Just realized something: Libby may have provided evidence not just to identify her killer, but to convict him too.

If LE can prove RA is the person on the video, Libby recorded him kidnapping them. His statement forcing them off their walking trail down a hill to an isolated place is evidence of kidnapping. It's an admission.

To prove felony murder, the state has to prove the defendant committed an underlying felony and someone died in the commission of that felony. They do not have to prove the defendant physically killed the victim.

This case is horrific but I'm just blown away by these girls. They not only caught their killer but they're going to be the star witness convicting him too.

Amazing, you’re so right! It perfectly fits, she captured “criminal behaviour about to occur” just as LE predicted numerous times all along.

Libby German’s Heroic Actions May Help the Case​

German’s quick thinking in the face of fear prompted Indiana State Police Sgt. Tony Slocom to pronounce her a “hero.” That young lady is a hero, that is no doubt,” Slocom told reporters. “To have enough presence of mind to activate the video system on her cell phone to record what we believe is criminal behavior about to occur, there is no doubt in our mind that she is a hero.”

 
I've thought and thought about it. The only thing I can come up with is maybe they were in the shack/shed on RL's property. If there was a shed there. I swear there was one, but I'm having trouble remembering that as fact.
I remembering hearing about a shack too.
 
I find it strange that LE or somebody never mentioned him as a witness. I recall early on that witnesses' were basically listed and vaguely described. Plaid shirt guy, middle age woman, and a few calls for unknowns seen that day. I don't recall hearing about a local man fitting RAs description hiking that day and coming forward as a witness. I need to review as it's been so long.

I think it reads to some people like the whole section is repealed, but just that those 2 items are in or out. But I'm not a lawyer!

Each state determines which felonies it believes are serious enough to serve as an underlying crime for felony murder. Traditionally, it is supposed to be something so dangerous that anyone participating in it could reasonably foresee that someone could get killed (and so refrain from doing it). The list of felonies can change over time as the legislature sees new cases come up.

Here, it looks like in 2013 the list of felonies were adjusted to say going forward, after July 2014, carjacking and "criminal deviate conduct" are no longer included. 2013 Indiana Code :: TITLE 35. CRIMINAL LAW AND PROCEDURE :: ARTICLE 42. OFFENSES AGAINST THE PERSON :: CHAPTER 1. HOMICIDE

They have to keep the law as it is and just add (before repeal) because there is no statute of limitations for murder. So even in 2022, there could be a carjacking from 2010 that resulted in someone's death and if LE finally solves the case, the person could be charged under this statute because at the time the crime was committed, it was an included felony.

So no, the entire thing was not repealed. Two crimes were removed from the list of eligible included felonies for crimes committed after 7/2014.

I'm listening to Episode 11 of the Down the Hill podcast (HLN). They said the search of his property was done on Oct 13th. Items were taken from the home and it was also at this point that his car was towed away. Neighbors say for nearly two weeks he was still at his house and going about his daily life. <modsnip - off limits> Nobody has been seen at the house since he was taken into custody on Oct 26th.

I think maybe the bodies were not that unrecognizable, but seeing the deer first caused the searchers to take a minute to realize that the bodies were also in view?

Iirc that was FSG that he met on the trail.
 
Yes, from what I understand the girls noticed BG before they crossed the bridge and had mentioned it to family via text or phone call.
RA might have been known to Libby because he had made creepy sexual comments to her previously. Imo she was his *type*. I suspect from seeing the photo of his daughter on the bridge (who I think bears resemblance to Libby) that his wife looked similar when she was young. Very often there is a *type* involved in fantasies, both normal and deranged. Libby might have started the video because she was alarmed to be in a remote location with someone who was known to her to be a creeper.

Could she have had a lot of defensive wound to her hands/arms and her grandfather found this out from the people who found them ?
 
Been following since the beginning but haven’t posted. Everyone is so convinced that because scene was “bloody” that it had to be a knife….thinking outside the box here….head wounds bleed very very badly (coming from experience). He could have easily controlled them by incapacitating them by hitting them over the head with something. It could explain why there were no signs of a struggle. It could have also been a weapon that wasn’t brought with him, a decent sized limb could easily do the trick….or random debris like piece of an old metal fence post laying in the woods. A hit to the heads could cause a lot of blood, and incapacitate both pretty quickly. Just food for thought. MOO.

To have a trial date already, they are pretty certain he's there man. This is great!
 
Im jumping in here without any knowledge what has been discussed before.

The thing that is on my mind alot, he lived there all that time. Did not feel the need to move or even felt treathened enough to act on it, even after the sound bit and the sketches. Is it because he was that cocky about it? Or did he liked the closeness of this horrible crime. Did he felt comfortable because this was maybe not his first kill?

Just my thought process. Sorry for any grammar mistakes.
Classic narcissistic sociopath or malignant psychopath behavior. Yes cocky, arrogant, enjoy power over others and incredibly controlling of others and their own behavior. They will obsessively relive their crimes over and over in their minds and through tokens or trophies they have kept from their exploits. Many different crimes are considered victories in their minds, not just murder.

I am slightly perplexed by the charges... if he was the only one involved, I'd think that intentional killing under subsection 1 would be what he's charged with. I guess it might be possible that they feel it's just easier to get a conviction under (2) since kidnapping is a given; they don't have to prove intent/premeditation. It does leave the door open that there was someone else involved and RA/BG was responsible for the kidnapping portion, but not necessarily the murder itself. Not sure how that reconciles with public statements, though.
