Thanks Niner but both female witness have finished their testimony. One found in fridge and one in freezer. Both around nine inches long. No post mortem banding. Not uncommon to find hair in fridge.

CW should finish up by early Friday, then defense should start. Now going over ideas on jury instructions if 'lesser includeds' will be introduced. CW said maybe 'involuntary manslaughter', defense doesn't want to comment on that yet.

Involuntary but IMO he wants an acquittal maybe first, 2nd and nothing else because without much evidence it would be easier to get an acquittal on first or 2nd.

If he's acquitted does that mean the jury didn't buy the only witness testimony therefore voids and nulls that plea deal?

It's harder for a jury to convict to life in prison charges if they struggling with reasonable doubt but by DA throwing that involuntary manslaughter out there jury might be more apt to convict without much evidence.

That makes sense. No wonder the defence didn't agree. I don't think MM killed Bella but I do wonder if he knew she was dead and helped.

I've thought that too because if he killed her knowing she would testify he did it why wouldn't he take a plea deal unless he didn't do it.

It really surprises me that it's not the other way round. MM with the plea deal and the mother on trial.

Shapiro will fight including those 'lesser' charges hard. There also may not be evidence to support the 1st degree with extreme atrocity and cruelty (judge brought that up).

Even if MM is found not guilty, that doesn't mean RB's plea is null & void, but it certainly helps 'if' the CW decides there is evidence to support her lying and then maybe go after her for perjury...let's hope.

I really (and I think we all) want to hear MM's side of the story! If the defense doesn't put him on the stand then I will assume he had more to do with it than we are all thinking!
