Did JOK have a coat on at the Waterfall? And/or, do we know if KR has said if he was wearing a coat?
 
Body in the yard that victim looks like he was in a fight and the trooper doesn't think that his condition was related to anyone in house or at least investigate that option. Brilliant detective skills at work here, NOT. JMOO

Jackson is running down the list of things that Tully knew about the scene and death of John and yet did not get a search warrant for 34 Fairview.

For example, there was only one shoe found and they did not look inside for the other.

Tully was initially aware that John may have been involved in a physical altercation.
Jackson is trying to say that if John was found with what they thought was injuries from a physical altercation, they would have checked the house where is was found. Yet Tully never did.

As a reminder, Higgins was not interviewed for the first time until weeks after the murder.

Moving on to the Sallyport video.
Tully obtained a copy of video footage from Canton PD.In the last couple of months, he asked the Canton PD to burn him a copy of the Sallyport video.

Tully viewed the inside the Sallyport video and did not make any note that the video was inverted.
He then gave the video to Trooper Bukhenik.

Jackson has asked for the evidence bags from yesterday to be brought back in.

No coat, just from memory. You could check bar vids from a few days ago, that's not to say he didn't have coat in the lexus. As no one (apparently) saw him leaving lexus or in front of of 34 fairview that's all we have I believe. Not sure if KR has said anything outside court proceedings re coat but jury hasn't heard re him wearing a coat imo

Later, when the 3 women went by Fairview (w/ Roberts) it was a frantic Read who spotted the body under the snow before anyone else in the car could even see anything according to previous testimony.

Alan Jackson is cross examining Lt Tully. He suggests the fact that O'Keefe did not have a winter coat on and had one sneaker on might warrant questioning people inside the Albert home. He's also asking about the Canton PD sally port video.

Tully says he saw it briefly, didn't notice it was a mirror image, or inverted.
 
When I first saw Tully I was like OK...this is a pretty normal, intelligent guy...good communicator...let's see what he's got....still waiting....oh wait...that's it??? He's done? A cell phone tutorial and some videos and map of Karen frantically driving around looking for her boyfriend? MMMMkay....why are we still here? What are we doing???
 
#KarenRead Good morning. Day 24 of testimony. Today we expect to hear more from Lt. Brian Tully, who oversees the state police detective unit at the Norfolk DA's Office. He testified yesterday he admonished Tpr Michael Proctor for his crude, offensive comments about Karen Read.


Tully returns to the witness stand. Prosecutor Adam Lally continues his questioning about the evidence search at 34 Fairview Road. Says they didn't search inside the because they didn't have any reason to believe they'd find evidence.


Tully says the legal requirement for a search warrant is that a location more likely than not contains evidence. Says they had no indication O'Keefe ever entered the home.


Tully says O'Keefe's arm abrasions had a certain pattern. Says blunt force from objects can leave such patterns. Starts to say "I'd be comfortable to say the marks on Mr. O'Keefe are consistent with..." Defense objects. Judge sustains.


Tully says they gathered surveillance video from the town library and from Temple Beth Abraham in Canton for the timeframes 12am-1am and 5am-6am. Says those are the times Read was traveling in the area.

Here's Read's SUV passing in front of the library on its way to 34 Fairview Road. The right at the light would be towards O'Keefe's home. The SUV continues north on Washington Street.

Here's Read's SUV back in front of the library at 5:11am. It shows it coming from the direction of O'Keefe's neighborhood towards where the Waterfall bar is located.

Here's the SUV a few minutes later, at 5:15am, heading north in front of the library. It continues towards the synagogue (same path it took to go to 34 Fairview Rd hours earlier.)

Tully testifies that the SUV would have had time to go back to 34 Fairview Road before continuing on to McCabe residence. He says without the detour to the scene, the time of travel is too short.


Tully describes how they use cell tower data to track phone movements. Says phones usually connect to closest tower but not always. Says phone connect to tower for data even when the phone is not actively being used.

Tully says cell phone data shows Read's phone was somewhere on the red arc on this map at 518am. (Prosecution is trying to suggest Read went back to 34 Fairview before going to McCabe's residence.)

Jackson begins cross examination by asking about O'Keefe not being found wearing winter clothing. Jacksons asks if it's reasonable his clothing might have been in the house. Tully says not reasonable, notes he himself wears shorts all winter.


Jackson asks if O'Keefe might have lost his shoe while being dragged by others. Tully says he's never seen that but says it's not impossible.

Tully says he recently asked Canton PD to double check for more video of the garage. Says that's when they got new video. Jackson asks if he noted the video was inverted. Tully says no.
