What to glean from the blank spaces in Alex's timeline in the deaths of JJ and Tylee?
On September 8th, after the trip to Yellowstone:
- Alex's phone returned to Rexburg, ID at 8:37pm
- He/his phone was at Lori's apartment #175 until 9:35pm
- From 9:43-9:53pm, he's at the Maverick on Main Street, Rexburg, ID (4 minute drive/20 minute walk from #175)
- 9:54-10:43pm? (49 minutes)
- From 10:44-11:15pm, he's at #175 again
- 11:16-11:43pm? (27 minutes)
- At 11:44pm, he's at his apartment #107
On September 9th:
- 12am-12:44am at #107
- 12:45-2:41am? (1 hour 56 minutes)

On September 22nd:
- Alex was watching JJ elsewhere while MG, DW, and Lori were podcasting in #175 from 9pm-midnight.
- Alex brought JJ back to #175 sometime in the middle of that recording session (according to MG's court testimony).
- JJ was sleeping on Alex's shoulder and he put JJ to bed. He leaves.
On September 23rd:
- Between 8am-9am, DW and MG and Lori meet in the kitchen. This is when DW asks where JJ is and Lori gives that story of JJ crawling up the cabinets and tells DW that Alex had to pick him up again because of this behavior.
- 9:30am MG and DW leave Rexburg.
- 9:55am-10:12am Alex is in Chad's backyard, near the pond where JJ was buried.

Regarding JJ's death:
There is evidence of JJ being tightly bound with duct tape, or over-restrained, in the same sense that the word "overkill" is used in other cases. Someone wrapped duct tape around his wrists first, and then around his hands
over and over again, and then around his arms from elbow to elbow in several tight layers. Someone also put duct tape over his mouth and then covered his head with a white plastic garbage bag, and then wrapped that in duct tape in several layers from chin to forehead.
Until we know what has actually happened, we could argue that anything
could have happened. But if you're trying to identify the truth about who committed a crime and what that crime was, you're going to take the facts and the evidence and apply them to the various theories that are out there. You could say for instance that JJ was poisoned or drugged, but the one thing we know for sure is that there is no evidence of that in the official testimony or documents.
We can't rule other theories out all together, for instance, poison or drugging. But you can give it lower priority. There is duct tape and a white bag around a child's face, covering the mouth, nose, and eyes.
That is evidence of JJ being bound and suffocated.
The question to answer is: who did it and when?
JJ's death seems to have been committed by a woman who was vindictive and resentful and who ultimately lost all self-control. Alex was a big guy and didn't need to restrain JJ with layers of duct tape to gain control of him. Kids fight back violently when they're being suffocated, research shows. One of the Cox siblings needed duct tape to restrain JJ in order to suffocate him, and one did not. I eliminate Alex from having a hand in JJ's death based on this method used. And I also eliminate him based on timing.
From the affidavit of probable cause, regarding September 22nd and 23rd:
September 9th is the only time Alex was at Lori's between midnight and 6am. So on the 22nd, if JJ was truly sleeping on Alex's shoulder (and he was
not covered in duct tape and a garbage bag), and Alex didn't return to Lori's that night, then Lori killed JJ with duct tape and a garbage bag.
The only other alternative scenario:
Alex could have picked JJ up after 6am but before 8am (when MG and DW woke up) and murdered him on the morning of the 23rd. Then drove to Chad's to bury him.

CHAPTER 40 HOMICIDE
18-4003.
DEGREES OF MURDER.
(a) All murder which is perpetrated by means of poison, or lying in wait, or torture, when torture is inflicted with the intent to cause suffering, to execute vengeance, to extort something from the victim, or to satisfy some sadistic inclination, or which is perpetrated by any kind of willful, deliberate and premeditated killing is murder of the first degree.
(b) Any murder of any peace officer, executive officer, officer of the court, fireman, judicial officer or prosecuting attorney who was acting in the lawful discharge of an official duty, and was known or should have been known by the perpetrator of the murder to be an officer so acting, shall be murder of the first degree.
(c) Any murder committed by a person under a sentence for murder of the first or second degree, including such persons on parole or probation from such sentence, shall be murder of the first degree.
(d) Any murder committed in the perpetration of, or attempt to perpetrate, aggravated battery on a child under twelve (12) years of age, arson, rape, robbery, burglary, kidnapping or mayhem, or an act of terrorism, as defined in section 18-8102, Idaho Code, or the use of a weapon of mass destruction, biological weapon or chemical weapon, is murder of the first degree.
(e) Any murder committed by a person incarcerated in a penal institution upon a person employed by the penal institution, another inmate of the penal institution or a visitor to the penal institution shall be murder of the first degree.
(f) Any murder committed by a person while escaping or attempting to escape from a penal institution is murder of the first degree.
(g) All other kinds of murder are of the second degree.
