Pre-sentence Investigation

Under Idaho Criminal Rules, a full PSI must include:
  • Prior criminal record
  • Social history, family relationships, marital status, age, interests, activities
  • Educational background
  • Employment background, present employment
  • Residence history
  • Financial status
  • Health status
  • Sense of values and “outlook on life”
  • Results of any substance abuse evaluation, mental health evaluation, domestic assault evaluation and or psychosexual evaluation
  • The presentence investigator’s analysis of the defendant’s condition, which would be a complete summary of the psychological factors surrounding the commission of the crime. The analysis would also include a recommendation about any type of rehabilitation
The defense is able to use information from the pre-sentence analysis to show a judge that Vallow deserves a lesser sentence. Former Ada County Chief Deputy Prosecutor Jean Fisher said that she believes a judge will absolutely take Vallow's mental health into consideration when sentenced.

When the victim impact statements and arguments have concluded, Judge Boyce will ask Vallow if she would like to make a statement. Once she finishes her statement or declines to speak, the judge can then issue his own statement and sentence Vallow to her term in prison.

"People who have a mental illness, if that's indeed what she has... It continues to make her a greater threat if she were to be out in the community because she can't control her behavior, or is so fixated on what it is that she believes religiously, that she cannot be trusted... And I think that the judge is going to think about that very seriously," Fisher said.

She also stated that the judge can take into consideration what the family members want, the impact of the murders on those family members, the ages of the children, the particularly heinous way they were murdered and buried (like garbage).

Ultimately, the decision on the punishment is up to Judge Boyce, but Fisher says it's unlikely Vallow will get anything less than a fixed life sentence.

In Idaho LWOP is called a fixed life sentence.

7/25/23 Update: Daybell’s defense attorneys do not believe Tammy Daybell’s aunt has a right to speak during Lori’s sentencing hearing next week. Vicki Hoban, Tammy Daybell’s aunt, filed a request in June asking Judge Steven Boyce for permission to give a victim impact statement during the sentencing. Boyce initially denied the request saying Idaho law only recognizes “immediate” family members as victims & an aunt does not fit that definition. A presentence report filed Friday shows victim impact statements were submitted by Tammy Daybell’s sister, Samantha Gwilliam, and her father, Ron Douglas, according to a motion filed by Jim Archibald and John Thomas, Lori Daybell’s attorneys. Because of that, they argue Hoban should not speak. “With Tammy’s sister and father submitting letters to the court, it is no longer necessary for the court to designate a family representative for Tammy’s mother. An aunt is not listed as a victim under Idaho law; therefore, the court should not receive comments from Vicki Hoban as a victim,” Archibald wrote. A hearing on the issue will be held via Zoom on Wednesday, 7/26/23 at 9:30am.
7/26/23 Update: Judge Boyce denied defense motion re Tammy’s aunt not to have the right to speak at Vallow’s sentencing. Next sentencing hearing on 7/31/23.
7/29/23 Update: During Vallow’s sentencing, four people are expected to give victim impact statements, or statements about how the crimes affected their family & their lives. Those who wanted to give impact statements at the sentencing had to submit a request – under Idaho law, the only people allowed to give victim impact statements during a sentencing have to be immediate family members of the murder victim(s). Vallow’s only surviving child, 27-year-old Colby Ryan, is expected to speak along with Summer Shiflet, who is Vallow’s sister. Kay Woodcock, the grandmother of JJ Vallow, is also expected to give a statement in court. Vallow was also convicted of conspiring to murder her husband Chad Daybell’s wife at the time, Tammy Daybell. Her aunt, Vicki Hoban, will likely give a victim impact statement at the time of sentencing.
*Chad Guy Daybell (53/now 54) – Final pretrial conference hearing on 2/22/24. Trial set to begin on 4/1/24 in Ada County.
*AZ – Charles Vallow (62) shot & killed on July 11, 2019 in Chandler, AZ. *Lori Norene Vallow (46/now 50) indicted (6/24/21) & served (6/29/21) & charged (10/2/19) with 1 count of conspiracy to commit 1st degree murder. Maricopa County
AZ – Brandon Boudreaux () attempted murder on Oct. 2, 2019 in Gilbert, AZ. *Lori Norene Vallow (46/now 50) indicted (2/24/22) (but not served yet) with 1 count of 1st degree premeditated murder (per court site) on Oct. 2, 2019 in Gilbert, AZ. Bond at $1M. Maricopa County

I agree, sadly I won't be able to stay up for live Verdict, will be 3am my time. I have a Tween on the Autism Spectrum/ADHD, he not coping with changes at the moment friend moved to inter state last week. I know there is a lot of up and down in his journey in life, I need to be bright eyed and bushy tailed and be calm for him, so I need sleep.
My thoughts are with JJ, Tylee, and Tammy friends and friends, it will be a very emotional day for them.
Hope is a speck of light that shines through the vast darkness, but many times, the light of hope changes to the light of comfort and love to guide us through the vast darkness of sorrow.
