This witness is wearing an orange jail jumpsuit, and has been locked up since late August for defying a prosecution subpoena dating back to May. The witness at a court hearing tossed away a subpoena handed to him, and has said he wouldn't cooperate.

Three other witnesses, kids who were then in their teens, who were also hanging out in Dawes Park the day of the shooting, also were jailed ahead of the trial. This guy, who testified that he has joined a gang in the years since the shooting, had by far been the most defiant.

Today, he's been cooperative, speaking clearly, giving "yes sir" and "no sir" to questions from ASA Tom Darman. There was some quibbling before he took the stand about a conversation he had with Darman, in which the witness asked if he would be released from jail if he testified

The other three witnesses were jailed for weeks— including a college student who was arrested on a warrant in this case and hauled out of his dorm room— and only got out within the past few days after attorneys challenged the no-bond holds.

So far, he's testified to descriptions of the three people he saw in the park the day of the shooting, black men in their 20s, and their vehicle. He was within a few feet of them, chatted a little and played basketball with them.

He testified these older guys asked to join their game, and asked who of the younger guys was best at basketball, who got the most girls. He also noticed one of them had a gun tucked into a pouch on his sweatshirt

This witness, however, did not see Tyshawn enter the alley where he was shot, and fled the park after hearing gunshots. He talked to police the next day, as officers canvassed the neighborhood.

Corey Morgan's lawyer, Tom Breen, opens cross-examination asking about the witnesses juvenile criminal history-- he was arrested with a gun and put on probation sometime after the shooting.

And, Breen notes he discussed reward money offered for tips in Tyshawn's case. When this guy talked to cops the day after the shooting, the reward money was at $12k, and $50k by the time he made his IDs. Witness said he asked about it, didn't know the dollar amounts

Breen has gotten witness to say that he couldn't see into a playground at the park, because his view was blocked by a field house, which contradicts some of his grand jury testimony from 2015.

"Chicago gangbangers allegedly executed a 9-year-old schoolboy because they blamed his dad’s rival gang for shooting some of their family members, according to prosecutors....

“Tyshawn brought a basketball to Dawes Park. Corey Morgan, Dwright Doty and Kevin Edwards brought guns,” Cook County Assistant State’s Attorney Margaret Hillmann told the court, naming the accused killers....

Morgan’s attorney, Thomas Breen, used his opening remarks to try to distance his client from the crime.

“That execution of that 9-year-old boy has to come from one singularly evil person,” Breen told jurors. “His killer did so of his own volition and for his own reason. Not at the behest or help of Corey Morgan.”

However, prosecutors claim it was revenge for an attack weeks earlier that killed Morgan’s brother and wounded his mother — allegedly by the boy’s dad’s gang, the Killa Ward faction of the Gangster Disciples...."

I wonder if people fear gang members will attend and notice who is there to support Tyshawn's family, and maybe even fear gang violence since we know at least one family member was a member of a rival gang.

I’m assuming it’s out of fear. The violence surrounding the gang culture in Chicago is out of control. jmo

First witness is another Ralph Ellison High student who was in Dawes Park the day Tyshawn was shot. This witness noticed one of the defendants— not sure whom yet— because she thought he was "attractive."

This witness also took note of the black SUV the defendants allegedly drove to the park, because there wa a rumor that the dean from Ellison was coming to the park, apparently to keep an eye on the students. She saw four people get out of the SUV intially, which is new.

Police canvassed the neighborhood around the park, and after about two weeks, went to Ellison and started pulling kids out of class to ask them if they'd seen anything, then had them look at photo arrays, and some, a physical lineup at 5th District HQ.

This witness left the park before the shooting, and didn't come forward until the cops came to her school two weeks later. It apparently didn't occur to her that the older guys she'd seen at the park that day might be suspects. "The things I saw, I knew they were odd..." she said

Morgan's lawyer points out some issues with the live lineup: the witness said she saw someone with long dredlocks in the park, but wasn't able to ID Morgan's mugshot 2 weeks after shooting. The next day, police did the lineup.

That lineup featured only 5 people— CPD regs require a minimum of 6— and only two (including Morgan) had dreds. Cops had showed her Morgan's mug the day before, but didn't say the same guy was to be in the lineup.

This young lady's body language showing she's tired of answering questions. We have a double jury, so she is questioned by prosecutors, then one jury is led out, and she gets crossed by one defendant's lawyer. Then they swap juries, and she's crossed by the other def lawyer.

Now on the stand: Shawn Walsh, former dean at Ralph Ellison HS. He heard what might have been gunshots from shooting. Tyshawn's death was a big topic at school, and students in the days after came to him to say they had been in nearby Dawes Park the day of the shooting.

The witnesses from Ellison HS who have testified were all between 14-15 years old at the time of the shooting (none older than 19 now). None saw shooting— prosecutors have no eyewitnesses— but each can place one or more of the defendants in the park the day of the shooting.

"...Nearly four years later, some of those students and other young bystanders took the witness stand this week to testify against two men on trial for Tyshawn’s killing...

The young witnesses were near the park that day and testified this week that they saw one or both men at the park on the afternoon of the shooting.

Though all are now 18 or older, many still seemed like kids on the witness stand, fidgeting, swiveling back and forth in the chair and answering questions in shy, quiet voices.

After a tense interplay between prosecutors and defense attorneys, 19-year-old Trinity Richardson left the stand Friday with a loud sigh, exclaiming, “Weird!”

Their testimony was more circumstantial than a slam dunk for prosecutors.

None of the witnesses said they viewed the actual attack on Tyshawn.

In the trial’s first week, only one witness so far has testified seeing anyone interact with Tyshawn at the park. And she did not identify the defendants in police photo arrays.

Another witness was the only one to identify photos of all three defendants.

But none of the witnesses was asked to identify either defendant sitting across the courtroom from them.

One witness identified Morgan in a photo array but not in a live lineup. Another picked out Morgan in one lineup but did not identify Doty in a different one. Still another said she saw a black SUV speed away from the alley after shots were fired and got a glimpse of the driver’s face. But she at first identified him as Edwards only tentatively, then said she was sure.

Prosecutors hope, though, that each of the six young witnesses provided a small piece of a puzzle that jurors will find convincing.

But the testimony left plenty for defense attorneys to criticize....

Edwards' brother, Davontay Gary, testifying that his brother was close friends with Corey Morgan and Dwright Doty, the two men on trial. They would often drive around in a black Ford Edge (which prosecutors allege was the getaway car)

On cross-examination by Morgan's attorney, Gary noting that he worked from noon to 8 at that time, so would have no idea of the SUV's whereabouts or who was riding in it during those times. (Tyshawn was killed in the midafternoon.)

It's science day at the Tyshawn Lee trial. There's a state police forensic expert on the stand now. Later we're expected to hear from a New Zealand scientist who helped develop software that analyzes complicated samples involving multiple DNA profiles.

Prosecutors used the "linking to" language deliberately. That evidence was brought out via the software analysis, not more traditional/established methods used for what you might consider a DNA "match."

should potentially note that officers who recovered the car noticed a smell of bleach inside, and an unidentified white powder all over. (the inference prosecutors want jurors to draw: the defendants deep-cleaned the car before abandoning it.)

There were forensic samples from the car - and Tyshawn's basketball - that were too complex for ISP's traditional analysis. So ISP turned to something new: STRmix, a software that purports to get more information from samples that include a mix of different DNA profiles.

This case was the first time ISP had used the "probabilistic genotyping" software. And, I still need to confirm this, but I believe it's also going to be the first time prosecutors have put such evidence on during trial.
