Allyne, the thing that is a question for me is whether she said these things during the trial, after she had access to all the evidence to shape her story around. Or did she say these things in the interrogation tapes?

If in July 2008, then I agree she would have to be there to know those things. I am not through the unedited tapes yet to know the answer.

JA told Detective Flores the basic timeline that was borne out later. Getting there late at night, Travis on his computer when she got there. Exhausted from driving all night, heading up to bed. Sleeping in until about noon.

She told him about Travis cleaning, that he had the furniture up on the couch where she normally sat because he was cleaning the floors. She talked about him working in his office and then described how she had a bit of a hard time convincing him to do a photo shoot in the shower, that he was reluctant at first.

She was still clinging to the Ninja story then and was not yet represented by an attorney.

1. She has yet to start a court day on time.
2. She allows JW to openly challenge/argue/pout/stomp her foot to her rulings
3. She allows the DT to bring in testimony that have already been denied in
previous hearings
4. She has no control of her courtroom, i.e. Nurmi addresses her from behind
the table, kicked back in his pseudo lazy boy chair
5. She can't decide on either sustaining or overruling objections by the DT
without calling the attorneys to the sidebar for discussions WAY too often
6. She has allowed things into the trial such as the sex tape with Travis' words
attached with words capitalized which assigns an importance which is so
biased, she allowed RS to remain on the stand while the attorneys argued
over things such as him providing "therapy" to Jodi and then turns to him
to ask him
7. She has allowed experts to include material from sources such as Time
rather than scientific, peer reviewed material
8. She has allowed persons to testify as experts who lack the acceptable
standard qualifications
9. She allows the DT's disrespectful behavior of giggling, eye rolling and head
shaking toward the prosecutor
10. She allows the DT to take up time to discuss things that they could easily
address with her outside of court
11 She allows the DT to ask leading questions ALL the time.
12. She allows witness's to be disrespectful to the Prosecutor, argue with the
prosecutor and other behaviors that aren't appropriate for the courtroom

Thank you for breaking it down for me!!! I appreciate it. While I watch the trial, I really have to admit that I am somewhat clueless as to the role of the judge and whats allowed/not allowed... normal/not normal.

SP juror removed for talking to LP brother. In video interview he said he just mentioned getting in the way of camera's to LP's brother's camera shot. He told his girlfriend about talking to LP's brother. He thinks he was dismissed because he was a "distraction".

So juror #5 may have done/said something innocent but maybe it's a "distraction". ikd
 
I'd like to add that JSS has allowed Jodi to "sneak" papers in and out of folders at the defense table. I suspect that Jodi has been passing notes via the guards who are assigned to her. :moo:

I think the DT should just move their table smack up against the Judge's to save time on the sidebars. Wilmott should have a permanent bench there to prevent the carpet from being worn out.

She has also allowed an "expert witness" to "paraphrase" third party emails while the DT asks very leading questions.

I agree with most of your points. The only answer I've gotten is that since it's a death penalty case, the DT is being coddled and allowed them to get away with unprofessionalism, IMO.

Yes, yes. We're waiting anxiously for court to start today. Let's hope the Judge gets through all this misconduct carp over and done with quickly and we get on with the testimony. :please:

He just wants more money. He apparently hasn't sucked the Arizona tax payers dry enough yet.
 
In the filing of this motion, it's said that this info did come out during the questioning of the jurors on Thursday. If the judge thought it rose to the level of a mistrial or even to the level of removing the juror, wouldn't she have done something about it then, rather than wait 3 days for the defense to file this? I mean if it were that big of a deal, it seems to me that alarm bells would've been going off in her head and Tri-color would have been gone before the defense team had time to do this.

If tri colour is kicked off she is going to be pi$$ed. She has invested her time and energy into this case, has been taking notes diligently and now this! It's not good for anyone to have as part of one's background 'Dismissed from a high profile trial due to juror misconduct'!

I am assuming she didn't do anything wrong. Even if she did make remarks which imply she is pro-prosecution, who could blame the poor girl? I think she is one of those who will speak once the trial is over regardless of whether stays or not.

Damn the DT! (is one allowed to say that?) I am sick of them.

If she does get dismissed I hope she doesn't get pi**ed - and if she cares about this case she will know that getting dismissed is better than a Mistrial! :twocents::seeya:

Agree, if dismissed, I just hope she doesn't start talking to the media in some way that could actually cause a mistrial.

I heard that when you are being interrogated, there is always someone watching - especially if you are in the room alone. There were eyes (IMHO) behind the camera watching to see if she would say anything when she was alone...or just in case she did something stoopid.

The detective (IMHO) already knew she stashed the paper in her pants before entering the room.

It's a good interrogation tactic, too, to observe someone you arrested while alone. Folks give off body language, and are more apt to talk out loud. Jodi, on the other hand, gave them so much more to observe. I wonder if they were LOL when she stood on her head?

Thanks for confirming. This proves she was trying to steal the paper and is also what I saw on the interrogation video. This is totally amazing. Think about it. Here she is only a day or two in jail with serious murder charges hanging over her head, and she is already breaking rules.

Combine that with what we all saw her do in the courtroom with sitting on the pad and appeared to be trying to steal either the pen or pad itself.

This crazy girl is dangerous. She has no regard for rules. I am surprised she has not already broken some serios jailhouse rule that gets her thrown in the basement solitary.

ETA: Oh yeah, she also tried to smuggle out the hidden encrypted words in the magazines. We have got to start a list of the rules she has broken so far.
