused of molesting Jetseta Gage before her disappearance. He is challenging the pros. intention to use her taped statement in the case against him on the grounds that it " infringe on Bentley's constitutional right to confront his accuser".

His bro. Roger is due to go to trial Nov. 28th for kidnapping and killing her.

James Bentley, 33, of Vinton, is accused of sexually abusing Jetseta Gage in Cedar Rapids for nearly three years and in his Vinton home last fall.

Bentley, who briefly dated the girl's mother, Trena Gage, faces second-degree sexual abuse charges in Linn and Benton counties.

The trial is set for Oct. 3 but it will likely be rescheduled.

Bentley's older brother, Roger Paul Bentley, 38, of Brandon, is charged with first-degree murder and first-degree kidnapping in the child's death in March. Her body was found in a rundown mobile home in rural Johnson County.

His trial was moved to Davenport because of extensive publicity about the case in the Cedar Rapids-Iowa City area. The trial is scheduled for Nov 28.

However, his attorney wants the trial moved to Council Bluffs. A hearing on that request is set for Oct. 4 in Johnson County District Court.

Trial for a man charged with sexually abusing Jetseta Gage has been delayed until Jan. 9.

James Bentley, 33, is charged with second-degree sexual abuse. He is accused of sexually abusing the 10-year-old Cedar Rapids girl over a three-year period.

He is charged in both Benton and Linn counties.

His trial in Benton County was scheduled to start Nov. 7, but his lawyer asked for a delay.
