State's attorney: Evidence supports death penalty in Foxwell case

SALISBURY -- A Wicomico County grand jury has indicted the sole suspect in the murder of 11-year-old Sarah Haley Foxwell, a move expected for more than a month as prosecutors built a case against him.

"The evidence has been developed as such that the state will file a notice of intent to seek the death penalty and the notice of intent to seek life without possibility of parole," Davis Ruark, Wicomico County state's attorney, said Tuesday during a news conference.
Thomas James Leggs Jr. of Salisbury, a 30-year-old convicted sex offender, was indicted Monday on first-degree murder, first- and second-degree sex offenses, and kidnapping and burglary charges. Police discovered Foxwell's badly burned body in a wooded area near Delmar on Christmas morning, a somber end to a manhunt effort by law enforcement and more than 3,000 volunteers.
Police first charged Leggs with burglary and kidnapping on Dec. 23, a day after Foxwell's family reported the girl as missing. Since his initial charges, Leggs has been held without bail at the Wicomico County Detention Center.
Ruark said it is impossible to predict when Leggs will be brought to trial. If the case proceeds as a death penalty case, the defendant will have the automatic right for a trial outside of Wicomico County.
Arch McFadden, an attorney with the Office of Public Defender for Wicomico County, said during Leggs' Dec. 29 bond hearing that Leggs denies ever harming Foxwell. McFadden could not be reached for comment Tuesday.
Maryland law stipulates that only specific evidence, such as DNA, can be used to obtain a death penalty conviction. Ruark said last month that his office submitted about 200 items to the Maryland State Police Crime Lab in Pikesville for DNA tests.

The interesting part to this case is out of the 172 convicted sex offenders living in Wicomico County, Leggs is considered high-risk, and Sheriff Lewis says he was actually one of the offenders they checked on often – but didn’t have to. According to the law, Leggs only had to register two times a year with the Wicomico County Sheriff’s office, and the sheriff’s office wasn’t required to check on him – but they did. Sheriff Lewis says in 2009 alone, they visited Legg’s residence he shared with his parents seven times. They found Leggs living in an 8×14 portable shed in the back yard, and he was doing cabinetry work with his family’s business. Investigators have also found Legg’s sister and her three children were living on the property with Leggs and the parents. This information has launched a new investigation to see if those children are victims as well.
On a side note, Sheriff Lewis says he visits the school where Sarah’s younger sister Emma attends, and has lunch with her frequently. He says the child is doing well.

Four days before the birth of the Salisbury girl he would be accused of kidnapping from her bedroom and killing, Thomas J. Leggs Jr. pleaded guilty to his first sex offense.

Over the next 11 years, as Sarah Haley Foxwell grew into a bright, lively middle school student, Leggs was charged with five other crimes against girls and young women, including raping a teenager on a Delaware boardwalk and grabbing a 13-year-old the same day his newborn child was brought home from the hospital.

Despite convictions for a sex offense and the rape of a minor as well as multiple parole violations, Leggs, 30, has eluded serious jail time. The Baltimore Sun reviewed court records for all of Leggs' criminal cases and spoke with several witnesses and past accusers to gain insight into the man charged with the death of the cheerful sixth-grade student whose body was found in a frozen field on Christmas Day.

It's disgusting that this monster was out walking the streets looking for his next prey.
 
I just wish in most states that sex crimes were taken more serious. Its not cute, or boys being boys, or the girl was asking for it. One day he's a leering perv and the next he is kidnapping children or women killing them to get his "kicks". I think most people deem sexually aggressive individuals are harmless or just as some guy that is coming on too strong. Or just a guy that kinda likes them young. I've met guys like this with questionable behaviors and I didnt know what I do now. Its sad really, most people have no clue!
 
Death penalty sought in Foxwell case

SALISBURY -- The death penalty will be sought for the man charged in the kidnapping and murder of Sarah Foxwell.


The Wicomico County State's Attorney's Office announced Friday that Thomas James Leggs Jr., was served the notification that the state would seek the death penalty and the sentence of life without parole.

The 30-year-old Leggs, who is being held at the Wicomico County Detention Center, was re-indicted Friday on first-degree murder, first- and third-degree burglary, kidnapping and sexual offense charges

A four-day Circuit Court trial for Thomas James Leggs Jr., 30, is scheduled to begin May 24.

Leggs was indicted on murder, burglary, kidnapping, sex offense charges after Sarah Haley Foxwell's badly burned body was found in a rural Delmar area.

this is the ONLY guarantee society has that an offender will not re-offend! I encouraged on another site that we all express our wishes to the Judge - we cannot sit by and let these horrendous acts continue as a law-abiding society. I will NEVER forget the large crowd of concerned citizens that appeared at the stadium for the search, so unselfish of them, on all days of days, Christmas.
RIP little Sarah, we will do our best to see that justice is served ...

Bill Requires Mandatory Sentence For 2nd-Degree Child Rape

A measure mandating that a minimum 15-year sentence be imposed in second-degree rape cases in which the victim is a child will likely be sent to the governor's desk for passage.

Family members of a slain 11-year-old girl went to Annapolis Monday to plead with lawmakers to agree on the terms of the bill.

Sara Foxwell, of Salisbury, was kidnapped and killed at Christmastime. Police arrested convicted child sex offender Thomas Leggs Jr. on capital murder charges in connection with the slaying.

"It's to protect our children. Our children should be our first priority. Being a parent of a child who was brutally murdered by a registered sex offender, I'm absolutely appalled that this is even an issue," said Jennifer Foxwell, Sara's mother.

"This case screams death penalty. We can't sit back and let this happen to any of our children at all. It's done. We've got to move forward," said Wicomico County Sheriff Mike Lewis.

The police, Sara's mother and the girl's aunt pressured state House leaders all day to make sure differences in the House and Senate bills increasing jail time for those convicted of second-degree rape of a child are worked out.

Time running out for Jessica's Law enhancement

Less than 12 hours remain in the 2010 General Assembly legislative session and passage of a bill to lengthen penalties for child sex offenders is in doubt.

The measure, contained in two bills (SB 622 and HB 254,) would significantly increase mandatory minimum sentences for second degree child rape and molestation of a child under 13 years of age by anyone over the age of 18. Current law sets the penalty at five years. The problem is that the two bills differ on the mandatory minimum. The Senate bill calls for 20 years to life in prison while the House version sets the penalty at 15 years to life.

A conference committee comprised of three members from each chamber’s judicial panel must hammer out a compromise. As this article goes to press, it appears neither Joe Vallario nor Brian Frosh, chairs of the House and Senate judiciary committees respectively have appointed members to a conference committee

General Assembly passes Jessica's Law enhancement

State legislators approved an enhancement to Jessica’s Law in the waning hours of the 2010 General Assembly. Now, any person convicted of second degree rape or molestation of a child under 13 years old will face a 15 years to life in prison without possibility of parole.

Late Monday evening the Senate rolled the measure into HB 936, Governor O’Malley’s bill, which alters registration requirements for the state’s sex offender registry.

The measure had been stalled because the House and Senate produced bills with different sentences. The House raised sentences from five years to 15 years to life and the Senate raised them to 20 years to life

ANNAPOLIS- One of the primary goals of the state legislature going into the 2010 General Assembly was to strengthen Maryland sexual predator laws, and while not all of the three dozen-plus bills introduced during the session were passed, state lawmakers did make significant strides toward the objective.

One of the hot-button issues going into the 2010 General Assembly session was the need to strengthen the state’s sex offender laws, spurred largely by the tragedy in the Salisbury area in December that claimed the life of 11-year-old Sarah Haley Foxwell, whose body was found near Delmar on Christmas Day. In February, Thomas James Leggs, 30, a registered sex offender in both Maryland and Delaware, was indicted on first-degree murder charges in the death of Foxwell, and the tragic case promulgated renewed scrutiny of Maryland’s sexual predator laws.

Because the Foxwell tragedy occurred in District 38B, which includes Worcester and Somerset counties along with a portion of Wicomico, local Delegates James Mathias and Norman Conway were often at the center of the sex offender law debate, which became a centerpiece during the session. Mathias and Conway sponsored or co-sponsored at least nine individual bills aimed at tightening Maryland’s sex offender laws
