Brian Walshe was active Monday in both the major criminal cases he's involved in — he had his first hearing in months in the murder case over the alleged killing of his wife, Ana, while his lawyer in federal court appealed a sentence recently handed down over art fraud.

At the status conference at Norfolk Superior Court in Dedham, Massachusetts, lawyers for the two sides established that Walshe's new, court-appointed lawyer still needs to catch up on the evidence in the murder case.

The next date in the case was set for May 1. Walshe's appearance was waived for Monday's hearing, and while he had been due to appear virtually, he wasn't on the Zoom call.

Unbelievable-- I can't believe it would be Attorney Tracy Miner appealing this federal (plea agreement) conviction unless he's trying to get out of the restitution he was ordered to pay. Mommy cutting him off? Trying to preserve assets remaining? MOO

The court session was brief because the case was continued until May 1 to allow Walshe’s new lawyer, public defender Larry Tipton, more time to get up to speed on evidence in the case based on a DNA sample that had to undergo “destructive testing” — meaning there was not enough of that sample for the prosecution and defense to conduct independent analyses.

The continuation will allow both sides an opportunity to come to an agreement on the destructive testing once Walshe’s attorney has had time to review the evidence.

“This is not in any way an unusual delay, particularly after a change of defense counsel,” Norfolk County District Attorney’s Office Spokesman David Traub told the Cohasset Anchor in response to an inquiry after the conference. “It’s just part of the relatively normal progress toward trial.”

What is happening with DNA testing in Brian Walshe murder case

Larry Tipton made his first appearance as defense attorney for Brian Walshe, charged with murder after the disappearance of his wife Ana.

Larry Tipton was appointed by Dedham Superior Court in December to defend Walshe in after Walshe's previous attorney, Tracy Miner, withdrew due to his inability to pay.

Until recently, Tipton had been occupied in the defense of Emanuel Lopes, the Brockton man convicted on Feb. 16 of shooting and killing Weymouth police Sgt. Michael Chesna and Weymouth resident Vera Adams. Lopes is scheduled to be sentenced on March 16.

During Monday's brief status hearing in Dedham, Norfolk County Assistant District Attorney Greg Connor, who also prosecuted the Lopes case, updated Judge Beverly Cannone on the status of DNA testing at the Bode crime labs in Virginia.

The name of his lawyer is missing from the federal notice of intent to appeal but he'd long been represented by Tracy Miner in the federal case -- she negotiated his plea agreement. Miner recently withdrew from the MA case due to his inability to pay.

Thanks. I'm glad mom is finally putting some financial distance between her and her son. Really odd that he is appealing his federal fraud case, maybe he's just bored.

Accused wife killer Brian Walshe appeals his federal art fraud conviction

Brian Walshe, the Cohasset man accused of killing and dismembering his wife Ana Walshe on the first day of last year, has appealed his unrelated federal art fraud conviction.

On Feb. 20, U.S. District Judge William G. Young sentenced Walshe to three years and a month in prison — which would run concurrent to any state-imposed sentence should Walshe be convicted in his upcoming murder trial. Walshe is in state custody in Norfolk County.

On Monday, Tracy Miner, Walshe’s attorney for the federal fraud case and former attorney for the murder case, filed a notice that Walshe was appealing his conviction to the First Circuit Court of Appeals, based in the same federal courthouse in Boston’s Seaport district.

Walshe (47/now 49) arrested (1/8/23), charged & arraigned (1/9/23) with intimidation/misleading police during the investigation into his wife's disappearance. Bond $5M Surety/$500K Cash. 3/4/24 Update: At the status conference at Norfolk Superior Court lawyers for the two sides established that Walshe's new, court-appointed lawyer public defender Larry Tipton, more time to get up to speed on evidence in the case based on a DNA sample that had to undergo “destructive testing” — meaning there was not enough of that sample for the prosecution & defense to conduct independent analyses. The continuation will allow both sides an opportunity to come to an agreement on the destructive testing once Walshe’s attorney has had time to review the evidence. The next date in the case was set for 5/1/24. Walshe's appearance was waived for Monday's hearing & while he had been due to appear virtually, he wasn't on the Zoom call. The hearing came less than two weeks after Walshe was sentenced by a federal judge for a years-long art fraud scheme that he pleaded guilty to before the alleged murder of his wife. On Feb. 20, U.S. District Judge William G. Young sentenced Walshe to three years & a month in prison — which would run concurrent to any state-imposed sentence should Walshe be convicted in his upcoming murder trial. This is what I have - and unfortunately no case # after it was transferred to Norfolk Superior Court
