I have to believe that the DA is going to be very sensitive to the family. I guess it would depend on how strong the case is, and as was noted, if they family even wants the death penalty.

I would not be surprised in the least if the family doesn't want to have this discussion in a trial, and have to analyze all of that in such detail.
Based on the comments we have heard, I highly doubt the family would want the Death Penalty IMO
 
Im going to try to say this as delicately and respectfully as possible. Forgive me.

Sperm can live inside a woman's body for up to 5 days. http://www.webmd.com/infertility-and-reproduction/guide/sperm-and-semen-faq#1. I think as adults, we can all agree it wouldn't be surprising, and likely expected, to find a woman's husband's sperm during a gynecological exam. Even if an assailant's DNA is also found, there is no way to prove which act caused the assault/damage and in this case, no way to prove beyond a reasonable doubt that either act was not consensual. It sickens me just typing that. So even if there is evidence of possible sexual assault, it could have occurred during either act and I don't think a prosecutor could prove which. So even though we all know Amanda didn't consent to anything with any of these three men, I can see why LE could be reluctant to charge them with SA. Just MOO.

I'm confused. If they did find dna other than her husband's, it's sexual assault, even if they can't prove any marks are from the SA. If DB was rough, or they were into something kinky, none of that matters if one of the assailant's dna is found. That's non consensual.

I'm leaning more towards more than one person's dna being found and they're still waiting for results. Even if it's DB and one perp or more than one perp's dna... It still needs to be sorted out before they can charge them.

I have no doubt a jury will understand who did the assault, imo - but the conversation of it all seems like punishment for the family.

But you could be right that they are waiting for results. either reason or both wouldn't surprise me as decisions on why they haven't made that charge.

Larry Taylor, 18, allegedly gave his accomplices a blow-by-blow of how he killed Amanda Blackburn, 28, during the Nov. 10 burglary, according to a probable cause affidavit that cited a cooperating witness.

**** meaning someone gave this account of what taylor told them , not via taylor's own confession to law enforcement.


"Taylor stated that she charged at him and he shot her somewhere in the upper body so he would not be scratched," the affidavit says.

"Taylor then told them that he leaned over her body and shot her in the back of the head. He leaned further, looked at her face, and watched her bleed."

A third burglary suspect, Diano Gordon, 24, was held on a parole violation but has not been charged in the slaying, apparently because he did not enter the Blackburn home.


 
So Jalen's sister was lying like a rug when she said he was sleeping on her couch and didn't leave until 10:00 a.m. Yeah right! Will she be charged with something?

It's possible she could still be telling the truth - could he have snuck back in at home by 8 - and she wouldn't have seen him until she got up herself, which might have been minutes before 10 a.m.?

ya know, both are plausible. But I think we all know what is most plausible.
 
Diano Gordon doesn't look like he has normal intelligence - I wonder if he actually tests below the normal level?

He looks like an abused/neglected kid.

My guess is, all three of them were abused and neglected as kids. There aren't many men in prison who had loving, nurturing, stable and supportive households. Some. He has a completely dull expression, to me - but if it's true he actually has lower than average intelligence I'm sure that will be revealed in the investigation. People with low intelligence are often on the periphery of crimes, because they make easy patsys for the leaders, and lack discernment.
 
I think you may be misunderstanding what "reasonable doubt" means. It doesn't mean "to a scientific certainty". Yes, if you have an imaginative mind and enjoy brain teasers, yes, you could say well it COULD be that the intruders didn't rape her at all - it COULD be that her husband had raped her, and when these three young men broke into her home to kill her and rob her she willingly consented to sex with them.

It's beyond a reasonable doubt, if they prove their DNA was inside her, that she was sexually assaulted and did not consent.

I do hope you're right.

The death penalty would be too easy for this scum.

6:40 a.m. – A resident on Sunnyfield Court hears two gunshots and what sounds like a woman scream.
6:54 a.m. – A $400 withdrawal is made on Amanda Blackburn's Chase debit card at an ATM on the 1300 block of 86th Street.
7:05 a.m. – Resident on 2900 block of Sunnyfield Court sees a black male wearing all black walking north with a T-shirt pulled up over his face.
7:10 a.m. – Resident on 2800 block of Sunmeadow Way sees "like white late model Chrysler Sebring" pull up and a black male wearing a hoody get inside.
7:53 a.m. – Amanda Blackburn's phone receives a voicemail alert from Chase bank warning of suspicious activity on her debit card.
8:17 a.m. – A resident on the 2800 block of Sunnyfield Court calls 911 to report a burglary at her home. Four televisions and a MacBook Pro were stolen, along with a bag of oranges. The suspects also "drank beer and wine and left the bottles in the home."
8:22 a.m. – Davey Blackburn calls 911, reporting he's found his wife injured and unconscious on the living room floor of their home on Sunnyfield Court.
