This was a permanent order in 2017; was re-opened as an "emergency" motion in 2019 (what happened with Rachel in 2019?); was dismissed and then was re-opened again in 2022 as a petition to modify visitation. This was going on for years and even with a final order in 2017, was still never-ending at the time.

Look at the standard of relief required in order to meet the requirements for an emergency motion:

Standard for Relief
  1. There must be sufficient showing that there is an imminent risk of harm or harassment to a party or minor child, unless there is sufficient showing that there will be an imminent loss of jurisdiction or removal of the child from the state.
  2. Purely speculative evidence of harm in [sic] insufficient to grant emergency relief.


There is other relief listed by way of another motion but this emergency motion must be grounded on an actual emergency.

That's not the only case that went that way, look at the one above it.
 
Someone dragged her there? According to MG there was a 15-20' blood trail leading into the tunnel. Of course, we don't know if that is factual at this point. MOOcoukd
Could be whoever grabbed her had her in a chock hold to get her to the tunnel but she broke free and that’s where the rock came into play, so many questions on this one.
 
In a new article in the NYP, we now have MG's father saying that his son is not lying and that his stepdaughter is an acquaintance of Rachel's and he was with a group of people when the body was found.

He also said that his son is going to remain quiet and not say anything further.

Did the newspapers pay for the original interview?
 
Definitely could be random, however statistically the odds are higher she knew the person. If the reports are correct that her face was smashed, then it seems more personal in my opinion. Plus I’m in no way judging…..each their own but she did put her self out there on Facebook and now we hear dating sites. This could have been done by anyone that had a fancy for her at the gym, dating site, or it could have been someone the new boyfriend knows, didn’t one article somewhere say he was living in a recovery house? Maybe someone was feeling jealousy of his new found love. Whoever it is, I just feel they knew who she was.
Murder is likely to be committed by someone you know, but not sure that holds true for murders of women who are jogging in a public park.

We still don't know the details of how she died, aside from the obvious face/head injuries. Some murderers wanting to kill someone would bring weapons, knife/gun/etc if the intent was to kill successfully and efficiently. But if it's just a rock that might've been used, it feels like that's all that was available ... so the vibe I'm getting is that this might've been some random / opportunistic crime. If she knew someone who suddenly wanted her dead, it feels like they could've planned a good ole-knifing/shooting, and not do it with a rock.

I do agree regarding the urgency around using the rock. Significant in my mind.

Could someone remind me of the actual [hysical surroundings? I believe there had been discussion of an apartment complex near by??? So, if so, I truly hope they are investigating residents there.

I was a victim of a stalker once. The perp had --somehow---gotten my phone number, AND he even took some of my laundry out of the laundry room!! LE couldn't do much. This was back in the day when LE exercised severe limitations on bugging a phone.
Anyway... They did catch him.... and he was living in the same large complex as I was, but not super close to my apartment. To this day, I feel trauma thinking about the sneaky things he did, and the sneaky things he SAW. I had no idea how long he was stalking. I actually ended up moving...

And I don't think someone who knew her would leave her body in a public park.

To me, it looks like stranger attack. Hit her with a rock because it's available and affective, dragged her off trail, likely SA, then disappear.

I suspect someone who either hangs out in the park in the woods areas or frequently uses the park, but not a runner. Speculation only.

Another thing that crossed my mind is maybe it could've been someone who had noticed her over time doing her walking/jogging, and maybe might've been interested in her, maybe might've even attempted to chat her up, and perhaps she wasn't interested and/or outright rejection ... and what followed was this attack on her. Not premediated attack, but spontaneous attack.

Maybe, but my hunch is it was a crime of opportunity by a random predator in the park.

Of course, this is speculation only. We'll find out more soon, I expect.

It is interesting that she want for a "daily" spray tan. If her days were very routine, then someone would know she'd be in that park on the trail. If she wasn't routine or rarely went for a walk/run shortly after her workout, that would be something to note as well.

Or it was a crime of passion done in anger. The infuriated murderer just grabbed first thing available and hit Rachel till she stopped moving. Then, when fury dissipated he started to panic and dragged her body to the tunnel, took her clothes off in order to make it look like something else than it was and run away.

Has “death by rock” been confirmed by LE?

Or are you relying on shaky testimony from the friend’s stepfather?

The shakey testimony of the guy who was giving multiple interviews about how he saw the body, and the blood-caked rock, and a 20 foot blood trail, and the victim's friend sitting in a pool of blood after the cops told her to sit down, etc, etc, etc. So the only cause of death in the media has been his version, cops haven't released anything, but they did come out and say he hadn't seen the body at all, but they haven't disputed that there was no blood-caked rock (at least I don't think they have).
