Good grief, that poor woman. I sure hope none of these three ever get out of prison. I don't see how a jury would have any sympathy for any or them. I don't care how old they are or were when they started getting into trouble. They were into big trouble things, drugs, guns, assaulting people and now murder. This whole thing just pisses me off!!! Competency hearings WTF are you kidding me...

Owen found competent for murder trial

GOSHEN — An Elkhart man has been found competent to stand trial for the murder of a woman in October.

Donald Owen Jr., 20, is accused of killing Kimberly Dyer in Elkhart on Oct. 21. He and 19-year-old Mario Angulo Jr. are believed to have tortured the 31-year-old Columbia City woman in some way during the robbery and confinement incident.

On Thursday, Owen appeared in court for a discussion of the evaluations filed by two psychiatrists in mid-March and early April. Based on the reports the court received, Circuit Court Judge Michael Christofeno said Owen was deemed competent.

Owen confirmed his jury trial date of June 15, though it’s not guaranteed that his case will go to trial then.

GOSHEN — Frustrated with feeling left in the dark, an Elkhart man signaled he’d rather go it alone and defend himself while charged with murdering a Columbia City woman last year.

Donald Owen Jr., 21, voiced several complaints during a hearing in his case Thursday in Elkhart County Circuit Court.

The hearing was initially set to check attorney responses to the results of mental health evaluations last month that found Owen was competent to stand trial. Both the prosecution and Owen’s attorney said they didn’t need to set another hearing to discuss the issue further.

Owen’s trial is scheduled to begin June 15, but chief public defender Peter Todd indicated the defense case might not be ready by then. Todd, who’s serving as co-counsel in the case, didn’t ask to reschedule the trial.

Deputy prosecuting attorney Katelyn Doyle added the prosecutor’s office plans to join Owen’s case with Angulo’s. She suggested pushing Owen’s trial back to align with the Oct. 5 date for Angulo’s trial.

So, while that could create logistical challenges for trials into the summer, Christofeno said he also anticipates Angulo’s trial could be moved up — Angulo’s attorney had pushed for an earlier date.

Owen, meanwhile, argued he felt ignored in the court system before the COVID-19 outbreak. Frustrated by what he saw as a slow pace, he said he’d rather represent himself at trial and wanted to dismiss the public defender’s office.

Christofeno cautioned him if he went solo, he’d be held to the same standards and procedures as trained, professional attorneys.

A final decision on Owen’s representation wasn’t stated during the hearing. And his trial remains set for June 15.


I have Owen's next hearing on 5/7.
 
While I've been caught up in the virus stuff, the trial is marching on. I wonder what this search warrant in the Owen case is about?

*Trial Status Conference Hearing (@ 8:30am CT) – IN – Kimberly Dyer (31) (occurred from Oct. 21 to Oct. 22, 2019, Elkhart) & Robert Porter (32) serious injuries (Oct. 21-22, 2019) – for *Donald R. Owen, Jr. (20/now 21) arrested & charged (12/19/19) with murder, robbery resulting in serious bodily injury, 2 counts of criminal confinement & life without parole enhancement. Held without bond.
Trial set to begin on 6/15/20. DA will seek life without parole.
12/19/19 Update: for all: motion to seal public records-granted. 12/23/19: for all: State’s motion to unseal public records-granted.
12/26/19 Update: Owen was found & arrested in Waco, TX. He is awaiting extradition in McLennan County jail in Indiana. No date yet for Owen. 1/6/20: DA will seek life without parole for all suspects. 1/21/20: Owen has initial appearance hearing on 1/23/20.
1/23/20 Update: Owen: appear in court today. Remains held on no bond due to murder charge. Important to note that all probable cause documents remain sealed in this case. Next Pretrial conference on 2/20. Status conference hearing on 5/7, and trial is set for 6/15/20. 01/30/20: Case 20D01-1804-F6-631 transferred in (to Circuit court). Hearing on 2/20.
2/4/20 Update: Defense Motion to Determine Competency and/or “As An Individual With Intellectual Disability” for hearing Feb. 20, 2020 at 8:30am with the pretrial hearing that is scheduled. NOTE: Dr. Parker is planning on doing the competency evaluation on Mar. 11 at the jail; Dr. Seltman will schedule an appointment in March as well. 2/25/20: Order Granting Motion for Competency Evaluation. For some reason, my notifications aren't working and I didn't realize there were any new posts here.

The Joinder of Defendants is interesting. I never heard of that before. I wonder if the defendants have a say in that decision.

Don't know IF they were indicted together, but they were all charged on 12/19/19. Don't know if that counts though.

Since I can't get into the court site - I can't tell you the indictment date - but you can! :)
 
I don't see anything regarding an indictment. Nothing about a grand jury. They sealed the Charging Papers. It's apparently beyond my realm of expertise. We need someone with more legal smarts than I have.

That search warrant shows up in all 3 cases so I wonder if the Joinder of Defendants hearing on May 21 has anything to do that that?

Yeah, same here - no legal smarts here either! :D And thanks for checking on that. Guess we shall find out on 5/21....
