CHARLOTTESVILLE — City prosecutors here have dropped an abduction charge against the man accused of killing University of Virginia sophomore Hannah Graham, a move that will allow more serious charges against him to move forward in neighboring Albemarle County.

Jesse Leroy Matthew Jr. appeared by way of video feed into Charlottesville General District Court on Thursday as a charge of abduction with intent to defile was dropped. He is being held for trial, which is scheduled for June.

Albemarle County Commonwealth’s Attorney Denise Lunsford initially did not seek a capital murder charge, saying she made that decision after consulting with Graham’s family and weighing the impact on the community.

On Tuesday, Lunsford said that new criminal analysis came back in late February. She said that there is “compelling evidence from the lab that capital charges are now appropriate.” She declined to comment about what that specific evidence is. “These are never easy decisions to make. If I didn’t believe it was worthy, we wouldn’t be standing here today.”

Did you guys catch that JLMs attorney was dismissed?

New attorneys were appointed to defend Matthew, as his previous lawyer does not have experience defending death penalty cases, which carry with them a high level of judicial and appellate scrutiny.
